‫الحمد هلل رب العالمين والصالة والسالم على سيدنا محمد خاتم النبيين وعلى آله وصحبه أجمعين‬

‫قرار رقم‪ )3/3( 15 :‬بشأن توظيف الزكاة في مشاريع‪ .‬ذات ريع بال تمليك فردي‪ .‬للمستحق‬
‫إن مجلس مجمع الفقه اإلسالمي الدولي المنعقد في دورة مؤتمره الثالث بعمان عاصمة المملكة‬
‫األردنية الهاشمية من ‪ 13-8‬صفر ‪1407‬هـ‪ ،‬الموافق‪ 16 – 11 .‬تشرين األول ( أكتوبر )‬
‫‪1986‬م‪،‬‬
‫بعد اطالعه على البحوث المقدمة في موضوع‪ .‬توظيف الزكاة في مشاريع‪ .‬ذات ريع بال تمليك‬
‫فردي‪ .‬للمستحق‪ ،‬وبعد استماعه آلراء األعضاء والخبراء فيه‪ ،‬قرر ما يلي‪:‬‬
‫يجوز‪ .‬من حيث المبدأ توظيف‪ .‬أموال الزكاة في مشاريع‪ .‬استثمارية تنتهي بتمليك أصحاب‬
‫االستحقاق للزكاة‪ ،‬أو تكون تابعة للجهة الشرعية المسؤولة عن جمع الزكاة وتوزيعها‪ ،‬على أن‬
‫يكون بعد تلبية الحاجة الماسة الفورية للمستحقين وتوافر الضمانات الكافية للبعد عن الخسائر‪.‬وهللا‬

‫‪The International Council of Fiqh Academy, which is an offshoot of the Organization of‬‬
‫‪Islamic Conferences (OIC), organized its 3rd conference in Amman, Jordan from 8 – 13‬‬
‫‪Safar 1407 AH, which corresponds to 11 – 16 October 1986. Having reviewed the‬‬
‫‪research done on the investment of zakah funds in profit generating projects, without‬‬
‫‪attributing individual ownership to a beneficiary and having listened to the opinions of‬‬
 the members (of the Council) and topical experts, resolved the following:

In principle, it is permissible to invest zakah funds in profit generating projects:

1. Which will eventually conclude with the ownership being transferred to the
recipients of zakah (asnaf); and

2. The investment projects remain under the purview of the zakah collection and
distribution authority. However, it (the investment) should only be made after all
the qualified recipients of zakah have received their dues there are reasonable
assurances that the possibility of the project incurring losses is remote.
