Virgin Mobile is ordered to provide the following records regarding the account with the phone number of
(310) 555-4032.

All personal information used to open the account, such as the subscriber’s name and Social Security Number,
the billing address, the address where the service was connected, if different from the billing address, all
telephone toll records for the last month of the account, if the service included call forwarding, disclose the
forwarded telephone number along with the subscriber’s name and billing address. Include Make, Model,
phone numbers, and ESN numbers of all phones associated with the accounts. Include forms of payment on the
original account also.

These records are to be returned to the Affiant within ten (10) days from the date in which the order is served.
Virgin Mobile, its agents and employees are ordered not to disclose the existence of this court order to the
subscriber(s), unless and until ordered to do so by the court.

(AFFIDAVIT IN SUPPORT OF COURT ORDER)
I, Detective Joe Officer, declare under penalty of perjury, that I am a Police Officer in and for the City
of San Luis Beach, County of Los Angeles, State of California, and have been employed as such
since December 1999. I am presently assigned to the Investigations Bureau, Special Investigations
Unit.

On April 14, 2010 I received information from a citizen informant who gave his/her name, address and
phone number to your affiant. The citizen informant, hereinafter referred to in this affidavit as CI,
spoke with your affiant. Your affiant has had no prior contacts with this citizen informant. The
informant was not under arrest nor a suspect in any crimes. He/She stated that he/she wanted to
give police this information because he/she was concerned about the welfare of the minor’s involved.
The informant appeared to be a citizen acting in the interest of law enforcement and for no other
reason.

The CI told your affiant that a subject was providing/selling narcotics (marijuana) and pharmaceutical
substances (alprazolam {xanax} and clonazepam {klonopin}) to minors in the City of San Luis Beach
and the City of San Miguel Beach. The CI told your affiant that the he/she has overheard
conversations of minors whom attend Jefferson High School in San Miguel Beach and minors whom
attend San Luis Union High School in San Luis Beach discuss details involving their (the minors)
buying/obtaining narcotics/drugs from this particular subject. The CI told your affiant that the minors
refer to the xanax pills obtained from “slut” as “zany bars”. The minors also discussed particular
details about this subject, which the CI overheard. The CI discovered that the subject in particular
goes by a street name of “slut” and is associated with “San Miguel 13”. The CI has been told
generalities about “slut”, including that “slut” is a dangerous person and that the CI would “not want
anything to do with him (“slut”)”. The CI was told that “slut” is a parolee and has spider web tattoos
on his elbows. Through overhearing conversations, the CI discovered that “slut’s” cellular phone
number was 310-555-4032.

Your affiant made attempts through departmental resources to identify “slut” in order to investigate
the claims of the CI, specifically the parolee status of “slut”. Your affiant has not been able to identify
“slut” which would assist in the investigation to verify the existence of felony sales of controlled
substances by “slut”, or any other possible violations of parole.

On April 14th, 2010, your affiant obtained a court order from the Honorable Judge John Thomas for
the release of records from Sprint PCS Wireless for cellular phone number 310-555-4032, which is
attached hereto as Exhibit number 1 and incorporated as if fully set forth herein. Your affiant faxed
the court order to Sprint PCS Wireless on April 14 th, 2010.
On April 20th, 2010, your affiant was notified by Sprint PCS Wireless via faxed letter, which is
attached hereto as Exhibit number 2 and incorporated as if fully set forth herein, that cellular phone
number 310-555-4032 was essentially leased to Virgin Mobile and that Virgin Mobile holds the
subscriber information for cellular phone 310-555-4032. The cellular phone number 310-555-4032
when initially checked by Sprint PCS Wireless shows Sprint PCS Wireless as the owner, however
only after a more thorough check does the cellular phone number show Virgin Mobile as the
subscriber information holder. Your affiant contacted Virgin Mobile and was notified that Virgin
Mobile requested an additional court order before they would release subscriber information.

I request the Court’s permission to obtain records from Virgin Mobile regarding the account listed on
the face page of this document. I believe the records will assist your affiant in the investigation to
identify “slut” and verify the parolee status of “slut” and the existence of felony sales of controlled
substance(s) by “slut”.

This affidavit is sworn to under penalty of perjury and is executed in Los Angeles County on
April 26th, 2010.
