SUBJECT: CINTRON V, VAUGHN SETTLEMENT/CounselFees

In the captioned case, a settlement of this over forty year old matter was achieved and
signed off by the federal court on February 18, 2010.

The Settlement had earlier been presented to the City Council and approved. For your
purposes, the Settlement Agreement provides, at page 6, for payment of counsel fees as ..*
follows:
^ x ^ a. On or before March 31,2010, a check made payable to "Sydney Schulman, Esq." in
•r the amount of sixty-two thousand five hundred dollars ($62,500) for attorneys

fees... and
b. On or before March 31, 2010, a check made payable to Sydney T. Schulman,

Trustee, in the amount often thousand ($10,000) dollars for expenses associated \
with implementing this Agreement... and
c. On or before March 31,2010, a check made payable to "-Sydney Schulman as trustee
for Joseph Moniz" in the amount of sixty-two thousand five hundred dollars ^

($62,500) for attorneys fees shall be issued for fees incurred prior to May 2009...

Those three (3) checks are due now, obviously. There is a "hitch" re the Moniz/trustee
check (No. c, above) since the lawyers (Schulman and Moniz) are trying to get that check
(S62..500) issued directly to Moniz. As of today (March 31,2010), I am still waiting for the

Meanwhile, the other two checks (No. a and No. b, above), payable to Schulman -* " ' """ '
(562,500) and to Schulman, Trustee ($ 1 0,000) should issue, please.

Further, the Settlement Agreement provides for two (2) additional payments of sixty-
two thousand five hundred dollars ($62,500) each to be issued/paid on or before July 3 1 , 201 0
to Sydney Schulman, Esq., for attorneys fees and to Sydney Schwlman, as trustee for Joseph
Moniz.. , for attorneys fees incurred prior to May 2009.
We will get back to you on those after the beginning of the 2010-201 1 fiscal year.
