GENERAL POLICIES ON LEAVES Legal Basis CSC MC 41, s. 1998 as amended by CSC MC 14, s.

1999 Revised Omnibus Rules on Leaves/ Other CSC Issuances on Leaves/ Special Laws Actual Service (Sec. 28) Period of continuous service since the appointment of official or employee, including period/s covered by any approved appointment with pay. y y Policy of actual service took effect on January 15, 1999 in accordance with CSC MC 41, s. 1998. AWOL, unauthorized sick leave without pay, suspension of one day or more (administrative penalty) preventive suspension, vacation leave without pay considered gap/s in the continuity of service. Sec. 56(d), Rule IV, CSC MC 19, 1999 (URACCS ) during the period of suspension, respondent shall not be entitled to money benefits including leave credits Authorized sick leave with or without pay ( on account of illness ) shall counted as part of actual service ( Sec. 28, CSC MC 41 s. 1998 as amended) Declared holidays, non- working/ off- duty days where services are NOT required are NOT considered gaps in service; these are excluded in the computation of vacation and sick leave (Sec.29,CSC MC 41 s.1998 as amended)

10 KINDS / CATEGORIES OF LEAVES NATURE OF EMPLOYMENT 1. Vacation and Sick Leave Credits 15 days vacation and 15 days sick leave for EVERY year of actual sevice 2. Leave Benefits For BARANGAY Officials 30 days EVERY year 3. Vacation Service Credits for TEACHERS GENDER 4. 10 Days Leave Privilege for Victims of Violence which may be continuous or intermittent 5. Maternity Leave 60 calendar days subject to service requirement - FULL pay for those with 2 or more years of government service - HALF pay for those with 1 year or less of government service - PROPORTION for those with more than 1 year but less than 2 years of government service. ( Sec. 12, CSC MC 41 s. 1998 as amended) Example X= 540/12 Where X refers to the number of days to be paid for employee who has rendered 1 year and 6 months 6. Paternity Leave 7 working days for a maximum of 4 paternity leaves

Parental Leave 7 working days EVERY year VACATION AND SICK LEAVE ENTITLEMENT to Vacation and Sick Leave Credits l- 15 days vacation and 15 days sick leave for each year of actual service without limitation as to the number of days the officials and employees may accumulate CONDITIONS y y y y APPOINTIVE officials up to the level of heads of executive departments, heads of departments, undersecretaries and employees of the government Valid appointment regardless of status for appointive officials ( permanent, temporary, contractual, casual ) Rendition of work during prescribed office/work hours Officials / employees with 10 days or more vacation leave credits shall be required to go on 5 days vacation leave every year, subject to the conditions provided in Section 25, CSC MC 41 s. 1998, as amended 1. Staggered schedule of 5 day vacation leave is prepared in consultation with employees, provided that the head of agency may cancel any previously scheduled leave in the exigency of service 2. Mandatory 5 day vacation leave is forfeited if not taken during the year; Scheduled vacation leave that has been cancelled in the exigency of service shall no longer be deducted from total vacation leave 3. Separation ( retirement, resignation ) from the service without completing the calendar year is not subject to the mandatory 5 day vacation leave 4. Those who avail of monetization of leaves for 10 days or more are required to go on mandatory 5 day vacation leave Vacation Leave is contingent upon the needs of the service and subject to the discretion of the Head of Agency Sick Leave granted only on account of illness or disability on the part of employee or any member of employee s IMMEDIATE family Immediate Family- refers to spouse, children, parents, unmarried brothers and sisters and any relative living under the SAME roof. OR dependent upon the employees for support (CSC MC 6 s. 1999)

Conditions and Requirements in the availment of vacation / sick leave ( Sec. 49 to 54, CSC MC 41 s. 1998 ) o Leave application including terminal leave shall be deemed approved if not acted within five ( 5) working days from receipt (Sec. 49) o NO SALARY / BENEFIT shall be given to official or employee during the period of UNAUTHORIZED leave ( absent without approved leave ( Sec. 50 ) o Vacation leave application of one ( 1 ) day or more shall be submitted on prescribed form n5 days in advance, whenever possible of the effective date of leave ( Sec. 51); Grant of vacation leave is at the discretion of the head of department / agency ( Sec. 52 ) o Sick Leave application of one ( 1 ) day or more shall be filed immediately upon employee s return from sick leave, provided notice of absence is sent supervisor/head of office ( Sec. 53) o Medical Certificate required for sick leave in excess of 5 successive days, sick leave filed in advance, or in case of doubt, regardless of the number of days (Sec. 53-54) o Approval of sick leave with or without pay is MANDATORY provided proof of sickness or disability is attached to sick leave application ( Sec. 54) LIMIT of leave without pay one ( 1 ) year, Clearance from head of agency/department for leave without pay in excess of one (1) month ( Sec. 57); Automatic separation from the service for failure to report for work after expiration of one year leave of absence without pay ( Sec. 62 ) Employee detained in jail services are automatically suspended, automatically considered on leave without pay; no money benefits/leave credits during detention period ( CSC Res. 99-1879. August 23, 1999 ) Earned V/S leaves during the approved extended period ( rendered by personnel beyond 65 years) shall not be commuted nor added as part of terminal leaves ( CSC Res. 040229, March 5, 2004 ) Exhaustion of unused Vacation and Sick Leave Credits PRIOR to effective date of separation ( resignation, retirement ) from the service, such that the official or employee would remain in government payroll, instead of monetizing said leave credits. MISCELLANEOUS POLICIES ON VACATION AND SICK LEAVE y Vacation and Sick Leave No limit in the accumulation and commutation beginning CY 1986, provided an official or employee goes on leave for at least five (5) days vacation leave for each year of actual service. Computation of Vacation and Sick Leaves 1 day vacation leave and 1 days sick leave for every 24 days of actual service using the tables of computation in Sec. 27, CSC MC 41, s. 1998 as

amended. For every 30/31 days of actual service (including Saturdays, Sundays and holidays, employee earns 1.25 vacation and 1.25 sick leave credits. EFFECT OF ABSENCES WITHOUT APPROVED LEAVE MONETIZATION OF LEAVE CREDITS y y y Minimum of 10 up to 30 days vacation leave credits each year, subject to approval of agency head, availability of funds, and compliance with the mandatory vacation leave. Monetization of additional vacation leave credits, beyond 30 days vacation leave, subject to approval/discretion of head of agency and availability of funds. After exhausting vacation leave credits, monetization of up to 50% of available sick leave credits, subject to CSC MC 16 s. 2002 (order of priorities, Sec. 23 of CSC MC 41 s. 1998 as amended: (1) Health, medical, hospital needs; (2) Financial aid and assistance due to force majeure as calamities, typhoons, fire, earthquake; (3) educational needs, (4) Payment of mortgages and loans; (5) Extreme financial needs; (6) Other analogous cases as may be determined by the CSC.
