Trafficking in persons: gender based Injustice towards Women

Abstract
Trafficking in persons has become a major transnational organised crime over the centuries. The history of trafficking can be traced down to the era of slavery and now it has assumed a wider shape in the form of trafficking in persons. It involved both sexual exploitation and labour exploitation of its victims. Men, women and even children are included in the list of victims but the trafficked women are generally the victims of sexual exploitation. The people who are disproportionately affected by poverty, discrimination and factors that impede their access to education, employment and other resources are the target of the traffickers. The reason behind this is that there is nobody so educated in their families to advocate their cause and fight for infringement of rights. In this paper efforts have been made to address the issues and problems faced by women due to trafficking, response of the society, legal mechanism adopted by UNODC wherein the human rights of the trafficked persons will also be concentrated upon, role of NGOs and other institutions in uplifting the standard of life of the trafficked persons and the position in India. While dealing with the Indian scenario the law prohibiting trafficking i.e. Immoral Trafficking Prevention Act, 1986 will be critically appraised, highlighting the loopholes in the Act due to which there is inefficient implementation. The paper addresses the issue of trafficking from gender and rights perspective. It recognises the similarities and differences in the experience of trafficked women. The special needs and situations through empowerment and other mechanism have been focused in the paper. It is

concluded with observations and suggestions made to improvise the situation and provide remedies to the victims of the human trafficking.
