Such answer should reach the Office of the Supervisor of the Town of Hyde Park at 627 Albany Post Road, Hyde Park, New York 12538 at or before 4:00 P.M. in the afternoon of said _ day of April, 1998.

You are entitled to a hearing on the above charges and to be represented by an attorney. You should be prepared at such hearing to present such witnesses and other proof as you may have in your
defense against these charges.

You are hereby notified that you may have a hearing pursuant to Section 75 of the Civil Service Law or a hearing before the Town Board sifting as the trial commission as provided for in the Rules and Regulations. At the time ofthe submission ofyour Answer, you should indicate which procedure you wish to follow. Absent a decision as the procedure to be followed, you shall be deemed to have selected the procedure under Section 75 ofthe Civil Service Law. Pursuant to said procedure please be advised that the Town Board has selected Edmund V. Caplicki, Jr. as the Impartial Hearing Ofiicer. Please be advised that you will be notified of the time, date and place of saidhearing.

Ifyou

are found guilty ofthe above charges, you are hereby advised that the appointing authority will consider your employment record in determining the penalty to be imposed. You may at that time present an explanation concerning the adverse contents, ifany, ofyour personnel file.

The penalty or punishment imposed on you, upon a finding of guilt, may consist of either dismissal from the service, a demotion in grade and title, suspension without pay for a period of not exceeding two months, a fine not exceeding $100.00, or a reprimand.

TI{E PROPOSED PENALTY IS 30 DAY SUSPENSION WITHOUT PAY ON EACH CHARGE. AII further notices and communications addressed to you in connection with these charges will be mailed to your latest address on record in the Personnel Office of the Town of Hyde Park which address is 429 Dutchess Turnpike, Poughkeepsie, New York, 12601unless you request in writing that the same be sent to you at a different address.
