US Food and Drug Administration (FDA) inspected facilities located overseas in India.

The World Trade Organization (WTO) treaties between nations protect patents and
trademarks. India is one of few nations that selected a patenting scheme based upon
protection of the manufacturing process (Process Patents) rather than using the more
common scheme of protecting the actual product (Product Patents).
Indian Patent law therefore allows scientists to legally manufacture a drug that has been
patented. In other words, a drug that is already under patent law may be duplicated as
long as a different process is used to create the same drug (or active ingredient) than the
process used in the original patent. As a result, Indian pharmaceutical chemists use
reverse engineering to legally create drugs. These drugs, that are still patent protected in
some areas, are sold worldwide. As a result, these patented drugs can be marketed at
prices that reflect their real manufacturing costs rather than a monopoly price that has
been determined by competition, high costs of research and development, advertising,
and promotions to doctors and the US public. Finally, because India has very strict price
controls on the retail selling prices of drugs, Indian pharmacies are inhibited from being
able to raise their prices higher than these limits. The result is that India has become the
largest producer of generic drugs in the world; drugs which have continuously met high
health and medical standards.
Our drugs are manufactured in India, whose enormous pharmaceutical industry is largely
owned and operated by U.S. drug companies. All of our medications are factory machine

Pharmaceutical Exports
India enjoys significant comparative advantages in this fast emerging sector in terms of
knowledge, skills, costs and institutional infrastructure.
With the product patent regime round the corner and the ever increasing thrust on the US
generic markets by the Indian pharmaceutical companies, the United States Food and
Drugs Administration (USFDA) is contemplating branching out to India. Besides Delhi,
cities like Mumbai and Hyderabad are being considered for locating its branch office.
“USFDA’s decision to set up an office in India is expected to save considerable time. The
office will enable exchange of information between the US authorities and Indian pharma
companies,” sources told ET.
“Besides the product patent regime, USFDA is also looking at India because India has the
largest number of USFDA approved pharma plants (outside USA),” sources added. India
is currently home to as many as 61 USFDA approved pharma plants.
Indian pharma companies are expected to notch a turnover of $12 billion by 2008 as
against the current revenues of $7 billion. “Indian pharma companies have gained global
recognition as producers of low-cost and high-quality bulk drugs and formulations,” they
said.
The list includes the US-based Ivax Corporation, Israeli drug maker Taro
Pharmaceuticals and the US-based Merck & Co, all of which are understood to be
sounding drug industry lobbies here on either buying local drug companies, or setting
up plants in India. Health equipment manufacturing companies like Australia's Uscom,
too, are also leaping into India.
Germany's Hexal AG, which has set up a liaison office in Secunderabad, is now
planning a full-fledged push into India. Gerhard Schaefer, director, business
development, Hexal AG said: "Hexal has decided to build a formulation plant in
Bangalore and is in the process of acquiring land and completing other formalities. The
products to be manufactured there, from 2006 onwards will be exported to Hexal's
subsidiaries in all parts of the world. Hexal will invest at least 10 million Euros in the

One of the largest drug manufactures, Cipla manufactures and markets bulk drugs and
formulations. It is now ranked second in India by ORG in terms of retail pharmaceutical
sales. All the bulk drug facilities have been approved by the US FDA, and the
formulation facilities have been approved by the Medicine Control Agency, UK; the
Medicine Control Council, South Africa; the Therapeutic Goods Administration,
Australia; and other international agencies.
Cipla has a very wide product range which includes antibiotics, anti-bacterials, anti-
asthmatics, anti-inflammatory anthelminites, anti-cancer, and cardiovasculars. In
domestic formulation market, antibiotics are the mainstay, and contribute to
approximately 50% of the company's revenue. Some of the leading brands are Ciplox
