Overview
Manystateshaveenacted"cyberstalking"or"cyberharassment"lawsorhavelawsthatexplicitlyincludeelectronicformsofcommunicationwithinmore
traditionalstalkingorharassmentlaws.Inaddition,recentconcernsaboutprotectingminorsfromonlinebullyingorharassmenthaveledstatestoenact
"cyberbullying"laws.Thischartidentifiesonlystatelawsthatincludespecificreferencestoelectroniccommunication.However,otherstatelawsmaystillapply
tothosewhoharass,threatenorbullyothersonline,althoughspecificlanguagemaymakethelawseasiertoenforce.Thischartclassifiesthevariousstatelaws
addressingthesethreedifferenttypesofonlinebehaviors,asdescribedbelow.
Cyberstalking.CyberstalkingistheuseoftheInternet,emailorotherelectroniccommunicationstostalk,andgenerallyreferstoapatternofthreateningor
maliciousbehaviors.CyberstalkingmaybeconsideredthemostdangerousofthethreetypesofInternetharassment,basedonaposingcrediblethreatofharm.
Sanctionsrangefrommisdemeanorstofelonies.
Cyberharassment.Cyberharassmentdiffersfromcyberstalkinginthatitisgenerallydefinedasnotinvolvingacrediblethreat.Cyberharassmentusuallypertains
tothreateningorharassingemailmessages,instantmessages,ortoblogentriesorwebsitesdedicatedsolelytotormentinganindividual.Somestatesapproach
cyberharrassmentbyincludinglanguageaddressingelectroniccommunicationsingeneralharassmentstatutes,whileothershavecreatedstandalone
cyberharassmentstatutes.
