WHEREAS the undersigned property owners have agrced to enter into this agreenent for the upkeep and naintenance of the herein described road, lccated in Tubac, Santa Cruz county, and vhereas the property osners have legal. access to their properties over the folLowing deeded easenent (road), said rcad belng an easement for ingress arrd egress to U.S. Highiray 89 is set forth in a Deed recorded in Santa Cruz County records at Docket Book 59 at page 61. to wit: ,'... (A)n easenent and right of way for road purposes, tlrenty feet ln vridth, for use as a rdeanE of ingress and egress to sald portion of said Northeast quarter herei-nabove nore particularly described, (See Attachnent A), by foot, by anixnal, and by vehicle, extending fron the llorth boundary of said portion in a general Northerly direction and by the nost feasable (sj.c) route. to a certain road upon lands currently ouned by Marcella Y. Allen, a hridon, lading to and connecting with the Tucson-lrogales public gighnay (U.s. Highnay 89), and the right to the use of said road for lngress and egress to and fron said Tucson-Nogales public highuay throughout the entire course of said road upon the lands of the said MarcelLa Y. AIIen, and upon the lands of any other person or perso:rs to the extent that said parties of the first part have an interest therein, it being the intention of said lrarties of the first part to grant to said parties of the second part their neans of ingress and egress over the iands of the said tlarcella y. Allen and upon an established road between said public highway and sald portion of land hereinabove parlicularly delcribed and conveyed by these presents,...rr.
