Borough Attorney Paster explained the different types of easements and that the appraisals will assess the value (if any) of easements required to move forward with the Flood Control Project Phase II. Members of the Council questioned a number of addresses listed on Ordinance #1386. The information will be confirmed with the engineers.
According to the police there was supposed to be a left turn only out of the driveway on Shadyside, which is not stated in the agreement. Correspondence was received by the Mayor and Council from Kai Chen, 90 Teak Road, Dumont, N.J. in which he asked whether the individual in Resolution #09-152 is the same individual appointed as Certified Tree Laborer in Resolution #09-07. He also asked whether Mr. Sherban was credentialed either by the State or the industry. ORDINANCES First Reading #1386 Acquisition of Easements in furtherance of the NJEIT Phase II Project-ordinance authorizing the purchase or other acquisition of easements, temporary and/ or permanent, and/or rights of entry on various real properties on the tax map of the Borough of Dumont to effectuate the NJEIT Phase II drainage project. Administrator Perkins Report The Borough received a grant from the County in the amount of $100,300 for Short Street, Veterans Plaza and Locust. The grant is about half the amount requested so the project will have to be prioritized. The electrical for the hut renovation project will be separated from the total from the engineering firm. Three proposals were received; the low bid came from East West at a price of $9,625. Mr. Perkins recommends that East West be used for the electrical part of the project. A letter was received from OSHA stating that the Police Department has now met all the requirements. An application for handicap ramps and doors at the library and senior center was submitted. We were then notified that the criteria for the grant had changed and the Borough is not eligible for the grant. After being notified of the issue of buses traveling on New Milford Avenue, N.J. Transit has taken action and notified the bus drivers they are not allowed to drive on that road before 8:00 AM and after 5:00 PM. Attorneys Report All of the executed easements from the property owners around the Virginia/New Milford Avenue intersection have been received. The parish needs approval from HUD to grant the easement. An appeal was filed by the Boroughs litigation counsel regarding the Bland v. Dumont lawsuit. Mr. Paster has been working with T&M and Suburban Title to effectuate property rights acquisition for the NJEIT Flood Control Project. Only one bid was received for co-location of a wireless communication antenna on the borough owned monopole. That bid was received from MetroPCS New York. The Borough of Demarest has expressed interest in an interlocal agreement related to Dumonts tree pruning equipment and personnel which would be a way of defraying costs. Mr. Paster plans on conferring with the Borough Engineer to determine the parameters for an easement on Lincoln Avenue. A date should be scheduled for a hearing regarding legal escrow disputed by a resident. There was discussion about making a portion of Brook Street one way.
Council Committee Reports Councilman McQuade There was discussion about making a portion of Brook Street one way. Board of Health A swine flu vaccine will be coming out soon. Some students have the flu and are being checked to make sure it is not swine flu. Councilman Caspare Environmental Commission There was no meeting last month because several members had to attend an event at the high school. Councilman Manna Police The police committee continues discussion in preparing to meet with the PBA about their contract. Councilman Riquelme Joint Land Use Board At last weeks meeting there was one formal hearing, which passed. The professionals will be appointed at the next meeting following RFQ review. Shade Tree Commission Many trees have been planted. Councilwoman Zamechansky Recreation Many items which had been included in the Hut project have been pulled out. Painting, for example, can be done by the Borough. Councilman Stylianou 5K Run The committee continues to meet and is seeking sponsors. Board of Education On June 11th the Board of Education will be honoring staff members who have twenty-five years of service. Mayors Report The Mayor asked for recommendations for capital projects by July 1st. Motion to go into closed session to discuss litigation: Councilman Manna Second: Councilman Stylianou All in favor. Mayor McHale and Borough Council: My question is regarding Resolution #09-152. I would like to know whether the individual appointed is the same individual appointed as Certified Tree Laborer under Resolution #09-07 on January 6, 2009. As recorded on the minutes of the January 20 public meeting, I had requested whether the individual appointed was credentialed either by the state (New Jersey Board of Tree Experts) or the industry (International Society of Arboriculture) given the title. Mr. Perkins indicated that he would get back to me. As of today; however, I have received no response from Mr. Perkins. I recall that Mr. Perkins, Councilman Caspare and others praised the individual on his performance, which is reassuring; however, I am concerned whether appointing an individual for a credentialed title when those credentials may not have been completed by the individual sets a risky precedent for future personnel appointments. I would appreciate it if this letter could be entered into the minutes during the public participation-consent agenda only and the response entered into the minutes as well. A new thermostat was installed. The main sewer line backed up twice in the police area and was repaired. Joint Land Use Board The first meeting is scheduled for January 26th at 7:30 PM. DPW In the month of December eighty catch basins were cleaned and forty-one potholes were repaired. Shade Tree Commission They are working on providing a $250 scholarship for a high school senior pursuing an education in the field. The members are planning on meeting to discuss Arbor Day. There are currently twenty-two trees included in the Adopt-A-Tree program. The next meeting is scheduled for February 16th in the Library. Councilman McQuade Finance The committee will review last years budget line by line. Board of Health There are two resolutions on tonights agenda for approval of Animal Control and Health Department agreements with the County. There have been complaints of no heat from some of the Dumont Terrace Apartments residents. A member of the Building Department went to check on the issue. Councilwoman Zamechansky Last month the councilwoman and Administrator Perkins went to the police graduation. Chief Venezio was recognized and received the Chiefs Achievement Award. Senior Citizens The Seniors will have a Super Bowl party. Meet and greet is scheduled for February 8th. Recreation Plans for the Memorial Day Parade are in progress. Councilman Manna Police The dispatchers handled a total of 5,999 calls in the month of December. Members of the Patrol Division investigated forty-seven motor vehicle accidents. Patrol officers issued two hundred seventy-seven motor vehicle summonses. The Detective Bureau referred three cases to the Prosecutors office. Chief Venezio received the Bergen County Chiefs Chief of Police Achievement Award. Borough Administrators Report The Borough will be receiving $5,375 from the Bergen County Utilities Authority for sewer connection fees. Shared Services-The Board of Education has agreed to allow the Recreation program to use its school buses when needed during the summer. There will be a substantial savings. Three projects, which include the EIT Phase II project, the Howard Street project, and the videotaping of the boroughs sewer system have been submitted for consideration for the Presidents Stimulus Package. The asbestos removal has been completed from the house at the New Milford and Washington Avenue Intersection.

He also asked what impact there would be on the bond ordinance if the money from the Stimulus is received. He thanked the Governing Body for putting the minutes on the website quickly. 3. Jennifer Kircher of 170 New York Avenue had a concern about neighborhood cats on her property. She asked whether the Borough could pass an ordinance to prevent house cats from roaming. Council President Remarks Mr. Manna stated that the Borough and the nation face many challenges. In times like this we have to be creative in our approach to problem-solving. Times like this call us to maintain civility. The economy will dictate that we prioritize based on our needs and affordability. We as a community will be looking at the following this coming year: Joint Land Use Board; road and storm water projects; parks, playgrounds and recreation projects; environmental and green projects; looking at the most effective way to broadcast meetings via the web. With the help of our commissions, boards and the willingness of our residents to get involved we will weather these difficult times together.
Councilman Caspare thanked the residents who voted for him. He also thanked the candidates who ran against them in the election for their diligence and work ethic. Councilman Riquelme thanked the people of Dumont for giving him another year to work for them and the Borough. Councilman McQuade commented that this Council can discuss their differences and then come to a conclusion which is best for this community. This is one of the most diverse councils in Bergen County.
