TRAINEE AGREEMENT
THIS AGREEMENT is made on ______________________. BETWEEN: 1. EXCELSURE MARKETING CORPORATION (the Company) 2. ___________________________________ (the Trainee) NOW IT IS HEREBY AGREED as follows: In consideration for the outsourcing by the Company, the parties agree as follows:

1. That under the terms of this Agreement, the company agrees to provide the Trainee with a work-training period; 2. That the trainee is expected to attend the work-training period for work experience, which will commence on _____________________ and shall end on ________________________; 3. That any tasks undertaken by the Trainee while on work-training period will have the purpose of promoting the Trainee's competence, understanding and familiarity of the companys business as well as in the Trainee's chosen work area; 4. That the Trainee will be under an obligation to the company and to himself to make satisfactory progress on the work-training period program, which will be agreed with the Trainee. Failure to do so may result in the termination of this Agreement. 5. The Trainee will be expected to reach a reasonable standard of competence and performance for each task for which he has been trained. Failure to do so may lead to the termination of the traineeship; 6. That the Trainee will have no contractual relationship with the company and that his training contract is not an employment contract. However, the Trainee will be expected to behave as a part of the company on whatever position he is assigned and shall abide by all the terms and conditions applicable to the companys own staff and respect the company's policies and procedures; 7. That the Trainee will be paid a daily training salary, inclusive of his daily allowance, in the amount of Two Hundred Fifty Pesos (P 250.00) for Bicol Area and Three Hundred Pesos (P 300.00), which will be paid after his training period; 8. That the payment in connection with Paragraph seven (7) shall be paid in the form of check issued to the trainee and shall be received by the same except by others with the written consent of the trainee; 9. That the Trainee must keep a record of attendance each day. If he/she is assigned for office work, through the Daily Time Record and if assigned in the field, the trainer must sign the record of attendance of the trainee in the Daily Time Record. Failure to do so will result in the deduction of an equivalent amount of his absent based in the stipulation indicated in paragraph seven on this agreement; 10. That the trainee will be unable to attend the training, his trainer must be informed within one hour of the normal starting time on the first day of absence. Failure to do so shall mean forfeiture of the training period; 11. That the Trainee wishing to terminate the traineeship period must give one-day notice to hi trainer; 12. That the company may terminate the traineeship period during the training period itself if the trainee is unsatisfactory and by the discretion of the trainer to terminate the trainees training. The following shall be the grounds for immediate termination of the trainee yet this list is not exhaustive: a. Persistent unauthorised absences

b. Incapacity to attend work-training experience due to illegal drugs or alcohol c. Abusive language to the companys customers or employees d. Aggressive and/or abusive behavior to any employees of the company; e. Misuse of equipment belonging to company f. Fraud or any criminal offence g. Theft of property belonging to the company h. Assault on any member of staff, customers, or public 13. That after the trainee successfully ended his training period indicated in the paragraph two, his contract training with the company also ended; 14. That the progress and performance of all Trainees will be reviewed after the training period and performance review shall be conducted with the following criteria: a. Standard of work and behaviour during period b. Attendance and performance c. Time keeping & Attendance record d. Conduct; 15. That after a careful evaluation of trainees, those who did not passed the training course shall not be among who will have the chance to work in the company;

IN WITNESS OF WHICH the parties have assigned this agreement that day and year first abovewritten.
