House-arrest inmate charged with attempted murder

Victim in Apple Mountain Road stabbing identified as suspects wife
reported. Ricky Henrys last known address was also reported as 90 Rambo Court, Linden, VA. According to Sheriff Daniel McEathron, Henry was serving a sentence on drug related charges and was in the Warren County Jails Work Release Home Electronic Monitoring Program at the time of the attack. It was not immediately clear if either or both the assailant and victim were currently utilizing the unfortunatelynamed Rambo Court home address at the time of the attack. Ricky Henry was transported to Warren Memorial Hospital and was treated for minor injuries he suffered during the incident. Henry was released from the hospital and transported to the Warren County Jail where he was served two arrest warrants: one for attempted first degree murder and the other for aggravated malicious wounding of Lakisha Henry. Ricky Henry is being held without bond on both charges and his next court date is set for August 17, 01 at 10 a.m. in Juvenile & Domestic Relations Court.

Ricky Brian Henry

By Roger Bianchini Warren County Report On August 14, 01 at 5:47 p.m. the Warren County Sheriff s Office received a 911 call advising of a stabbing in progress at the school bus stop, pull-off area at the entrance to the Apple Mountain Subdivision on Apple Mountain Road. When deputies arrived on scene they found bystanders treating a white female who had multiple stab wounds. In a WCSO press release the following day, the female victim was identified as Lakisha Henry, 33 years of age, with the last known address of 90 Rambo Court, Linden, VA. Deputies also located the suspect, identified as Ricky Brian Henry, white male, 3, and the husband of the victim, who was subdued by bystanders at the scene. Lakisha Henry was treated at the scene by medical personnel. She was then transferred by helicopter to INOVA Hospital in Fairfax where she was still in Intensive Care, listed in critical condition the day after the attack. Mrs. Henry suffered numerous stab wounds to her entire body, the WCSO press release reported. Initial unverified information received by this reporter indicated the victim was putting children into a van at the Apple Mountain Road bus stop/pull over at the time she was attacked by her husband; and that Ricky Henry was subdued at the scene by three males present at the time of the attack. One person said a witness told her the assailant came out of the woods on foot. Ricky Henry was taken into custody by the deputies on scene without incident, the Aug. 15 press release

Pickup slams into old Stickleys Stationary building

Shortly after 4 p.m. Thursday afternoon, Aug. 16, a pickup truck, believed to have been northbound, left North Royal Avenue and slammed into the front window of the vacant Stickleys Stationary building next to the Liberty Gas Station on the 500 block of North Royal Avenue. Police were questioning a man at the scene who appeared uninjured, if somewhat distressed, as other officeers were cordoning off the entire block and diverting traffic off that block of North Royal Avenue. Now we know the Front Royal Town Council has been discussing easing up commercial parking restrictions to help facilitate commercial development of vacant properties, but this may be taking that line of thought a little too far. No further detail was available at press time.

Three arrested on Georgia warrants, drugs

Talk about bad company. Research of our archives revealed this online post of a press release from Sheriff McEathron, dated March 9, 011 On March 8, 011 at approximately 9:15 p.m. Warren County Sheriff s deputies assisted U.S. Marshals with the execution of fugitive arrest warrants. The deputies and U.S. Marshals arrested Stephen Damon Ferguson, age 31, of Rambo Court, Linden, VA on a probation violation extradition warrant from the State of Georgia. Also arrested was Robert Joe Farmer, age 35, of 90 Rambo Court, Linden, VA on a failure to appear on assault and battery, cruelty to children, terroristic threats extradition warrant from the State of Georgia. During the execution of the arrests at 90 Rambo Court, illegal narcotics were observed, which resulted in the felony arrest of Ricky Brian Henry, age 30, of 90 Rambo Court, Linden, VA for possession with intent to sell or distribute more than five pounds of marijuana. The narcotics case was turned over to the Northwest Virginia Regional Drug Task Force. Stephen Damon Ferguson and Robert Joe Farmer are currently being held without bond at the Warren County Jail. Ricky Brian Henry was released on a $10,000 secured bond. This is the charge Henry is believed to have been under home incarceration on at the time of the Aug. 14, 01 attack on his wife. Warren County Circuit Court Clerks office records indicate Henry has a local rap sheet including 1 counts of Grand Larceny, Statutory Burglary and Petit Larceny occurring on either Jan. 9, 009 or June 13, 000; as well as multiple related Probation Violation and Revocation hearings. At issue for many, particularly friends and relatives of the victim, will be how someone with Henrys extensive rap sheet was able to get house arrest/work release on his most recent conviction stemming from the March 8, 011, U.S. Mar-

shall-led bust and Henrys association with out-of-state fugitives wanted by the federal government?

Letters
those affected will find some measure of comfort in knowing that they do not grieve alone. People from all walks of life in our Commonwealth, these United States, and across the world share with you the shock, confusion, anger and despair. You are not alone. The people of this Commonwealth and these United States stand in unity with the Sikh community. As we remember the lives of the departed and pray for a swift recovery for those healing from the attack, our hearts go out to their family members, loved ones and all those affected by this terrible tragedy.

A daughters thanks
Ladies and gentlemen, I am proud to say that my dad is a police officer. My dad is a K9 sergeant and his name is Bryan Courtney. He was the one who was attacked by Clyde Burrell. On the night of July 8th, when my mom, Cindy, came back home from the Emergency Room after she had seen my dad, my mom asked me, Do you want to see your dad? I said, Yeah, and me and mom rode with Captain Clint Keller to Warren Memorial Hospital. So I was there to see him that night. And now I look at dad and think WOW, hes made an amazing recovery! For those of you who are concerned about my dad, he is OK, except his right thumb still is purple, his shoulder hurts, and his right eye is still bloody. Luckily, dads corneal abrasion has healed for the most part and the stitches that were in his head were taken out on Aug. 3. I thank the vacationers from Kentucky and citizens nearby that came to my dads rescue. I also thank the nice gentleman who wrote to you guys and whose letter was published. His name is Paul Jaffe. Paul, thank you for the nice comments

Choosing a Running Mate
By Nick Thomas Have you been wondering how Mitt Romney really chose Wisconsin Rep. Paul Ryan as his running mate for the November elections? Let me explain, with the aid of some politically modified, internet jokes. Romney invited Ryan on a weekend camping trip, along with his other short list candidates: Virginia Gov. Bob McDonnell, Ohio Sen. Rob Portman, New Jersey Gov. Chris Christie, and Florida Sen. Marco Rubio. Whoever displayed the greatest intelligence and resourcefulness, Romney promised to select as his VP running mate. So Early the first morning, the men rented a large pontoon boat and headed off to fish. Soon, they ran out of bait. So Rubio stood up and walked across the water to get some more bait, then returned to the boat the same way. But after hours, they ran out of bait again. This time McDonnell volunteered to get more bait ... so he got up and walked across the water, too. After another hour of fishing they run out of bait again, so Tim Pawlenty offered to go. But as he stepped out of the boat, he sank straight to the bottom. Turning to the others, Rubio grinned and said, I guess he didnt see the rocks. And Romney sent Pawlenty home. The next morning, the men were up bright and

early and again headed out in the boat. They had a successful day catching plenty of fish so Romney said to the others, This is such a great spot, we need to mark it so we can come back. Portman agreed, and proceeded to etch a mark on the side of the boat. What are you doing Rob? asked McDonnell. Marking the spot, replied Portman. Dont be stupid! snapped McDonnell. What if we dont get the same boat next time? So McDonnell and Portman were both sent packing. Sitting around the campfire that evening, the remaining men began talking. So Marco, said Romney to Rubio, what did you do about that old car I heard you were trying to sell - the one that had 50,000 miles on it? Well, Ill tell you, but you must keep this to yourself, whispered Rubio. I took it to a friend who owns a car repair shop. He turned the odometer back 00,000 miles and said I shouldnt have any problems selling the car! Really? asked Romney. Well how much do you think youll get for it now? Oh I didnt sell it, answered Rubio proudly. Why should I? It only has 50,000 miles on it! And Rubio was sent home. The following morning, Romney and Christie set off to hunt, but soon it was clear that the possible future leaders of the free world were totally lost. Now dont panic, Romney said reassuringly to Christie. I know just what to do. Were supposed to shoot up into the air three times and someone will hear us and come with help. Okay, said Christie. So he shoots three times into the air.

They waited an hour, but no one showed up. So Christie shot three more times, but still no help arrived. Bewildered, he tried this again and they waited another hour. Eventually, Christie started to look a little worried. As he tried again, he said to Romney, It had better work this time Mitt, were down to our last three arrows. And Christie was sent home. The final day of the trip, Romney and Ryan spent it fishing from the riverbank. Suddenly, the game warden jumped out from behind the bushes. Immediately, Ryan threw his fishing rod down and started running through the woods at full speed, hotly pursued by the game warden. After about a mile, Ryan collapsed to catch his breath and the game warden finally caught up to him. Okay pal, lets see your fishing license! demanded the warden. Ryan pulled out his wallet and gave the game warden a valid fishing license. Well, whats the matter with you? asked the astonished the game warden. You have a valid fishing license - you didnt have to run from me! Yes sir, I did, replied Ryan. Mitt back there - whos on his way home by now - well, he didnt have one. And thats how Paul Ryan became Mitt Romneys running mate! Ready to get back to work - damaged digit or not, Sgt. Bryan Courtney gives us a thumbs up as wife Cindy looks on
By Roger Bianchini Warren County Report The Front Royal Police Department hosted National Night Out on Tuesday, August 7, from 6-9 PM in the Gazebo area of East Main Street in historic downtown Front Royal. National Night Out is a crime prevention initiative celebrated across the nation, sponsored by the National Association of Town Watch (NATW) and co-sponsored by the Front Royal Police Department. The Front Royal Police Foundation sponsored the band Souled Out, who played the entire evening. After some pretty avant-garde chromatic tuning that Souled Out band members seemed to be jamming with at times, the Warren County High School Band opened the festivities at 6 PM with the national anthem and some rah-rah music to get everyone going. The event is seen as promoting a strengthening of the law enforcement-community partnership bond. And it was great to see FRPD Officer Bryan Courtney with son Nathan and wife Cindy at the event. Courtney looked great, with just a few remaining facial bruises and a patched thumb about 10 days after being attacked by a suspect while responding to reports of someone exposing themselves to passing motorists on the northside of town on July 8. It seemed to us an especially successful event, perhaps with community awareness of the importance of local law enforcement and that community-police relationship brought to the forefront of everyones mind by Sgt. Courtneys encounter with a large and possibly intoxicated or unstable suspect.

Jason Lethcoe introduces 26th District state Senator Mark Obenshain to some heavy artillery. Lethcoe, who helped man the Tactical Unit display, used some improvised tactics in coming to aid of fellow officer Bryan Courtney on July 28.
Over 60 vendors engaged in family safety education with lessons in stranger danger, Neighborhood Watch, safe casting with fishing equipment and safe food handling; not to mention feeding hungry people from stands including Two Fat Butchers BBQ and Tony Ts Apple Farm apple strudels and more mmmm, food. There were also free McGruff backpacks for the first 00 children to visit the VIPS booth. Target, a national sponsor, had lessons in bicycle safety and gave away a bicycle and document shredding was available by TrueShred to help keep your affairs secret and prevent identity theft. Among those addressing the crowd were Front Royal Mayor Tim Darr, FRPD Chief Richard Furr, who is retiring at the end of the month, 6th District State Senator Mark Obenshain, FRPD Community Relations Specialist Janice Hart, among others. AND Souled Out got everyone on the good foot.

Animal world

After 2 years shelter horses still seeking a home

Undoubtedly they are an attraction that brings people to the shelter in search of a dog or cat. There generally plenty of fence hangers watching, the days Ive visited. Kathy encourages kids to feed a carrot or an apple to the now friendly horses. Kathy has taught them manners and asked local horse trainer George Lewis to gentle them on his own farm. George continues to help with hay supplies, as do Rockland residents Thomas McGeath and Maurice Bowen. Im really appreciative of what these gentlemen and others do for the girls, Kathy said. Also, Southern States, the Police Foundation, and others have been a great help. Individual donors have contributed several hundred dollars in recent months, thus the new line item in the shelter budget. Shes pleased with his development, because she said she didnt want to take away anything from all the other animals. While she credits Central Virginia Equine Rescue in Charlottesville with staying in touch, she says they and other horse rescue operations are inundated with animals people cant afford to keep. Its not that they dont want to help (by giving shelter) but they know the girls have a good (but temporary) home here, so they probably reach out for others who have more desperate needs, Kathy said. She has mailed hand written letters and information sheets and photographs to people who have expressed interest but its the same old story - no room at the inn. Anyway, she added, philosophically, it only takes one yes... WHAT WE NOW REALLY NEED-AND YOU SHOULD WRITE THIS IN CAPITAL LETTERS-IS WHAT WE CALL A ROUND PEN TO HELP WITH THEIR TRAINING, Kathy said, and the Report is only too pleased to cooperate! She appealed to local farmers to look at their inventories this fall to see if they can either give or loan a round pen (call 540-635-4734). The shelter executive director is Lavenda Denney. [Malcolm Barr, Sr., a contributing writer, has been a member of HSWC since 2002, president 200911, and president of the Hampshire Racing & Breeding (Thoroughbred) Partnerships 1989-2010. He is a lifetime member of the AKCs Japanese Chin Club of America (JCCA) and has been involved in breed rescue (JCCARE) since 1974]

Kathy Brugh gives Shaline and Lalique some TLC time at the shelter and she is working hard to find a permanent home for this duo of Arabians.
By Malcolm Barr Sr. Warren County Report On a weekend last month, I recalled the arrival in Front Royal precisely two years earlier of two mares, Arabians, the very day their time ran out, the day they were to be euthanized. So, on the spur of the moment, I visited them at the Julia Wagner Animal Shelter. They came to the fence seeking handouts; I had none, but sneaked a kiss on the nose of one of them while the other strutted away in apparent disgust. My fault! I remember well, in my second term as president of the Humane Society of Warren County (HSWC), the early morning telephone call from former shelter executive director Carol Ann Fox, describing the plight of Shaline and Lalique, victims of an estate disposal sale near Charlottesville. A dozen horses were part of the estate and the heirs demanded their disposal, by adoption or the abattoir. Their longtime veterinarian found homes for all but two of the Arabians, then began desperately calling neighboring counties for help. The buck stopped with Carol Ann and me - the girls, as they were to become known, came from afar but what were we here for but to provide shelter to animals in need? They arrived by truck three hours later, around noon, and so began their new lease on life. The two bay mares have been at the shelter ever since. Despite earlier successes in placing several large animals, including other horses, a Shetland pony, a big ole mule, a goat or two, Lalique and Shaline inherited problems not of their making--the death of a doting owner, of course, but also the sudden economic downturn in our town and the nation. People today cannot afford to keep their own horses, never mind adopt them into their pastures, said a volunteer at the shelter the day I stopped by in July. And nor would we have been able to step forward if not for the fact the HSWC, with help from Cedarville Ruritan Club and a group of individual volunteers, fenced off about an acre of its property and built a run-in shed specifically for horses. Over 4 months, folks have looked even volunteered in a couple of cases to take the girls but none ultimately came through with the forever home the Arabians needed and deserved. Then along came a Fairy Godmother to take over what my knees refused to allow me to do feed the girls, keep their shed and pasture clean, and more. For the last thirteen months, local horse fancier Kathy Brugh has given care, training, cleaning and feeding of the two animals, while searching every known Internet site and local farms to find a permanent home for the two orphans. Meanwhile, Shaline and Lalique have collected quite a fan club. People, businesses and nonprofits have donated funds specifically for the care of the horses. It was quite a milestone when they became a line item on the shelter budget, joked Kathy Brugh while she encouraged the girls in their exercises -- swiftly cantering on command at about 0 mph around the perimeter. Kathy is there, in back of the animals shelter, four days a week on average, and if youre lucky enough to be there too, the horses provide one of the best free shows in the county!

Asleep at the Wheel The Kings of Western Swing

albums. As a kid growing up in suburban Philadelphia, Benson constantly listened to roots and country music and did not let anyone restrict his musical boundaries. As a kid performer, he led a band called The 4 Gs which consisted of his sister and him. We toured all over the Philadelphia area and sang folk music, Kingston trio and Carter Family. That is where it all started. Now, older, wiser and with hundreds of thousands of miles under his belt, Benson is excited to come down to Orkney Springs with Asleep at the Wheel to perform at the Shenandoah Valley Music Festival on September . Gates open at 5 p.m. and the show starts at 7 p.m. Expect excitement, expect thrills, and expect music like youve never seen before. We are completely reinventing western music and putting on a live show that will be hard not to dance to. In 1977, the band was voted Best Country Western Band by Rolling Stone and awarded the Touring Band of the Year by the Academy of Country Music. Since its inception in 1970, the band has earned nine Grammy awards, released more than 5 studio albums and, in 1975, their tune The Letter That Johnny Walker Read, placed No. 10 on the Billboard charts. Amid all the awards and fame aside, Asleep at the Wheel is still keeping up with the changing landscape of western swing. Even while touring the frontier for over 40 years, the band has managed to remain on the upswing by using remarkable improvisation and techniques. The Asleep at the Wheel concert is the last concert of the 49th anniversary season. Tickets can be purchased online at www.musicfest.org or at (540) 459-3396.

Sarah Hasnain Special to WCR Have you ever seen a wheel try to reinvent itself while its still rolling? The nations most famous western swing, boogie and roots band, Asleep at the Wheel, has done just that, making live shows an exquisite treat for concert goers. Lasting more than 40 years and having more than 80 members associated with the band, Asleep at the Wheel remains the king of the genre, constantly reinventing their signature sound and improving the music. I have seen all of the changes the band has been through these past decades and with all of that, we have encompassed amazing growth, Ray Benson, the bands famous leader and front man said. The reinvention began when new vocalist Elizabeth McQueen invited comparison with the classic female vocalists of the bands earlier era, while fiddler singer Jason Roberts gave the band a second male lead

voice to complement Bensons immediately identifiable baritone. Its the changes with the vocalists and different sound techniques that make watching Asleep at the Wheel even more breathtaking at a live show than listening on a CD. Thats the deal. Every night we are always looking for something new for our audience to hear. It is what separates us from many other swing bands, Benson noted. They initially started in the genre of Americana roots and country but as time progressed, they later switched over and remained to be a western swing band. It just slowly evolved that way. We all became proficient in our instruments and because of that, we were able to enlarge our palette and use different vocals. In addition, they also take insight from their predecessors, making sure their audience never forgets that their forefathers helped them shape the western swing band they are today. On our album, Willie and the Wheel in which Willie Nelson was our guest collaborator, we zeroed in on the western swing from the 1930s and 40s as opposed to the modern swing we hear today. It was definitely a great change from our past

What Exactly Did Bob Goodlatte Agree To?

Incumbent agrees to debate just not in front of most constituents
(On Aug. 13, Andy Schmookler, Democratic Nominee for Congress in the 6th District, issued this statement) After my press conferences at the beginning of August challenging Bob Goodlatte to debate, I was pleased that he accepted. But it is far from clear whether Mr. Goodlatte is willing to debate in a way that serves the people. In one troubling development, Mr. Goodlatte has reportedly told those in Roanoke who were trying to arrange a debate that he would be unwilling to participate in any debate that would be televised. I would like to ask Mr. Goodlatte how he can justify that position if he is committed to the idea that elections should serve the needs of the voters, and not the ambitions of the politicians. Does he want to debate only if almost no one gets to watch? Also, Mr. Goodlatte did not respond to the two proposals I made regarding our debates in the letter that I sent him, which I read at my press conferences. First, I proposed that the format for these debates be determined not by the candidates or the political parties but by some independent organization, like the League of Women Voters, that would keep the interests of the voters paramount. I want to know if Mr. Goodlatte accepts that proposal. Second, I proposed that we have at least three debates one in each of the three main populations centers of our District (Roanoke, Lynchburg, and Harrisonburg). In a district as vast as ours, that seems the least we can do so that voters throughout our District can attend debates and compare their choices side by side. I would like to know if Mr. Goodlatte agrees to that proposal of holding at least three debates across the District. These are things that we, as public servants, should be willing to do. That is especially true because the two forces Mr. Goodlatte and I represent in this campaign are so fundamentally opposed. This battle goes deeper than the usual politics, deeper than liberal vs. conservative. My position is that Mr. Goodlatte has betrayed the peoples trust and that in this race I am the one the people can rely on to fight for them against the destructive and dishonest force he so willingly serves. He and his political party have a pattern of serving their own ambitions at the expense of the people and of the nation. Thats at the heart of Americas crisis today. And that is what my challenge to Mr. Goodlatte is all about. Let the voters hear this case argued. As for Goodlattes excitement at Mitt Romneys pick for vice president on his ticket, Schmookler issued the following statement: Bob Goodlatte says hes excited that Mitt Romney has chosen Paul Ryan for his running mate. No wonder. Congressman Goodlatte voted twice for the infamous Ryan budget, which would gut Medicare and rob Americas senior citizens of trillions of dollars in order to fund yet another tax cut for the very richest Americans. (Andy Schmookler is an award-winning author and political commentator whos done talk radio in the Shenandoah Valley for nearly twenty years. He is running for public office for the first time because of what he terms a profound crisis of the spirit on the U.S. political scene.)

Goodlatte calls for Fed banking accountability to Congress

On July 5, the U.S. House of Representatives passed the Federal Reserve Transparency Act (H.R. 459), introduced by Rep. Ron Paul, by a bipartisan vote of 37-98. As a cosponsor of H.R. 459, I supported this legislation to provide the Government Accountability Office (GAO) with the authority to fully audit the Federal Reserve System, commonly referred to as the Fed H.R. 459 would also require the GAO to submit a report to Congress following the audit, bob Goodlatte said in a press release. The GAO is currently prohibited from auditing monetary policy operations, foreign transactions, and the operations of the Federal Open Market Committee, the primary policy-making body through which monetary policy is formulated. This lack of transparency is particularly troubling considering the fact that the Fed lent out nearly $16 trillion over the course of the current financial crisis more than the total economic output of the United States in 011. The Feds monetary policy decisions affect every single American. You have a right to know how the government spends and leverages your taxpayer dollars. I believe it is fundamental that we provide stronger oversight of the Fed, and I urge my colleagues in the Senate to take up this common sense legislation, Goodlatte concluded.

Im not sure waiting a month would change my mind. I think this is the wrong location Im not going to support this. - Planning Commission Chairman Mark Bower on applicant request for a delayed vote

Planning Commission cries fowl play on request

County planners join EDA in opposing chicken slaughterhouse
seasons. Fallon said he had inadvertently omitted that information during discussion with county staff. He also said the facility might eventually be upgraded to move as many 5,000 birds through the slaughterhouse per week and wanted that option included. However, unanswered questions about the amount of fowl waste that could make its way into the town sewer system and eventually the Shenandoah River from the slaughterhouse appeared bothersome to the commission. Im very concerned with run off what assurances are there that blood will not get into the Front Royal system and into the Shenandoah River? Bower asked, adding, Im not sure how youd even monitor it. Im not sure either it would be very tough, Planning Director Logan replied. Fallon attempted to ease those concerns, referencing a two-bucket redundancy in the waste collection process and health department requirements designed to minimize

Chairman Mark Bower, left, and Doug Rosen were part of a tough crowd.
By Roger Bianchini Warren County Report On Aug. 8 the Warren County Planning Commission added its unanimous opinion to that of the Front Royal-Warren County Economic Development Authority on a request that would allow poultry abattoir to be added to county uses on industrially-zoned land and that opinion was NO! Abattoir is a polite way to say slaughterhouse. The request from NONSUCH IV, LC for a zoning amendment adding poultry slaughterhouse to uses permitted by Conditional Use Permit on Industrial land in Warren County would allow Ayrshire Farm to expand its current plant in the Kelley Industrial Park from a transfer and shipping poultry operation to a transfer, slaughter and shipping operation. Representatives of the company lauded its process as a humane method of mass execution of chicken, turkey and other game foul that eventually make their way to our lunch and dinner tables. The birds are stunned first so they dont know whats happening after that, a company rep assured county officials of the fowls level of perception at the time of death. However the notion of first this, then possibly other slaughterhouses in the midst of county industrial

property seemed less than appetizing to some even if it does taste like chicken. Why does the EDA oppose this? Planning Commission Chairman Mark Bower asked county Planning Director Taryn Logan. Logan replied the EDA was concerned the requested use was not compatible with other existing uses in the industrial park and would make it harder to market vacant properties in the future. She added the EDA was nervous about creating a precedent on such uses throughout the countys industrial land and was standing firm in its opposition. The only two speakers Bill Barnett and Walt Moyer at the public hearing supported the request. And Ayrshire attorney Merle Fallon pointed to a letter of support from Nina Weissberg, president of Cedarville LLC, the investment company owning surrounding vacant commercial property. Fallon told the commission that one proposed condition limiting the number of birds slaughtered to 700 to 1,000, three times a week, would have to be raised because those numbers went higher during holiday

This is the facility of our choice [for that expansion], Fallon replied. But with no hard answers as to why the fowl slaughter operation couldnt be expanded in Loudoun or how much waste might get into the municipal sewer system and river, the commission consensus was negative. Applicant attorney Fallon suggested tabling the vote for a month to allow the company to research answers, rather than face a no vote based on unanswered questions. Im not sure waiting a month would change my mind. I think this is the wrong location Im not going to support this, Bower said, starting a domino effect from his colleagues. I agree with Mr. Bower. I dont believe this is the place to start weakening uses for our industrial sites, Rosen chimed in. Stickley said his reasons were more technical, focusing on the projected increase in numbers of slaughtered birds going through the plant, as well as associated increases in truck traffic in and out. I dont see any advantage to Warren County its not going to create a lot of jobs; there has been a lot of opposition, Lorraine Smelser added. Where is it going to end? Robert Myers asked, completing the bandwagon rush toward unanimous voice votes recommending denial of both the zoning and CUP requests. Now it moves to a vote of the board of supervisors following a yet to be scheduled public hearing there. And Shenandoah District Supervisor Richard Traczyks explanation at the previous days supervisors meeting to potential callers on the issue to direct those calls mostly complaints apparently to Logan because the proposal was in front of the planning commission is no longer valid. waste escaping the plants closed system. But Scott Stickley pressed Fallon on the issue. How much water goes down the drain? Stickley asked. A company rep said that the current slaughter facility tied to the Ayrshire Farm operation in Loudoun County worked off a well system and wasnt connected to a municipal water-sewer system, so there was no way to estimate run off based on that operation. However, it was added the proposed facility here was estimated to run 15,000 to 17,000 gallons through the town water-sewer system per month. Both Chairman Bower and Commissioner Doug Rosen questioned Fallon as to why Ayrshire Farm didnt simply expand its slaughtering operation at the Loudoun County Farm where the birds are raised. Fallon replied there were limitations due to multiple types of animals, including beef moving through the farm to be slaughtered elsewhere. I dont understand You dont slaughter chickens at Loudoun County? Rosen asked. He was assured they did but were limited in the number allowed to be slaughtered. Why not expand the operation there? Rosen pressed.

right-wing allegations against President Barack Obama. As reported in that story, we later found out one of those people, a woman who with her daughter confronted 6th District Congressional candidate Andy Schmookler over an unsubstantiated quote they attributed to President Obama on pro-life issues, left in a huff and went directly to Front Royal Police headquarters in an attempt to have this reporters camera and photos she believed were taken during their encounter with Schmookler seized. Little did we know that was just the tip of a much larger lobbying effort by Jessica Dominguez targeting this reporter. That effort was revealed by a Freedom of Information Act request to FRPD about the womans allegations against us. According to police records FOIAed to us, after her initial July 7 visit, Jessica Dominguez returned to FRPD headquarters on July 8, 10th and 11th in ongoing attempts to have our camera or photographs seized; have us arrested on of all things child pornography statutes; and finally have FRPD violate federal FOIA law in order to keep her identity secret. You cant make this stuff up so well let FRPD describe its encounters with Ms. Dominguez: July 7, 4: PM Sgt. R. S. Bauserman supplemental notes: Jessica Dominguez, along with her daughter [name redacted] came to the PD regarding someone taking pictures of the daughter without her permission while inside the Demo-

I then made contact with the subjects in the PD lobby, advising that Officer Kellers advice was correct. The mother still appeared to be disenchanted with my response. The mother then requested I identify the subject responsible for taking the photos and retrieve them. Bauserman then elaborated that there was no statute enabling her request but that he would check with

battery was dying and charging and recharging the flash very slowly, the only photo I got of either Dominguez was the one published of the mother I didnt even get one of Mama Dominguez shielding her daughter by sticking her posterior in front of my camera, saying, Take a picture of this. But with that fact unknown to all but me, Dominguez returned to FRPD the next day for my favorite part of this psychological melodrama. July 8, 3:30 PM These are the supplemental notes of Officer (Zachary) King: On the above date and time I, Officer King, spoke with Jessica Dominguez in the lobby of the Police Department. Ms. Dominguez stated that she wanted me to look at Virginia Code Section 18-374 because she believes Roger Bianchini to be in violation. Upon reviewing the above code section, it was found that the code refers

Commonwealths Attorney Brian Madden for verification of that opinion. Mr. Madden was in agreement that no crime had been committed and if any photos had been obtained I could not demand they be turned over, Bauserman wrote. When he went to relay Maddens opinion to Dominguez, he found she had left police headquarters. Contacting Officer Keller by radio, Bauserman discovered Dominguez

was back at Democratic headquarters with her daughter and Keller in tow. Bauserman informed Keller that the commonwealths attorney had verified their opinions. Officer Keller then advised the situation was about the same and I should come by the headquarters. Upon my arrival I located all parties and saw that the mother was still unhappy with the situation and still wanted me to locate the photographer and retrieve the photos. Further

investigation revealed the subject that may have taken the photo(s) was Roger Bianchini of the Warren County Report. (I was gone from my Saturday afternoon reporting assignment by then) Through further conversations with local Democratic officials about the incident, Dominquez the elder continued to press police to seize the imagined photos she believed had been taken. Perhaps the funniest part of this is that because my camera

to communication devices publishing photographs of minors in child pornography and other sex crimes. I advised Dominguez that Bianchini committed no offense when he took photographs of her daughter while standing in a public venue with no expectation of privacy. Myself, Officer Keller and Sgt. Bauserman had explained to Dominguez on yesterdays date (07/10/01) that Bianchini committed no offense. July 10, 4:18 PM Capt. Clint Keller On July 10, 01 I spoke to a person on the phone identifying herself as Jessica Dominguez. Dominguez stated she had an incident this past Saturday at the Democratic Headquarters in which she made a police report. Dominguez advised that the person taking her daughters picture was Roger Bianchini (Warren County Report). She is fearful that he will file for a FOIA and obtain her and her daughters personal information. Ms. Dominguez stated she did not want him getting that information as she is fearful he will retaliate and smear them in the newspaper (reporters note: I guess this public record of her actions will be considered that smear I wonder what I should consider her allegations I was trafficking sex photos of her daughter?). I explained to her that we have to go by Federal Code dealing with FOIA and that we do not give out date of birth or social security information but that names and address may be subject to FOIA. I advised her that I would speak to the Town Attorneys

office for guidance on this issue and get back to her. Additional info about Kellers contact with Assistant Town Attorney George Sonnett is then reported. July 1, 9:07 AM Patrolman Sammy Keller Keller recounts Capt. Kellers conversation of the previous day with Ms. Dominguez, adding, she wanted to sign a form not to allow information to be released. Officer Keller spoke with Shelley (town attorneys secretary) about the release of information. Shelley advised that the mothers name would be released, however no information about the daughter would be released. Ms. Dominguez was informed of that information. Officer Keller also advised her that the FOIA request could not be blocked and that we must comply with law. Ms. Dominguez also requested that an officer contact Roger Bianchini to get any photographs that were taken of her daughter. Officer Keller then notified Sgt. Bauserman about the request and Bauserman stated we were not going to get involved with that issue Video of the interview with Dominguez was downloaded to the main computer. Gee guys, can I FOIA a copy of that too?!!? Oh, never mind I dont want to put you through all that again History truth is that the pro-life community is PROTECTING DEFENSELESS UNBORN HUMAN LIFE. Mr. Bodine writes abortion rights were killed as a very hostile attempt to counter the reality that it is abortion that KILLS AN UNBORN HUMAN LIFE. Mr. Bodine fervently favors using the technical term fetus, again, in an attempt to deHUMANize the unborn HUMAN life. Perhaps to allay the guilt or consciences of those that know that they are choosing to kill an unborn HUMAN life. The pro-aborts that choose to kill unborn human life, like naral, planned parenthood, the multi-billion dollar abortion business giant that perpetrates sex-trafficking of young girls and is US tax-payer funded etc., actually have a PRO-ABORT AGENDA because it is HIGHLY PROFITABLE. Since 1973, for about 40 years, the pro-abort agenda has been pushed and allowed for the 56 million unborn human lives to be killed and emotionally maul their mothers. It is time to face the truth that prochoice (to kill unborn human life) HURTS WOMEN and KILLS HUMAN LIFE! Sincerely, Jessica Dominguez Warren County (Managing editors note: both this publication and the editor of the Capital News Service stand by the fairness and content of the referenced story by Michael Bodine. And this editor must comment on the tendency reflected by Ms. Dominguez to present pro-fetal life opinions as undisputed, unassailable fact, rather than a highly complex and debatable issue as reflected in several articles in this edition (Feb. 3) of Warren County Report. We also edited from the letter a reference to Planned Parenthood as slanderous and inaccurate. However, we will include it here only to illustrate the writers particular mindset Planned Parenthood, the multi-billion dollar abortion business giant that perpetrates sex-trafficking of young girls and is US tax-payer funded. Despite such unsubstantiated hyperbole from the writer, or others in the pro-fetal life lobby, abortions account for only three percent of publicly-funded Planned Parenthoods medical activities on behalf of the health of American women. And Dominguezs assertion Planned Parenthood perpetuates sex-trafficking of young girls because it does not bar prostitutes from medical services speaks to the type of irrational hysteria that characterizes so much of the rhetoric of religious extremists who seem hell-bent on forcing their no-quarters perception of reality on all Americans under the guise of religious freedom.)

Wells Bill lobbies county for Browntown Road safety

By Roger Bianchini Warren County Report Browntown Road safety advocate Wells Bill brought his case for increased attention from both the county and Virginia Department of Transportation to the Aug. 7 meeting of the Warren County Board of Supervisors. His public comments appearance followed an approximate 80-minute July 5 meeting with county and VDOT staff. Bill referenced that earlier meeting while acknowledging his difficulty in summarizing the breadth of its content to the 3 to 5 minutes he had to publicly revisit the issues he has brought forth before the entire board of supervisors. But limited or not, Bill rolled on in his inimitable style. He summarized his personal efforts in galvanizing a unified front of residents along the 5-plus mile stretch of Browntown Road, including the intersection with Rocky Lane. Of 9 homes contacted, he got 8 signatures indicating support of his efforts; 5 who disagreed speed was an issue Im not slowing down for anybody Bill reported of that groups mindset; and 5 who agreed in principal but said they did not sign petitions. He compared his result, an approximate 90-percent positive response to a county survey circulated by mail that got only an 8 percent total response. At the root of those numbers and Bills efforts is a belief that excessive speed and line of sight problems created by overgrowth in roadside foliage have combined to make that 5mile section of Browntown Road an extreme hazard to the public safety of those who travel that road. To support that belief, Bill pointed to the rash of accidents, the most recent involving a 6-year-old female resident within the past 10 days. Among the others cited was the one that severely injured Skyline High student James Brogan on his way to school one rainy morning last school year. In a July 19 letter to VDOT resident engineer Cliff Balderson, Bill listed Brogans accident as well as two others involving Skyline students, and one close call he was personally involved in among five specific incidents he believes are directly related to speed and associated safety issues he has raised. 1. Mr. W.R. Bill and Ms. E.F. Russell were almost killed at the intersection of Browntown Road (Rt. 649) and Rocky Lane (607) on 15 October 011 when their vehicle was clipped by a motorist traveling at an excessive rate of speed on 649. . On 11 January 01 a horrible crash involving a Skyline High School student (Brogan) occurred less than mile from intersection 649 & 607. 3. On 19 April 01 a three vehicle incident occurred involving the child of a high ranking Warren County official at the intersection of 649 & 607. 4. On 16 July 01 another horrible crash involving a Skyline High School student occurred directly across from intersection 649 & 607. 5. Resident of Browntown, Nancy Deavers, explained her granddaughter demolished the family Jeep at the intersection of 649 & 607 approximately one year ago. Her granddaughter attended Skyline High School. He added observations about residential entrances, signage and speed to those incidents: 1. On Browntown Road (649) there is an approximate total of 80 plus private driveway entrances, state road intersections and small farm entrances within the 3.6 mile stretch from Hickory Hill Road (650) south to the Freedom Club. . The white sign speed limit is 45 mph - with certain areas yellow signed at 35 mph within the aforementioned 3.6 mile stretch. Bill is seeking a traffic study to determine the speed at which that stretch of road is being traveled by motorists, as well as more governmental oversight of line of sight overgrowth problems. But pointing to a lack of such public works in that regard, Bill noted that at his own time and expense he has engaged in brush cutbacks. Bill summarized what he thinks needs to be done in his letter to VDOTs Balderson: 1. to reduce the existing white sign 45 mph speed limit on Browntown Road (649) to 35mph from Hickory Hill Road (650) south to the Freedom Club a distance of 3.6 miles; and to reduce the yellow sign 35 mph speed limit to 30 mph at appropriate locations within the aforementioned stretch; . to address and implement the necessary steps to obtain compliance by the motoring public to the posted limits; 3. to clear and remove tree limbs on the southwest side of Browntown Road (649) in the vicinity of Rocky Lane (607) in order to increase the sight distance for vehicles attempting to access 649 from 607; 4. to replace the inadequate culvert on Rt. 607 at mailbox 176 and to widen the eastern .45 tenths of a mile of 607 to allow normal passage when oncoming vehicles are encountered. Following Bills presentation to the supervisors on Aug. 7, County Administrator Doug Stanley told us, As the Board discussed at the end of the meeting, they will discuss Mr. Bills request at an upcoming work session. Cliff [Balderson] is looking at the issues Mr. Bill brought up at our meeting on July 5th and will report back to the County on some of the sight distance concerns to see what VDOT can address. I think it cost the County 3 x $5,000 approximately for the reviews of Rockland, Fairground and Morgan Ford Roads. I think Cliff said this one could cost a little more (than $5,000) due to the 5+ mile length of area to be determined. The study would tell us what the current traffic speed is and we will know from that if drivers are following the current speed limits. I had contacted Sheriff McEathron after the July 5th meeting and requested some additional enforcement/presence along this stretch of road. Bill noted an increased sheriff s office presence on Browntown Road during his Aug. 7 comments. He said he saw a deputy monitoring speed from a doctors office parking lot, leading to some slamming on of brakes by passing motorists. He thanked the county for that increased law enforcement presence aimed at slowing traffic down. He also told the board he was formalizing his request for a speed study and additional county and VDOT attention to the issues he has raised by his appearance before them. During earlier comments during his general VDOT report of past and potential speed studies, Balderson acknowledged the need to establish whether existing speed limits were the primary issue or a failure to adhere to the speed limit was the root cause of the problems and accidents cited by Bill.

Engles Angle: Surprises and Speedos

By Kevin S. Engle Warren County Report In the pool today, Michael Phelps won another Damn it! I yell as I jump out of my chair to change the radio station. Ive already heard more than I wanted to. Im happy for Michael Phelps, but I didnt want to know how he did until tonight, when my wife and I tuned in to the Summer Olympics. But in todays world of instant communication, thats about as likely as the two of us winning a medal in the mixed team synchronized swimming event. No matter how hard Ive tried, its been almost impossible to go through an entire day without hearing who won gold, silver and bronze. I cant listen to the radio when the news comes on at the top of the hour. I cant turn on the TV for the same reason. And I certainly cant surf the web without seeing results plastered across my computer screen. All is takes is a few words, or a picture of an athlete on the medal stand to ruin the surprise. At least some radio and TV stations warn you with a spoiler alert before they spill the beans. Doesnt anyone like to be surprised anymore? Do you really want someone to tell you how the movie ends when youre walking into the theater? Or the surprise twist in the last few pages of that new book you just started? Did you know that only 17% of expectant parents wait until the big day to find out the sex of their baby? Actually, I just made that number up, but you get the idea. I like surprises, especially good ones. I dont want to know what Im getting for Christmas until Christmas. Thats part of the fun. And I dont want to know who won Olympic events before I watch them on TV. But several days into the Games, I realized something. It doesnt really matter. Why? Because I cant stay up late enough to watch them anyway. That alarm clock goes off early enough as it is. I dont have anything against diving or beach volleyball, but I wish NBC wouldnt lead off every prime time telecast with those events. How about showing some swimming and gymnastics first for a change? When NBC gets around to airing what I really want to see, usually at 10:00 or later, Im already in bed. Ive seen so much diving that I could do an inward 3 somersault with a 3.2 degree of difficulty. And yeah, Id nail it. And heres an even better reason to show diving later at night, after Ive gone to bed. Those swimsuits the guys wear? I dont need to see those. Im embarrassed just watching on TV. They might as well scrap the Speedos and use a few pieces of duct tape to keep things in place. The women beach volleyball players wear more than they do. So what do I do? Do I give in and listen to those spoiler alerts throughout the day, or do I stay up until midnight and see for myself? I did what any world class swimmer would do. I shaved my chest hair. It didnt solve anything, but Ill swim faster. Oh, there is no such thing as mixed team synchronized swimming. Even if there were, it wouldnt be on until after diving.

Texas Chainsaw Horns slated for Sept. 1 Dancin Downtown

Downtown Front Royal, Inc. (DFR) is pleased to announce that Dancin Downtown re-turns to historic Downtown Front Royal, Saturday, September 1 from 6 PM to 10:30 PM. The event has become a time-honored community gathering, bringing both Front Royal and Warren County residents together for an old-fashioned neighborhood celebration. Its just a nice way to celebrate the end of summer and the start of fall, Executive Director Jim Martin said. Dancin Downtown has always highlighted regional and local musicians, and this time will be no different. The Texas Chainsaw Horns mark their return to Front Royal, bringing their high energy and style to rock as the featured entertainers. Food and drink vendors will be on hand, Martin said, and many of Main Street s cornerstone restaurants will be open during the event. While weather is always changing and unpredictable, clouds or even a light sprinkle will not keep the event from going forward. If overcast, bring an umbrella. Gates open at 6 PM. Tickets remain just $5 at the gates, and children under the age of 1 are admitted free. Dancin Downtown ushers in the numerous downtown-area fall events. The Front Royal-Warren County Chamber of Commerce Brew and Blues Festival, the Warren Heritage Societys Annual Festival of Leaves, and Downtown Front Royals own Hometown Halloween event are all planned for later this Fall. For more information, visit www.downtownfrontroyal.org, or contact Downtown Front Royal, Inc. at 631-0099. (From a release)

Over 17,000 attend 2012 Warren County Fair

Its mini-pull on Tuesday with Twice as Wild

schedule included WDW wrestling, a lawnmower pull, comedian James Gregory, ATV drag races, singer Aaron Tippin and the Star Family Circus & Thrill Show. The new Rappahannock (Electric Cooperative) Community Stage was a big hit, Joye said and added that theyd like to advertise early on for next year and get a lot more local entertainers. Its a great place for people to sit back in comfortable chairs and relax, she said. Aaron Tippen played on Friday and Joye said that people in charge of working the stage gave him a high rating because he was so nice and down-to-earth.

He said our Fair was Homey. Our people always try to make them feel at home and safe, she said. The monster truck show, Thrashen Hollar Bluegrass Band, The Fabulous Hubcaps, and a motocross exhibition, wrapped up the events on Saturday. The Monster Truck Show had the hill above the back field packed with people, and one of the contestants in the motocross event flipped his bike up backwards and broke his foot, said Joye. Thursdays ever-popular Stoney Roberts Demolition Derby, in its 49th season and sponsored by Marlow Motors, was also held in the back field and attracted a huge crowd which stretched up the hill to the Midway.

By Carol Ballard Warren County Report Love of Country, hometown Warren County and country living was the underlying feeling at the 55th annual Warren County Fair. The theme was Summer Days and County Ways and the clicker counting attendance read 17,500 at the end of it. When you have a fair, and have money left over after paying the bills, its a good fair. Were satisfied, fair president Joye Wood said. She added that there were 956 exhibits, the most theyd ever had.

There was a wealth of things to do, see, eat and drink, and play on from Aug. 4-11. Fans were treated to animal, craft and food exhibits, music groups, carnival games, and beauty pageants. Both visitors and participants strolled around unhurriedly, willing to take the time to enjoy it all. When you look out and people have smiles on their faces and are doing a little jig here and there, you can see its a nice escape. Next year we plan on having more lighting and walking paths so people dont have to walk in the road, Joye said. The family-oriented fairs events

The music was so magnetic that families were moving to the beat while holding their infants and children, who were also feeling the music. One little girl, a lone man in the back and several ladies right down in front couldnt stop dancing. People normally do dance. We play a lot of nightclubs and always try to get people out on the dance floor, said Dave Crim, Cazhmieres manager and drummer. They played something for every age group. He mentioned that the beauty pageants Fairest of the Fair Queens court, composed of mostly young girls were extremely impressed, and kept saying Oh My God when they played a selection of popular songs-notably, Call Me, Maybe by Carly Rae Jepsen, and Lady GaGas Poker Face. Everybody was kind of holding their breath about the weather, but everyone was super, super nice, he concluded. The weather held up, but the spectacular heat lightning added a dramatic background to the show and all the band members looked like they were having a great time. Their tight sound kept up the pace with songs like Shes a Brick House, made famous by the Commodores. Singer and keyboardist and Front Royal native B.D. Unusual vacation destinations locals visit Deadwood

A town more wide open than Front Royal in its heyday - & who are those guys?
itors question, Carol said, We had already picked the Mt. Rushmore area before Deadwood (the graphic wild west TV series) came on. But I must say it brought more fun to the trip, trying to picture some of the facts that the program brought out.

Mt. Rushmore, pop history quiz left to right, they are Charlie and Carol Goddard relax on a Beware of Bears bench
By Malcolm Barr Sr. Warren County Report Some folks choose the oddest places to take a vacation. Like our neighbors, Carol and Charlie Goddard of Ashby Station Road in Rockland. They picked Deadwood, South Dakota. Deadwood! I exclaimed. When you get back, let me know what you found there and if you enjoyed it. This week, Carol stopped by and told me we had the best darned vacation we ever had which isnt saying a whole lot when you stop to think about it because Charlie usually prefers to stay close to home. Anyway, joined by Carols brother, Dale Williamson, off they flew to Rapid City, Iowa, rented a car and drove south to Deadwood where Wild Bill Hickock once ruled the roost and Calamity Jane is buried. This was a town wider open than Front Royal in its heyday (in the 1800s). In fact, according to Carol, theres slot machines and such in almost every public place (though with a population of about 1,000 there arent many public places) and the brothels disappeared less than 30 years ago. The Chamber of Commerce (or somebody) has gussied up the onehorse, one-street town a bit, and gun battles are a thing of the past. At this time of year, temperatures exceed the 100s in Deadwood and thereabouts but the a/c rental got them around comfortably, allowing Carol to experience one of the great sights of her life. We were driving around a long curve in the road when, right before us was Mt. Rushmore. My goodness, Id seen pictures of Rushmore but in reality it really is unbelievable, Carol said of the four U.S. presidents faces carved into solid rock (we know you can name them). On another road trip through the Badlands, the trio saw another carving in another mountain, an unfinished image of legendary American Indian Chief Crazy Horse, which was begun in 1948 but never finished despite efforts of the late sculptors daughter to complete the project decades later. For Carol and Dale, photographers both, the wildlife, including buffalo, prairie dogs, bears, elk, burros and deer, was a delight. A constant challenge was eating -theres a dearth of restaurants. Also, Carol advises its educational but not a place youd want kids tagging along (nothing much for them to do) but do take along your national parks passport that gets you on to Skyline Drive (or your Golden Age passport if youre old enough!). Since most of this part of our country is national park, the passports save money, even on this quite affordable vacation. It was a trip well never forget, concluded Carol Goddard, adding (sotto voce): At least it got Charlie outta town!). Responding to our managing ed-

Split council approves resolution on N-S connector road

Design, path and nature of Kendrick-Kerfoot connector still pending
and Vice-Mayor Shae Parker during council discussion. That central point is that what was being voted on was NOT approval of any design or even authorization that a temporary road be built, but simply approval of a resolution of support by council of the idea of a connector road eventually being built across the now federallycontrolled 467-acre environmental disaster site property. The mayor then cast the deciding vote against the original motion of Daryl Fund to send the resolution to the planning commission for consideration as part of its capital improvements review. Darr then joined Hrbek, Parker and Hollis Tharpe to block what that majority appeared to see as an essentially obstructionist maneuver to delay any movement forward

There is an existing 50-year-old, somewhat deteriorated semi-paved road on site along the approximate path of the proposed permanent or temporary northsouth Kendrick-Kerfoot connector road. You are looking north toward Kendrick Lane.
By Roger Bianchini Warren County Report After an extended debate for and against design parameters and the advisability of continuing to wait for full release of the Avtex property for development to move forward on a north-south connector road between Kendrick Lane and Kerfoot Avenue, Mayor Tim Darr found a decision of sorts awaiting his tiebreaking vote. The mayor began with a brief preface on his vote reiterating a pivotal point made by both Bret Hrbek

their breath. In fact, Hrbek noted during council discussion of the resolution that release of the property and construction of a north-south connector road in the area has been going on since both he and Parker were in high school. Virginia Attorney General Mary Sue Terry and the Virginia water Control Board shut the then Avtex-owned rayon and synthetic fibers manufacturing plant down for water emissions violations in 1989. Movement on a federally-overseen clean up and remediation of portions of the property began about two years later. During earlier discussion, Funk has stated the only reason he doesnt have a conflict of interest and can vote on the road is that it impacts many more people than he and other family members who live along Kerfoot Avenue. Funk has often reiterated concerns about safety, speed and volume of traffic in arguing against the temporary road project now before council. After appearing to support the road during earlier work session discussion, Tom Sayre said he agreed with Funk after visiting the area and viewing the existing path there. Citing his engineering background, former town public works director Tewalt reiterated his ongoing opposition to what he said would be a waste of money in building a temporary road where a permanent road would eventually go. He also said he thought the proposed path was not the right place for the road. However, Hrbek pointed out that what was being voted on did not approve any design path for the road. This is not giving any authority to spend any money. This is just a kinda, sorta we want the road. I dont see any map connected to this resolution, Hrbek said. Considering a north-south connector road is an EPA-mandated condition for development of the property, Hrbek asked why any councilman would want to hold up the release of any portion of the property by the EPA.

Bret Hrbek, left, attempts to explain to all it is a vote of support for the road and future commercial development on site, not road design. Gene Tewalt and Shae Parker listen.
toward the connector road. Parker then made a motion to approve the resolution. As a concession to Gene Tewalts objection to funding a temporary connector road, the vice mayor even deleted the staff-generated motions reference to a temporary connector road. Tewalt then joined Parker, Hrbek and Tharpe to create a 4- majority approving the resolution of support for the concept of a connector road that would tie northside neighborhoods to the countys soccerplex and skatepark recreational areas already built on released areas of the AvtexRoyal Phoenix property off Kerfoot Avenue on the towns southside. The resolution of support was recommended after Front Royal-Warren County Economic Development Authority Executive Director Jennifer McDonald recently told council such a resolution was needed for submission to the U.S. Environmental Protection Agency to gain early release of a portion of the property for development of the Kendrick-Kerfoot connector road. The situation is further complicated because the EPA will not approve construction of a permanent road on the property while Superfund remediation truck traffic is still entering and leaving the property. The EDA is hopeful that the EPA will accept a submitted report stating that the FMC-overseen remediation is essentially completed, other than tying up loose ends, and release the entire property by years end. However after years and many previous prospective release dates, no one is holding

We need this resolution all this is, is to get EPA to pursue release of this portion of the property. If we send this to the planning commission to start the process over it will be delayed another six to nine months. That will make it more difficult for the EDA to market the property and make it harder to get economic development there, Hrbek told his colleagues. Hrbek even got Town Attorney Doug Napier to explain that any final design or approval of the road would first go before the planning commission for a recommendation before council could vote on any final decisions. Hrbek also pointed out that as the towns elected body, council was responsible for decisions on policy, which he observed is what the resolution of support for a connector road is. So, youre saying we should send this resolution to an appointed body to tell us what we should do on a matter of policy? Hrbek asked incredulously. Just prior to the votes, Hrbek reiterated this point. If we go down the route Mr. Funk has proposed, were asking the planning commission if we should issue a resolution of support, not to even look at the road itself So were adding a whole other step to give to the planning commission a job that is not theirs Our job is to tell them what policy should be and their job is to see that it can actually work pragmatically in the real world. But some werent getting it. I have to disagree about a waste of time, Sayre began in prefacing his votes. At our last work session I was told two things, one, that the road would not dip down and it does dip down. And two, I was told by a different council member that there were squares, they didnt elaborate how big the squares were, but squares of how much our easement was, it would be very tight and we couldnt move around the road. Then when I went out I found out both those things I was told at the work session was wrong. I actually talked to Mr. Burke about that, and Id like to have at our work sessions if hes aware Im being given bad information, Id like for him to pipe up and correct it. So, I think this is proper to send it to the planning commission and see what they find out. In the end, it was only Sayre joining Funk in voting not to approve a Resolution of support for the Connector Road from Kendrick Lane to Kerfoot Avenue Responding to a question, Town Manager Steve Burke said after forwarding the approved resolution to the EDA for submission to the EPA, he would instruct the towns consultant to begin a road safety audit on the connector road. Parker pointed out that the previous council had authorized the setting aside of about $150,000 over two years for design and engineering work on the road, so the necessary funding is already in place. Development Postscript During earlier comments in the Public Presentations portion of the meeting, Linda Allen suggested the town and EDA move toward the type of light industrial uses allowed on the 160-acre business park portion of the property, rather than recruit another commercial shopping center developer that would create additional competition for downtown businesses already facing lost business to the northside 5 Corridor shopping centers on county land.

Town
And in a further related agenda item, council unanimously voted to reappoint Deborah Langfitt to the town planning commission for a four-year term.

State committee upholds county Republican officers

McHugh-led activists fail in bid to overturn Repici-led executive slate
ing, so was the only sitting officer not in dispute. Two votes were taken by the state central committee. The first was 38-3 not to direct Warren County Republicans to hold another mass meeting to elect officers. The second was 40-3 to accept the Repici-led slate as the county executive committee. The would-be county chairman left on the outside looking in by the votes, Mike McHugh said he would accept the decision, if not agree with it. Illustrating some humor, McHugh wrote supporters later in the day of the RPV vote, To borrow from Al Gore (re: 000 Florida recount Supreme Court decision), I vigorously oppose the decision but accept it. However on a less humorous note, McHugh added, By accept I do not mean legitimate. Until Republicans learn to stop acting like Democrats and thrashing the rule of law there can never be unity. Its just an example of raw power over principal. But they want to focus on getting Romney in. But for them to complain about Obama and turn around and do the same thing? McHugh told us in a phone conversation several days after the state committee result. McHugh visited the same theme in an e-mail he sent out the day after the RPV vote. It is beyond ludicrous to complain about Barack Obama trashing the Constitution without acknowledg-

Not seeing eye to eye - Mike McHugh, left, and Dominic Repici have divergent perspectives on process and results of McHughs challenge of Repicis election as county Republican chairman.
By Roger Bianchini Warren County Report As defacto Republican presidential nominee Mitt Romney was fending off questions about his financial and taxpaying past, while deciding to go about as far right politically and economically as his party could go in tabbing Wisconsin House Rep. Paul Ryan to be his running mate, Warren County Republicans were maneuvering for a final stand before the Republican Party of Virginia (RPV) on a dispute over the election of local officers. That decision, given on Aug. 4 in Richmond, was that the slate of officers elected at an April 1 committee meeting after a March Mass Meeting impasse was the rightfully seated Warren County Republican Executive Committee. That slate of Executive Committee Officers is Dom Repici, chairman; Steve Kurtz, vice chairman and Mary Kay Clark, secretary. Trish Anderson was reelected treasurer at the mass meet-

We won, he lost. We have the backing of the state committee and its important we get on with what we have to do, which is elect our candidates. WC Republican Committee Chairman Dom Repici on state votes on county officers
ing that George Bush did the same and that our own party continues to do the same, McHugh wrote supporters on Aug. 5. We asked McHugh how big a factor he believed the coming national convention and presidential race were in the votes to move past a county Republican officer dispute. I think thats some of it. I get it to hell with rules, its just power politics. Goodlatte got really involved. Hes scared to death of Warren County, McHugh said of the Republican 6th District incumbent U.S. House representative. McHugh campaigned hard for retired Pentagon officer and libertarian, small government candidate Karen Kwiatkowskis challenge of Goodlattes re-nomination as the Republican 6th District candidate to the U.S. House of Representatives. McHugh said that 6th District officials were instrumental in blocking the success of his appeal. He accused both Repici and 6th District Chair-

County politics
man Wendell Walker of lying before the state committee about the nature of the earlier 6th District Committee ruling on his initial appeal. That perception is based on the belief a vote on Repicis chairmanship was avoided by the sitting Warren County Republican Committee chairman recusing himself from voting as a 6th District Committee member, as would be his right as county chair. I hate to call any man a liar but [Repici] recused himself to avoid a vote on the issue [of his chairmanship], McHugh insists. Theres no question in anybodys mind he recused himself because he wanted to move past a vote on whether or not he was chairman. At the time of the 6th District Committee meeting, Repici told us he abstained simply to move the meeting forward after nearly two hours of debate over the Warren County officer situation. Why would he recuse himself to move things on? I dont know, I guess thats how he spins it in his mind,

County politics
McHugh said of that line of thought by the county chairman. Chairman comments I dont want to engage in the kinds of insults he does, Repici said of McHughs comments on about him and the decision. Its unfortunate, we have important things in front of us like getting candidates elected. Rather than breaking rules on his side, Repici questioned McHughs tactic of rewording his original appeal after it was rejected locally and by the 6th District Committee, then submitting directly to the state for a ruling. That is so far out of line and I think it confused everyone as to what they were voting on, Repici said of the Aug. 4 state hearing. And state Chairman Pat Mullin finally said, This has gone on long enough the whole issue of Warren County, I think is how he put it. As a result, Repici said, We won, he lost. We have the backing of the state committee and its important we get on with what we have to do, which is elect our candidates. Origin of dispute After returning to the county about a decade ago, McHugh served as the Warren County Republican Committee South River Magisterial District rep in 00, 004 and 006 and as committee vice chairman in 008. McHugh then refocused his guns rights and pro-life activism more at the state and national levels, as he had in the past, including a stretch in Vermont. Then McHugh assembled a more libertarian-leaning, largely younger coalition of Republicans that sought to nominate him as county chairman at the March 15 Republican Committee Mass Meeting. However, the selfdescribed coalition of constitutional conservatives, Ron Paul people and hard-core, pro-life Catholics failed due to then Committee Chairman Dave Hendersons rule that all officer nominations for the mass meeting would have to be pre-filed. Thwarted in nominating anyone on March 15, the McHugh-led group, holding an approximate 55-45 mass meeting voting majority, was reduced to blocking the election of the pre-filed slate, with the exception of the treasurer as cited above. On April 10, the splinter group of newly active Republicans re-adjourned the mass meeting and elected its own executive committee slate, McHugh chairman; Nick Bukowski, vice chairman; and Jon Fidero, secretary. Two days later at the monthly committee meeting, the Repici, Kurtz and Clark slate was elected by a mainstream committee majority eligible to vote as standing committee members. McHugh then began his challenges, stating that officers could only be elected at a mass meeting and challenging Hendersons pre-filed nominee rule as against state Republican bylaws. McHugh told us he was seeking the Warren County Republican executive committee chairmanship because of the influence a committee chair has in setting rules, agendas and the general direction of the committee. As the controversy erupted, some

old guard county Republicans said they believed the McHugh-led move on the executive committee was motivated by more than concern about local or 6th District issues; that it could have been part of a national effort to pack state and eventually national convention delegations with Ron Paul supporters. They can think that if they want. It doesnt hurt me if they think I have that kind of pull, McHugh told us when we first asked him about that perception of his motivations.

So many classics: Jack Evans 2012 Classic Car Show

First place winner Burle Tangen presents his award for his 1935 sedan and behind him is the car itself.
By Carol Ballard Warren County Report If cars could talk, the ones at Jack Evans Chevrolet annual Classic Car Show held on Saturday could, with a few gaps, tell the entire 0th Century American story. August 4 was another hot day in Front Royal, but it didnt prevent classic car owners from converg-

ing on the lot at 15 S. Royal Ave to give the admiring public another chance to enjoy antique vehicles like the 1906 Wayne -whose body is made from Tulip Poplar wood-and others constructed out of heavy steel frames with sleek lines that were built to last. Some of them were driven across battlefields, and after the wars, many were used to carry on the business of peacetime life. They carried families down country lanes for picnics, parents to work, and couples on dates. Others come from a time when a persons arm was the only turn signal, seat belts and air bags werent

mandatory, rides were smooth and most cars driven in the USA were made here at home. And the price of gas wasnt nearly the issue it is now. John Evans IV, owner of the dealership and the force behind the annual show, showed off a more recent model. The brand new 013 eco-friendly Jalapeno green Chevy Spark 5-door hatchback gets 5-38 mpg. Who knows, maybe in 100 years, it will also be a restored classic and be on display? This should appeal to the younger people, he said. Along with the more recognizable restored Chevys, Fords, and Dodges was the 1906 Wayne, owned by Jeffrey H. Brown of Front Royal. He said his father found it when he (Jeffrey) was 1

The heat didnt deter enthusiastic car fans from walking around, loving the cars, eating hot dogs, having fun with friends and family, and listening to the upbeat and sometimes nostalgic music of the local band Eye Soar that matched the older-days feeling of the event. EBS Child Development Center celebrates Dr. Shermans birthday

Children, staff and church members gathered to sing happy birthday to Dr. Sherman on August 10, 01, what would have been her 113th birthday. The Elizabeth B Sherman Child Development Center, a Mission of the Front Royal United Methodist Church sponsored the Valley Health Coach mobile unit on August 10th from 11 a.m.-3 p.m. Free screenings for cholesterol and diabetes were conducted in the church parking lot at 1 West Main Street. It was a fitting way to honor the birthday of beloved FRUMC church member, Elizabeth B. Sherman, who left a legacy to the community. Dr. Sherman herself participated in mobile health units in the 1930s. Children, staff and church members gathered to sing happy birthday to Dr. Sherman and celebrated with cake afterwards. The EBS Child Development Center has openings for full (6 a.m.-6 p.m.) and part time (varied hours) fall preschool. The program offerings are very flexible to answer the many needs of parents including Morning Preschool, Full Time Preschool, and Flexible Preschool for those who only need a few days a week. Please call 540-6-503 for information. Background Elizabeth B. Sherman was born in Luray on August 10, 1899. Dr. Sherman graduated from Randolph Macon Womens college in 190 with Phi Beta Kappa honors. She worked two years as a teacher before her dreams of medical school became a reality. Because UVA would not accept women in med school, she went to University of Maryland and graduated in 196 at the top of her class, receiving the Gold Medal of Excellence. All the men at her graduation stood as she received her diploma. After practicing in Baltimore, she got her license to practice in VA and returned to Front Royal in her early 30s. In order to pay her rent and keep business going, Dr. Sherman would work for the public health mobile unit traveling throughout rural Maryland. Her last office location was at the corner of 4th and Virginia, which is still standing today. She retired from obstetrics after delivering 00 babies. She formally retired from medical practice in 1990 at 91 years old. Buried at Prospect Hill, she died in 1997 and has been honored in many ways since. Warren Memorial Hospitals Womens Care Center is named after her as well as our Child Development Center. Also, Dr. Patterson honored her by naming his medical building after her on 10th Street. Dear Stewart, I see so many Bradford Pear trees split in the middle. Should I still plant this tree? Dear Tree Lover, A Tree Lover

blowing inside shop doors like snow. As for the split in the middle? Well, thats an open invitation for disaster! It leaves the tree even more vulnerable to weather, winds, disease, and insects than it already is. Note: Only feed your ornamental pear in the fall. Be careful as excess nitrogen from fertilizer increases vulnerability to leaf disease problems. Theres no need to fertilize them after they reach five or six years old, if theyve been properly mulched from the beginning. Prune dead wood and broken branches in late winter, before the flower buds swell. The pros for buying a Bradford Pear: Lovely white blossoms; dense branching; long green leaves that turn a lovely wine color in the Fall; doesnt need regular pruning; tolerates urban stresses; likes full sun with slightly acidic soil; and has little difficulty with clay soil. The drawbacks: Growth much larger than expected; susceptibility to a splitting of their wood, especially in harsh weather; vulnerability to Aphids, Spider Mites, the Gypsy Moth and Fire Blight (a bacterial disease where new shoots suddenly wilt in late Spring, turn black or brown, and die). Always make sure the trees you purchase have a single leader (main trunk), have a good shape with no flat sides, have no dead or broken branches, and if container grown, does not have circling roots. Plant it in a space large enough so its roots wont tear up your sidewalk and branches wont fall on your house, car, or kids! Come visit me at the Arboretum, across from the flea market. Bring the kids! Ill sit up on my hind legs, twitch my tail, or run around in circles just to make yall smile. Just dont chase me, or Ill run up a tree and hide.

To answer your question in one word: No! The Bradford Pear tree (Pyrus calleryana), a cultivar of the Callery Pear, is a very pretty tree. Originally touted as elegant, sturdy, and low-growing, it turned out neither so sturdy or low growing. If youve ever been on Main Street in the spring, youve seen the beautiful white blooms of the Bradford Pears. But, they kept growing and growing and growing and as they grew, roots tore up sidewalks, branches struck cars, trucks and passers-by, and blossoms fell by the thousands (!!!)

The Front Royal/Warren County Tree Steward program began in 1997 with volunteers dedicated to improving the health of trees by providing educational programs, tree planting and care demonstrations, and tree maintenance throughout the community. The group now consists of over 30 active members with several interns working toward becoming certified tree stewards from our annual All About Trees Class. Each month Stewart will answer a question from our readers. Please forward it to Stewart in care of frwctreestewards@comcast.net and we may publish it in a future issue.
