Representatives of EVANS & BRYANT PLC, Assigns of VIRGINIA HOUSING DEVELOPMENT AUTHORITY, presented to me, on the 19TH day of April, 2012 A.D., a Claim alleging a debt that I owe, bearing fraudulent Account Number that I have no knowledge or Record of. However, when 'Requested to answer Discovery concerning the same, Representatives of VIRGINIA HOUSING DEVELOPMENT AUTHORITY and / or its Assigns failed to deliver and have consequently Defaulted on the Request. Default Notice, dated the 24th Day of April, 2011 A.D. [EXHIBIT 'B'] was sent to VIRGINIA HOUSING DEVELOPMENT AUTHORITY and its Assign, EVANS & BRYANT, which the United States Postmaster's Records show was received by a Representative of VIRGINIA HOUSING DEVELOPMENT AUTHORITY on the 26th Day of April , 2012 A.D. On the 14th Day of December, 2011 A.D., I was presented with a similar Claim bearing similar fraudulent Account Number inserted on the Claim, alleging a debt I owe, from Representatives of Virginia Housing Development Authority. I again, 'Requested' Discovery which they deliberately failed to answer and to which they are in Default. The fact that these Affidavits were not rebutted and Discovery was not answered has already put VIRGINIA HOUSING DEVELOPMENT AUTHORITY and LAW OFFICES OF EVANS & BRYANT in 'Default'. Representatives of EVANS & BRYANT, PLC Assigns of VIRGINIA HOUSING DEVELOPMENT AUTHORITY AND TONYA D WIHEROW, with 'unclean hands' and disingenuous intent, have misused the Court by filing fraudulent documents in the Courts to move within a Jurisdiction that is clearly 'Colored' and 'Corrupt'. 'Robo-signed' documents, in the form of a Summons, were presented to me from the Courts on the 26th Day of June, 2012 A.D. stipulating a Complaint filed by Tonya D Witherow D/B/A TONYA D WITHEROW on behalf of In order to lawfully move the Court to make Rationale in the Argument / Controversy in which they were corresponding with me, there has to be 'Proof' of Evidence' that an alleged Debt exists, i.e. the Evidence of Contract, which was Requested of and Demanded of Representatives of VIRGINIA HOUSING DEVELOPMENT AUTHORITY and its Assigns which was never produced. Representative of VIRGINIA HOUSING DEVELOPMENT AUTHORITY, Sandra Garrett, admitted, in writing on two (2) occasions (correspondences dated April 24th, 2012 and May 23rd, 2011) that they have no Record of a Contract. Representatives of VIRGINIA HOUSING DEVELOPMENT AUTHORITY and its Assigns failed to enter the alleged Contract into Evidence. VIRGINIA HOUSING DEVELOPMENT AUTHORITY and its Assigns failure to produce the Contract and Discovery demanded by me, places the burden on the Court, Officers, Judge (Neutral Arbitrator), Prosecutor, etc. to answer the following: What Instruments were produced to move this Court to summons me in any form, shape or manner when those same Instruments are exactly the same Instruments that I requested in Discovery and the same is required by Law as Evidence for Representatives of VIRGINIA HOUSING DEVELOPMENT AUTHORITY and / or its Assigns to move the Court? If otherwise is the case, then someone, in the process of moving this case to action, has unlawfully rubber - stamped an 'Execution' to move this case forward without 'Proof' and Examination of the Evidence. Such an act would constitute Fraud, Racketeering and the 'Misuse of the Courts'. Affidavit of Fact - Writ in the Nature of Response and Demand [EXHIBIT 'CR - 1 BLB'], dated the 26th Day of June, 2012 A.D., was sent to the Clerk of the Court, Special Civil Part, Civil Division: Richmond City which included a Request for Discovery, in particular, Proof of Jurisdiction of the Courts. The United States Postmaster's Record shows that the said Affidavit, Response /Rebuttal to the fore-mentioned 'Summons', was received and signed for by a Representative or Personnel in the Agency of the SUPERIOR COURT OF VIGINIA,

SPECIAL CIVIL PART, CIVIL DIVISION: CITY OF RICMOND on the 27th Day of June, 2012 A.D. Representatives / Officers of the Courts have also failed to answer Discovery and therefore, are in Default. A Default Notice [EXHIBIT 'CR-ND1-AE'], dated the 1st Day of May, 2012 A.D. was received and signed for by a Representative or Personnel of the Court on the 7th Day of May, 2012 A.D., as per the United States Postmaster's Record. Affidavit [EXHIBIT PCC-1-JA] in the form of a Criminal Complaint against Representatives of EVANS & BRYANT, PLC dated the 27h Day of June, 2012 A.D., was also filed with the Federal Bureau of Investigation, Vrgnia Division, regarding the apparent Fraud, Colored Operation and Collusion that was taking place between Officers representing the SUPERIOR COURT OF VIRGINIA, SPECIAL CIVIL PART, CIVIL DIVISION: CITY OF RICHMOND and Representatives / Beneficiaries / Profiteers of EVANS & BRYANT PLC. Administrator / Deputy Clerk acting as and Magistrate Dawne Pridemore, appears to be acting in collusion with Representatives / Beneficiaries / Profiteers of EVANS & BRYANT, PLC has literally and fraudulently rubber stamped a 'Judgment By Default' without being presented with Evidence of a Contract, etc., thus refusing to honor 'Due Process', a violation of my Constitutional Rights. Also, the 'Robo-signed' Judgment by Default by Administrator / Deputy Dawne Pridemore, is fraudulently marked 'judgment ordered', which is a misrepresentation of the fact, since the Claim was rebutted. Neither the Courts nor the Claimants have answered Discovery, in violation of Federal Law; yet they are holding me in 'Default' when they are the ones in Default, which appears to be collusion between the fore mentioned Parties and a clear indication of their fraudulent Colored Operations. Representatives of VIRGINIA HOUSING DEVELOPMENT AUTHORITY, its Assigns and the Administrators, Officers, etc. of the SUPERIOR COURT OF VIRGINIA, SPECIAL CIVIL DIVISION: CITY OF RICHMOND have not answered Discovery and have not proven Jurisdiction; yet they are proceeding and harassing me. This is a clear case of an Administrative Court exercising Administrative Office to get a Judicial outcome. The process is not Judicial but they are trying to show that it is; it holds no legitimate office. The ruling to move this case forward and make Rationale has undermined 'Due Process' which is a violation of my Constitution and Treaty Secured Rights. The 5th Amendment requires that all persons within the United States must be given Due Process of the law and equal protection of the law. Due process of law implies the right of the person affected thereby to be present before the tribunal which pronounces judgment upon the question of life, liberty, or property, in its most comprehensive sense; to be heard, by testimony or otherwise, and to have the right of controverting, by proof, every material fact which bears on the question of right in the matter involved. "A judgment is void if the court acted in a manner inconsistent with due process. A void judgment is a nullity and may be vacated at any time." 261 Kan. at 862. Also, City Of Richmond Special Civil Court, its Administrative Officers, etc. are sending to me correspondences as if Jurisdiction exists, with Decisions and Claims being made in an 'Incompetent Jurisdiction', since Jurisdiction has not yet been established. All orders or judgments issued by a judge in a court of limited jurisdiction must contain the findings of the court showing that the court has subject-matter jurisdiction, not allegations that the court has jurisdiction. In re Jennings, 68 Ill.2d 125, 368 N.E.2d 864 (1977) ("in a special statutory proceeding an order must contain the jurisdictional findings prescribed by statute.")

Lack of Federal Jurisdiction can not be waived or overcome by agreement of parties. Griffin v. Matthews, 310 F supra 341, 342 (1969): Want of Jurisdiction may not be cured by consent of parties. Industrial Addition Association v. C.I.R., 323 US 310, 313. The Supreme Court rules, in its continuance, concerning people in Government, etc. and people operating in different Municipalities, etc., where issues before the Courts and issues causing injury to people, must be in a Court of Competent Jurisdiction. It appears that all Parties involved are in want of Jurisdiction. Court must prove on the record, all jurisdiction facts related to the jurisdiction asserted. Lantana v. Hopper, 102 F. 2d 188; Chicago v. New York, 37 F. Supp. 150. Once jurisdiction is challenged, the court cannot proceed when it clearly appears that the court lacks jurisdiction, the court has no authority to reach merits, but rather should dismiss the action. Melo v. U.S. 505 F 2d 1026. Due to their 'Dirty' dealings and 'Colored' operation, I am therefore making a Formal Request for an immediate Investigation into these matters of 'Harassment', 'Misuse of the Courts', Corruption, Color of Law, Colored Operations and Fraud by Representatives of SUPERIOR COURT OF VIRGINA, RICHMOND CITY, SPECIAL CIVIL PART, CIVIL DIVISION, Representatives of VIRGNIA HOUSING DEVELOPMENT AUTHORITY and its Assigns, Law Firm styled as EVANS & BRYANT, PLC and for their unlawful practices to go on Record. Enclosed are copies of relevant correspondences between Representatives of EVANS & BRYANT PLC and its Assigns, Officers of the SUPERIOR COURT OF VIRGINIA, CITY OF RICHMOND: CIVIL DIVISION, Representatives of EVANS & BRYANT, PLC an Assign of VIRGINIA HOUSING DEVELOPMENT AUTHORITY and me, regarding the captioned subject matter. Other documents germane to issues of my Complaint can be forwarded to you upon request.
