GAUTENG INTEGRATED WASTE MANAGEMENT PLANS REGULATIONS

The Member of the Executive Council responsible for agriculture, conservation and environment has, in terms of section 70(1) read with section 69(1)(dd) of the National Environmental Management: Waste Act, 200x (Act No. xxx of 200x), made the Regulations as set out in the Schedule.

SCHEDULE
CHAPTER 1 INTERPRETATION AND PURPOSE OF THESE REGULATIONS 1. (1) Interpretation In these Regulations any word or expression to which a meaning has been assigned in the Act has that meaning, and unless the context requires otherwise annual waste management performance reports means the annual performance reports drafted in accordance with chapter 4 of these Regulations; category , in relation to municipalities, means a category A, B or C municipality envisaged in section 155(1) of the Constitution, and as further defined in the Municipal Structures Act; Constitution means the Constitution of the Republic of South Africa, 1996; district municipality means a municipality that has municipal executive and legislative authority in an area that includes more than one municipality, and which is described in section 155(1)(c) of the Constitution as a category C municipality; guidelines means any national and provincial guidelines or policies issued in terms of the Act, but includes the Gauteng Provincial Government Agriculture, Conservation, Environment and Land Affairs Guidelines for the Development of Integrated Waste Management Plans for Local Government of April 2004 and the Gauteng Department of Agriculture, Conservation and Environment Gauteng Provincial Integrated Waste Management Policy of September 2006, until such time as these guidelines or policies are replaced by subsequent guidelines or policies;

local municipality means a municipality that shares municipal executive and legislative authority in its area with a district municipality within whose area it falls, and which is described in section 155(1) of the Constitution as a category B municipality; metropolitan municipality means a municipality that has exclusive executive and legislative authority in its area, and which is described in section 155(1) of the Constitution as a category A municipality; MEC means the Member of the Executive Council responsible for agriculture, conservation and environment; municipal council means a municipal council referred to in section 157(1) of the Constitution; Municipal Structures Act means the Local Government Municipal Structures Act, 1998 (Act No. 117 of 1998); Municipal Systems Act means the Local Government Municipal Systems Act, 2000 (Act No. 32 of 2000); National Environmental Management Act means the National

Environmental Management Act, 1998 (Act No. 107 of 1998); plan means the integrated waste management plan drafted in

accordance with chapters 2 and 3 of these regulations; the Act means the National Environmental Management: Waste Act, 200x (Act No. XX of 200X); the provincial department means the Gauteng Department of Agriculture, Conservation and Environment. (2) These Regulations must, unless a contrary interpretation is clear from the words and context, be interpreted to be consistent with published guidelines. (3) Nothing in these Regulations must be read in any way to detract from the provisions of the Act and the Municipal Systems Act on the contents of and procedures for the submission and approval of integrated waste management plans and integrated development plans.

When a period of days must in terms of these Regulations be reckoned from or after a particular day, that period must be reckoned as from the start of the day following that particular day to the end of the last day of the period, but if the last day of the period falls on a Saturday, Sunday or public holiday, that period must be extended to the end of the next day which is not a Saturday, Sunday or public holiday.

Purpose of these Regulations The purpose of these Regulations is to regulate the preparation, contents and submission of municipal integrated waste management plans to the MEC, in a manner which is consistent and which supports and enhances the provisions in the Act.

CHAPTER 2 SUBMISSION OF INTEGRATED WASTE MANAGEMENT PLANS 3. (1) Submission of plans by municipalities Each municipality must submit an integrated waste management plan in the prescribed manner as set out in Chapter 3 below, to the MEC 90 days prior to the date prescribed for the submission of its integrated development plans to the Member of the Executive Council for local government in terms of the Municipal Systems Act. (2) If a municipality is unable to comply with the timeframes as set out in Regulation 3(1) for the submission of its plan to the MEC, it must prepare and submit a situational report to the MEC not less than 90 days before the date stipulated for submission of its plan, containing the following information: (a) (b) (c) the reasons why it cannot comply with the timeframes; steps taken to remedy the situation; and assistance required to remedy the situation.

Submission of inputs by local municipalities to district municipalities Local municipalities must submit their plans to the relevant district municipalities at least 30 days prior to the date on which municipalities must submit their plans to the MEC as prescribed by Regulation 3(1).

CHAPTER 3 CONTENTS OF INTEGRATED WASTE MANAGEMENT PLANS 5. (1) Contents of plans to be submitted by municipalities An integrated waste management plan must, as a minimum (a) contain a situational analysis that includes (i) a description of the population and development profiles of the area to which the plan relates; (ii) an assessment of the quantities and types of waste that are generated in the area; (iii) a description of the services that are provided, or that are available, for the collection, minimisation, re-use, recycling and recovery, treatment and disposal of waste; and (iv) the number of persons in the area who are not receiving waste collection services; (b) within the domain of the municipality, set out how the municipality intends (i) to give effect, in respect of waste management, to Chapter 3 of the National Environmental Management Act; (ii) (iii) to give effect to the objects of the Act; to identify and address the negative impacts of poor waste management practices on health and the environment; (iv) to provide for the implementation of waste minimisation, re-use, recycling and recovery initiatives; (v) to address the delivery of waste management services to residential premises; and 4

to give effect to best environmental practice in respect of waste management;

set out the priorities and objectives of the municipality in respect of waste management; set out the approach of the municipality to the planning of any new facilities for the disposal and decommissioning of existing waste disposal facilities;

(e) (f)

indicate the financial resources that are required to give effect to the plan; and describe how the municipality intends to give effect to its integrated waste management plan

in the format and containing the information as is set out in Annexure A of these Regulations. . CHAPTER 4 REPORTING AND REVIEW OF INTEGRATED WASTE MANAGEMENT PLANS 6. Reporting on implementation of integrated waste management plans and reports (1) Municipalities must prepare and submit annual waste management performance reports on the implementation of their plans to the MEC for approval. (2) Annual waste management performance reports must contain information on the implementation of the integrated waste management plan, including information on (a) (b) (c) (d) (e) (f) (g) (h) the extent to which the plan has been implemented during the period; the waste management initiatives that have been undertaken during the reporting period; the delivery of waste management services and measures taken to secure the efficient delivery of waste management services; the level of compliance with the plan and any applicable waste management standards; the measures taken to secure compliance with waste management standards; the waste management monitoring activities; the actual budget expended on implementing the plan; and the measures that have been taken to make any necessary amendments to the plan. 5

The annual waste management performance report must be submitted to the MEC at the same time that the annual performance report must be submitted in terms of section 46 of the Municipal Systems Act.

performance reports on the implementation of their plans as contemplated in subregulation (1) above to the relevant district municipalities at least 30 days prior to the time specified for municipalities to submit their annual waste management performance reports, as is contemplated in subregulation (3)above.

7.

Review of integrated waste management plans and reports Municipalities must revise their plans in accordance with the provisions of subregulation (2) below, and must submit the revised plans to the MEC every 4 years as from the date specified for the submission of the first plan referred to in Regulation 3, irrespective of whether the plan was submitted on the due date or not.

Revised plans must incorporate updated information on the situational analysis, goals, priorities, objectives, approach, required financial resources and methods to give effect to the plans, as is set out in Chapter 3. CHAPTER 5 GENERAL

8.

Short title and commencement These Regulations shall be called the Gauteng Integrated Waste

Management Plans Regulations, 2008, and shall come into effect on a date to be determined by the MEC in the Provincial Gazette.
