Speaking to Boston's 96.9 FM radio program (http://www.newstalk969.com) "Jim and Margery" on Monday, Democratic Senate challenger Elizabeth Warren admitted that she is not licensed to practice law in Massachusetts.
According to reports from listeners, she claimed that she does not maintain a law practice. She also "said that she gave up her New Jersey license because she could not keep up with the Continuing Education requirements," according to one listener who commented on Breitbart's Monday story, "Does Elizabeth Warren Have a Law License Problem?" (http://www.breitbart.com/Big-Government/2012/09/24/Does-Elizabeth-WarrenHave-a-Law-License-Problem). Ms. Warren's statement comes as a surprise to the many clients she's provided legal services to over the past decade, including the law firm of Simpson, Thacher, and Bartlett, which listed her as "of counsel" in the 2009 brief they submitted to the United States Supreme Court on behalf of their client, Travelers Insurance.

First: Even if Elizabeth Warren was legal to do what she did: The hypocrisy of a liberal Democrat representing Travelers Insurance Co. and getting dismissed cases by injured asbestos workers (most of which were undoubtably union members) is astounding. If Scott Brown did anything similar, the press would destroy him. Second: It is not at all clear she was an active member of the New Jersey or Texas bars (the only bar associations she was ever a member of) when she raked in $200,000 on part time insurance defense work. If that is true, she may be in for some serious trouble. Does she fall under the "law clerk" exception? I don't know ANY states that allow it. However, I read today that she may be protected by some 6 year statute of limitations in Massachusetts, so if she hasn't actually represented a client in Massachusetts during the last six years, she gets off scott free.

As Obama would say ummmm......ummmmm...I digress, the phrase "of Counsel" connotes an independent contractor arrangement between a law firm and an attorney that is not employed by the law firm. The purpose of the relationship is to provide firm clients with access to attorneys in areas the firm does not practice in while affording the of counsel attorney access to firm clientele. Usually both parties endup earning money where they would have not otherwise.
