Heymann Files Ethics Complaint, Initiates Legal Action Against Fischer


DUVAL COUNTY SCHOOL BOARD CANDIDATE CALLS ON OPPONENT TO REFUTE AND DISAVOW FALSE, ILLEGAL POLITICAL COMMITTEE CAMPAIGN ACTIVITIES
JACKSONVILLE, FLA. Duval County School Board candidate Jon Heymann today filed formal complaints with the Florida Division of Elections and the Florida Commission on Ethics against a Lutz, Florida group connected with opponent Jason Fischer. Heymann also called on Fischer to disavow the false charges made in recent voter mailings by the electioneering communications organization Florida Federation for Children. Jason Fischer is knowingly accepting campaign support from a heavily-funded out-of-town political group that is blatantly lying to voters in order to attack my integrity and further its own political motives, Heymann said. If Jason Fischer is a man of honor he should publicly disassociate himself with this irresponsible group and refute the libelous information they are circulating about me. A mailer sent by Florida Federation for Children this week, with a headline Conflict of Interest falsely asserts that the Commission on Ethics said Heymanns position as CEO for the nonprofit organization Communities In Schools of Jacksonville will put him in violation with state laws if elected. The mailer cited as a source an opinion from the Florida Commission on Ethics clearly stating the exact opposite. Heymann requested the Ethics Commission opinion before entering the race last spring. The March 2, 2012 letter to Heymann from Wayne Rubinas, assistant general counsel with the Florida Commission on Ethics, concluded that no conflict of interest would be created if Heymann were elected. In sum, subject to the foregoing specificity and requirements, it appears that a prohibited conflict of interest under Sections 112.313(3) or 112.313(7), Florida Statutes, will not be created were you to become a School Board member, Rubinas wrote. There can be no doubt that Jason Fischer knows the lies being spread by this shadowy out-of-town political committee are intentionally false and misleading, Heymann said. I will not sit idly by while he and his cronies steal this important election through deceit and illegal campaign tactics. Florida Federation for Children is an electioneering communications organization heavily funded by the American Federation for Children, a national political committee leading the fight to expand taxpayer-funded voucher programs in public schools.
