You are required to take the following action(s):

The parties shall select a neutral and file a "Proof of ADR" form on or by the 210

day of the fling of this
action. If the parties have not selected a neutal within 210 days, the Clerk of Court shall then appoint a
primary and secondary mediator from the current roster on a rotating basis fom among those mediators
ageeing to accept cases in the count in which the action has been fled.
2. The initial ADR conference must be held within 300 days afer the filing of the action.
3.
Pre-suit medical malpractice mediations required by S.C. Code 15-79-125 shall be held not later than 120
days afer all defendants are served with the "Notice of Intent to File Suit" or as the court directs. (Medical
malpractice mediation is mandatory statewide.)
4. Cases are exempt fom ADR only upon the following grounds:
a. Special proceeding, or actions seeking extraordinary relief such as mandamus, habeas corpus, or
prohibition;
b. Requests for temporary relief;
c. Appeals
d. Post Conviction relief matters;
e. Contempt of Court proceedings;
Forfeiture proceedings brought by govermental entities;
g. Mortgage foreclosures; and
h. Cases that have been previously subjected to an ADR conference, unless otherwise required by
Rule 3 or by statute.
5. In cases not subject to ADR, the Chief Judge for Administative Purposes, upon the motion of the court or
of any part, may order a case to mediation.
b. Motion of a part to be exempt from payment of neutral fees due to indigency should be filed with the
Court within ten (10) days afer the ADR conference has been concluded.

Pursuant to Rules 64 and 65, SCRCP, Plaintiff respectflly moves for an 0X]0rl0 order
that all votes cast in the November 6, 2012 general election for State House District 75 (HD-75)
be seized fom the Defendants and deposited into the safe-keeping of the State Law Enforcement
Division (SLED) until such time that a fll hearing on this matter can be held and provisions can
be made under the supervision of this Court for an independent, manual recount of all ballots
cast. Plaintif also seeks an emergency hearing on this matter. This drastic remedy is sought as a
result of the lawless manner in which the Defendants have conducted the general election ad the
counting of ballots. This Court's intervention is necessary to prevent the irreparable injury of the
loss or miscounting of votes believed to be determinative of the outcome in HD-75.
PARTIES
I. Plaintiff South Carolina Democratic Party (SCDP) is a political party capable of
nominating candidates to appear on the general election ballot, including candidates for
the State House of Representatives, HD-75.
2. Plaintiff Amanda Alpert Loveday is the Executive Director of the SCDP.
3.
Defendant Richland County Election Commission (RCEC) is an agency of the County of
Richland charged by law with conducting local, state and national elections in Richland
County.
4. Defendant Lillian McBride is the Executive Director of the RCEC. She is sued in her
ofcial capacity.
5.
Defendant M. Elizabeth Crum is the Chair of the RCEC. She is sued in her official
capacity.
FACTS
6. On November 6, 2012, RCEC conducted the 2012 general election.
7. One of ofices voters voted to fill in this election was HD-75. Two candidates were on
the ballot competing for HD-75: Democrat Joe McCulloch and Republican Kirkman
Finlay.
Even though provisional and failsafe ballots are yet to be counted in this race, this
Petition asks this Court to intervene immediately to protect the integrity of this election
because it is clear based on the initial rets that this race will be very close and has
already been impacted by numerous irregularities that threaten to undermine the
legitimacy of the election.
8. The 2012 general election in Richland County was marred by irregularities stemming
fom the illegal conduct of the Defendants.
9. Richland County voters waited as long as fve or six hours to exercise their fndamental
right to vote.

These long lines were attributed to an inadequate number of voting machines and a large
number of voting machines that became inoperable while voting was occurring.

South Carolina law requires the use of one voting machine per 250 registered voters. S.C.
Code Ann. 7-13-680.
12.
The RCEC failed to provide the statutorily required number of voting machines, failed to
provide additional necessary machines, and failed to make timely repairs of numerous
inoperable machines.
13.
As a result of the RCEC's illegal conduct in failing to provide voters with adequate
voting equipment, poIling locations around the county remained open late into the night
with voters casting ballots as late as 10:00 p.m.
14. Once poIling locations were closed, the RCEC failed to properly "close out" voting
machines. This procedure transfers data fom the voting machines used by voters to a
cartridge that combines all the votes cast in that poIling location. This cartridge is then
used to create a printout of the results in that poIling location.
15. Prior to transporting the cartages to the RCEC headquarters, poll managers are required
to print the results for their poIling location and post it on the door of the poIling location.
16. Once the "close out" procedure is complete, the cartages and one Qf the voting machines
fom each precinct is transported to the RCEC headquarters at 2020 Hampton Street,
Columbia, South Carolina where the RCEC totals the votes cast in all precincts.
17. Many precincts failed to properly "close out" their vote totals and post them.
18. Some precincts were unable to complete this procedure because the voting machines lost
power afer their batteries died.
19. Other precincts failed to complete this procedure as a result of human error.

This required the RCEC to retrieve machines fom the polling locations around the
county and tansport them to the headquarters for "repair," recharging, or merely to
conduct the procedure.
21. This corective action was not completed on Election Day, November 6, 2012.
22.
No final results were released for Rchland County elections on Election Day or early the
next moring on November 7. RCEC released preliminary numbers for fewer than 25
percent of the County's 124 precincts that night or early the next morng.
23. Richland County is believed to be the only county that failed to release results on
Election Day or early the next morng.
24. On November 7, 2012, at 8:00 a.m., RCEC staf reted to headquarters to resume
retrieving and counting votes cast.
25. Despite repeated assurances by the Defendants that this process would be completed
"soon," it dragged on throughout the entire day. Plaintif and other observers received
chaging explanations throughout the day as to the reason for the delay.
26. The RCEC leaed for the first time on November 7, that they needed to retrieve
necessary election machinery abandoned at the polling locations in order to "close out"
and tally vote totals.
27. Additionally, the RCEC solicited the assistance of a technician from the company that
maes the voting machines to repair and retrieve votes fom machines that were
inoperable by the RCEC staf.
28. Information in four precincts in HD-75 remained unavailable for most of the day with
various explanations being ofered as to why vote totals fom these machines were

unavailable. These precincts were: North Forest Acres, Pennington, Ward 25, and
Woodlands precincts.
29.
Vote totals for Pennington and Ward 25 were provided to Plaintif and other election
observers at 12:24 p.m. Vote totals for Woodlands were provided at approximately 3:30
p.m. and vote totals for North Forest Acres were provided at approximately 4:15 p.m.
30.
Based on these preliminary totals, Democrat Joe McCulloch led his opponent,
Republican Kirkman Finlay by 38 votes.
31.
At this time, some but not all of the absentee ballots had been reported as reflected in a
12:24 sU ary provided to Plaintif and other election observers (Exhibit A).
32. Typically there are three types of "absentee" ballots.
33. In-person absentee are cast on voting machines at the RCEC headquarters prior to
Election Day. These votes are cast on voting machines no diferently than in a polling
location.
34. Mail-in absentees are sent to voters via U.S. Mail and retured the same. These ballots
are marked on a paper Scantron sheet and scanned by a reader that totals them.
35. Finally, Uniformed Overseas Citizen Absentee Voting Act (UOCAVA) ballots, are
ballots that are sent to militay and civilians overseas. These ballots can be transmitted
via mail, email, or fax and reted via the sae.
36. UOCA V A ballots that are not reted in a machine-readable format were transmitted by
hand onto a new machine-readable ballot by a variety of unknown individuals.
37. The 12:24 sU ary produced by the RCEC reported four categories of absentee votes
but only reflected totals in three of those categories. "Absentee 3" reported that
McCulloch led Finlay, 201 votes to 145, respectively.

38. Defendants told observers that Absentee 3 was a "combination" of these absentee voting
types.
39.
At 6:20 p.m., the RCEC provided a fnal summary that updated vote totals for Absentee
1, 2& 3.
40.
In Absentee 3, Finlay added 267 votes to his prior total for a total of 412 votes. (Exhibit
B)
41. McCulloch did not add a single vote in categor Absentee 3.
42. As of the RCEC's 6:20 p.m. summary, Finlay now leads McCulloch by 265 votes with
6771 to 6506.
43. When confonted with the fact that Absentee 3 added 267 a deteninative margin - to
Finlay's total without adding a single vote for McCulloch, Defendants had no explanation
for how this was possible.
44. Sigificantly, even though Defendants had paper and UOCA V A absentee ballots in their
possession before any other ballots these were the last ballots to be counted and also
provided Finlay with a lead by a detenninative margin.
45. Not one of South Carolina's other 45 counties experienced the widespread failures
sufered by Richland County voters.
46. The grossly incompetent manner in which the RCEC conducted the 2012 general election
has been widely reported by the South Caolina press cors and is not reasonably in
dispute. See Exhibit C.
DEFENDANTS FAILED TO PROVIDE. MAINTAIN AND REPAIR VOTING
MACHINES IN THE CONDUCT OF THE ELECTION
47. S.C. Code Section 7-13-1680 states:

The governg body of any county or municipality providing voting
machines at polling places for use at elections shall provide for each
polling place at least one voting machine for each two hundred fifty
registered voters or portion thereof or as near thereto as may be
practicable. The machines shall be of the type approved as provided for
in this title and shall be kept in complete and accurate working order
and in proper repair. The machines may be used in such election
districts or precincts in the county or municipality as the oficials holding
the election or conducting the primary may determine. The governg
body of the county or municipality owning the machines shall have
custody of such machines and other fiture or equipment of the polling
places when not in use at an election.
S.C. Code Ann. 7-13-1680 (emphasis added)
48. S.C. Code Section 7-13-1680 states:

If any vote recorder being used in any election shall become out of order
during such election, it shall be repaired, if possible, or aother vote
recorder substituted by the custodian or county election offcials as
promptly as possible, for which purpose the govering body of the county
may purchase as many extra vote recorders as it may deem necessary, but
in case such repair or substitution cannot be made, paper ballots, printed or
writen and of any suitable form, may be used for the taking of votes.
S.C. Code Ann. 7-13-1470
Defendants have failed to comply with these mandates resulting in a widespread failure
as publically reported and not reasonably in dispute.
DEFENDANTS ILLEGAL PROCEDURE TO REPLECATE UOCAV A BALLOTS
50. Upon information ad belief, Defendants are illegally replicating UOCA VA ballots by
hand for the purpose of using a machine to count the ballots.
51. As explained above, UOCA VA ballots can be retued via email or fax. See S.C. Code
Ann. 7-15-405 & -406.
52. These ballots are not machine-readable.
53. Even though these ballots are not defaced, Defendants ae none-the-Iess replicating them
by hand. This procedure is prohibited by the statute concerng defaced ballots which

establishes the exclusive circumstances under which election ofcials can replicate
ballots. S.C. Code Section 7-13-1410 states, in relevant pa,that:
Provided, that if it appears that a ballot is so torn, bent, or otherise
defaced or has been marked by other than the marking device, so that
it cannot be counted by the automatic tabulating equipment, the
county election commission may cause a duplicate of each such ballot
to be marked so that it can be so counted. Such duplicate ballots, when
so authorized by the commission, shall be prepaed at the counting station
in the presence of witnesses and substituted for the original ballots,
which duplicate ballots shall be counted by the automatic tabulating
equipment. The original ballots shall be preserved and all such duplicate
ballots shall be clearly labeled with the word "duplicate" and shall bear a
serial number which shall also be recorded on the original. At the counting
station, write-in votes tabulated by the precinct ofcials shall be added to
the results from ballots tabulated with the automatic tabulating equipment
and the totals certifed as the precinct count on the sW ary sheet.
S. C. Code Ann. 7-13-1410
54. Upon information and belief, none of the non-machine readable; UOCA V A ballots were
tom, bent or otherwise defaced.
55. Upon frther information and belief, no witnesses were present during these replication
ad substitution despite the presence of Plaintif, other observers and members of the
South Carolina press corp.
IRREGULARITIES IN VOTE TOTALS REMAIN UNEXPLAINED BY DEFENDANTS
56. Defendants have also offered no explanation for numerous irregularities in the reported
vote totals.
57. Defendants have offered no explanation for how the fnal absentee update could add 267
votes to Finlay's total but not a single vote to McCulloch's total for the Absentee 3
category.
58. Defendants have offered no explanation for what types of absentee votes are included in
the Absentee 3 category.

59. Defendants have offered no explanation for why HD-75 has not reported a single vote in
category Absentee 4, as compared to numerous other elections in Richland County
reporting votes in that category.
60.
Defendants have offered changing explanations for the nature, extent and timing of
problems resulting in the delayed reporting of vote totals fom voting machines. This
process took an unprecedented 36 hours fom the time the polls closed until preliminary
reports were available.
PRYER FOR A TEMPORRY RESTRINING ORER
61. Pursuant to Rules 64 and 65, SCRCP, Plaintif respectflly seeks an 0X]0rl0 temporary
restraining order
62. "Pursuant to Rule 65(b), SCRCP, a trial judge can issue a temporary restraining order
without providing notice where it clealy appears fom specific facts shown by afdavit
or by verified complaint that immediate or irreparable injury, loss or damage will result
to the applicant before notice can be served and a hearing had thereon." Zabinski v.
Brigt Acres Associates, 346 S.C. 580, 600-01, 553 S.E.2d 110, 120 (2001).
63. As previously alleged, Defendants have demonstrated that the conduct and counting of
the 2012 general election has and is being conducted in a grossly incompetent manner
resulting in widespread illegality and irregularity.
64. These illegalities and irregularities appear to be outcome determinative in HD-75 where
the contest appears to be very close and dictated by a change in only a few hundred votes.
65. Failure to intervene immediately and seize the voting machines, all ballots cast, and all
equipment necessary to conduct an accurate count of the votes in HD-75 may prevent ay
accurate count or recount fom occurring.

This would not only harm the Plaintiff, who has an interest in electing its candidate to
HD-75, but would also harm the public who has a strong interest in the open, honest and
accurate conduct of its elections.
67. Accordingly, Plaintif respectflly requests an Order fom this Court:
i. That the Richland County Sherrif seize all voting machines, ballots cast and
machinery necessary to count the votes case in HD-75;
ii. That the Sherriff deliver these materials to SLED for safekeeping until m
emergency hearing can be held;
iii. That the Court hold an emergency hearing to determine the extent and nature
of the illegalities and irregularities alleged here and discovered through swor
testimony;
iv. That the Court order an audit and count of all votes cast in HD-75, regardless
of marmer cast, by a competent, independent authority of the Court's
choosing; and
v. That the Court order all other relief that it deems just and proper.

Richland County election officials might have broken
state election laws by having too few voting
machines in place as complaints have surfaced from
precinct captains that they received a lot fewer
machines than usual.
The county also has been pelted with complaints
from irate voters, more than in any other election in
memory, a spokesman for the S.C. Election
Commission said Wednesday, as politicians call for a
public inquiry of what went wrong - and maybe even
a new election.
Some critics called for the head of elections director
Lillian McBride, who has held her $86,394 post since
July 201 1 when the county merged its voter
registration and elections offices. Some voters waited
in line up to seven hours. Some left the polls without
voting. And at least 20 percent of precincts, plus
absentee ballots, weren't counted until Wednesday
evening, as key races hung i n the balance.
State election laws require one voting machine for
every 250 registered voters or "portion thereof or as
near thereto as may be practicable," according to the
language of the statute.
Voters across the county - as well as some precinct
managers - said the number of machines was down
from previous years, in an election where officials
were expecting near-record voter turnout.
State law also requires local election oficials to have
one poll worker for ever 250 registered voters.
McBride's office has not said how many people
staffed the county's 124 precincts Tuesday.
McBride declined The State newspaper's requests
Wednesday for interiews, citing the crunch of late
vote counting that continued almost 24 hours after
polls closed.
But the newspaper's analysis of the latest registration
data provided Wednesday by McBride's Elections
Voter Registration office shows about 245,000
registered voters.
That means county election oficials should have put
as many as 982 machines into precincts.
The wait was over four hours to vote at Rice Creek
Elementary on Hard Scrabble Road in Columbia
during election day Tuesday. Lines went down two
hallways that fd into where the voting machines
were located.

McBride's deputy, Gary Baum, provided the
newspaper on Wednesday the precinct-by-precinct
tally of registered voters that totaled 245,328.
State elections spokesman Chris Whitmire said the
law requires local elections officials to calculate the
number of machines based on "active" voters, not
just those who have registered to vote. Whitmire said
his office has a list provided by the county on Nov. 2
showing 244,923 active voters. Baum did not say the
figures he provided the newspaper had been purged
of inactive or no-longer-qualifed voters.
McBride's office has yet to say precisely how many
machines were distributed.
But Baum said Tuesday night the number was
between 750 and 800 of the 1 , 000 machines the
county has. He said unused machines were broken
and a couple dozen were assigned to election
headquarters for "fail safe" voters, those who had
moved within the county and had notified election
officials.
Baum said he did not know why all of the 200 to 250
machines went unused.
State law requires one voti ng machine or more per
250 voters at a precinct. Some examples reported

The law's "as near thereto as practicable" language gives local election officials some "wiggle room" on a
precise number of machines required, Whitmire said.
But the law has no teeth. It carries no penalty for violating it, other than lawsuits, he said.
Poll workers complain
Many precinct captains of the county's 124 precincts said they received fewer machines on Tuesday than
usual.
"During the (GOP) primary (in June), we had eight when only 50 people voted," a manager from the
Lincolnshire precinct said Tuesday night as she stood in line with her counterparts at elections
headquarters in the county administration building. She said her precinct was given six for the presidential
election Tuesday, and that one broke.
Poll workers from the A.C. Moore, Keenan, Dutch Fork and Pontiac precincts had fewer machines than in
past elections.
Nancy Brock, a poll worker for 27 years in Richland County, said Wednesday she was stunned to learn that
her voting location received half the number of usual machines. Her A.C. Moore Elementar School
precinct typically receives six machines. Tuesday it got three, Brock said.
Precinct workers asked a county representative who visited the school Monday to provide at least one
more machine. "We pleaded for another machine," Brock said. "The answer was obviously no."
This time, the county didn't ask her how many machines were needed, in contrast to former longtime
elections director Mike Cinnamon, whom Brock said checked regularly with poll workers.
Frank Sarnowski, poll clerk at the Ward 33 precinct in Martin Luther King Park near Five Points, said he
also was not asked by the county how many voting machines were needed. The county usually provides
five machines. The precinct got three this time.
Iasked for more, " Sarnowski said Wednesday. "They said that was all that was available. They didn't say
why."
McBride said Tuesday her staff did ask some poll workers how many machines they needed.
The problem was made worse when machines broke down in possibly dozens of locations.

Whitmire told The Associated Press that state officials sent extra voting machines to some polling places in
the county and that they also dispatched extra technicians to service broken machines.
The shortage of machines available does not appear to be tied to the budget for McBride's office.
County Council granted her the full $1 ,228,574 McBride requested for the fiscal year that began July 1 ,
county spokeswoman Melinda R. Edwards said i n an email to the newspaper. The fiscal year before,
Council added about $1 53,000 to McBride's budget request of $1 , 1 05,765, according to the email.
"They got the most money they've ever had," County Councilman Seth Rose said.
With the highly contested penny sales tax and a couple of tight political races hanging in the balance
Wednesday, McBride and her staff stayed busy feeding paper absentee ballots into a counting machine,
which had broken down at about 1 a.m. and didn't get rolling again until about 1 0 a.m. Technicians
scrambled to unlock information stored in some voting machines that had malfunctioned during the process
of consolidating votes from multiple machines at the same precinct.
Political fallout
McBride and Baum kept political operatives and reporters gathered at the office up-to-date on the count,
but they declined to explain what went wrong or why the day before.
They said the ofice would issue a news release, but none had been sent by 9:30 p.m.
Tuesday night, as frustrated voters waited in lines after the polls closed - some unable to vote until nearly
midnight, McBride repeatedly put of interview requests from the newspaper as well as television reporers.
However, she spoke with a State newspaper reporer about 5:30 p. m. before polls closed and blamed the
troubles on her predecessor.
She has made no public statement since.
State Reps. James Smith and Todd Rutherord and County Council chairman Kelvin Washington and
Councilman Joe McEachern were among the politicians gathered at McBride's office Wednesday.
Smith and Rutherford held an impromptu news conference to announce the delegation will conduct a
hearing on the voting problems, as soon as next week.
"We plan to focus on accountabil ity and how we make sure this doesn't happen again," Smith said.
"We're gOing to get to the bottom of this," Rutherford said. "It's not only outrageous, it violated the law . . . .
We're not sitting here apologizing for it. We know something didn't go right."
They said they don't know whether machines weren't serviced properly or whether the poll workers weren't
sufficiently trained.
State law requires keeping machines voting-ready and poll workers trained.
While Smith and Rutherford, both Democrats, were reluctant to say whether the problems determined the
outcome of races, they agreed that many voters gave up because of the long waits, losing their right to
vote.
Rep. Nathan Ballentine, a Republican from Chapin who represents porions of Richland and Lexington
counties, called the problems inexcusable and aimed his criticism at McBride.
"At this point, I'd be hard-pressed to say she needs to be in charge of the next" election, Ballentine said.
Richland Councilwoman Val Hutchinson, who won a squeaker of a re-election to a third term Wednesday
night, said she's part of a group looking into contesting the election and asking for a "revote. "
"We think there have been enough complaints countywide that i t warrants looking into what happened
during this election, correcting it and holding another election," said Hutchinson, one of three Republicans
on the 1 1 -member Richland County Council.
Rep. Joe Neal, D-Richland said, "This was a nightmare, a massive failure of voting machines across the
county."
Legislators were assured the voting process would run smoothly, Neal said. "We were all led to believe
there would be no problem."

Early voting laws?
Whitmire said the difficulties underscore the need for a state law allowing early voting. Dozens of bills have
failed to get through the Legislature, the state elections office spokesman said.
Meanwhile, the leader of the county's legislative delegation, Sen. Darrell Jackson, D-Richland, said
Wednesday that McBride, top members of her staff and Richland County Election Commission chairman
Liz Crum, an election law specialist, will testif next Tuesday before a group of local and state officials
about the voting snafus.
The delegation selects the 1 5-member elections commission, and the delegation unanimously selected
McBride over Cinnamon, who had directed county elections since 1 975, to run the office.
The hearing is slated for 1 1 a. m. Tuesday in the Senate Gressette office building's Judiciary Committee
room on the State House grounds, Jackson said.
The public may attend. But if a crowd shows up, the location might change, he said.
Cinnamon, who retired last year after 40 years of managing elections in Richland County, said Wednesday
he had never encountered problems like those that occurred Tuesday.
McBride told The State on Tuesday afternoon that Cinnamon had not left information on "how many
(machines) they may have used in the past."
If the county needed guidance from past elections, Cinnamon said Wednesday, there are two sets of
records available to McBride's staf: an election file showing the number of machines in past elections and
election returns, which show the number of machines used.
Asked whether her office called Cinnamon for advice, McBride said, "I'll plead the 5th on that one."
Amid all the political fallout, a voter who contacted the newspaper put all the heated rhetoric into
perspective.
Tom Eggleston, a minister who voted in the Riveralk precinct near Irma, said he was as frustrated as
other voters about waiting more than four hours on a chilly morning to cast his ballot.
"As I stood in line for four hours and 1 5 minutes to vote . . . it dawned on me," Eggleston wrote in a letter to
The State newspaper. "How does my four hours and 1 5 minutes compare to the soldier who is out in the
trenches everyday protecting my freedom? How does my four hours and 1 5 minutes compare to the
homeless man who is out on the street with no place to go?
"Standing in line is a privilege because it allows each of us the ability to cast our voice for freedom."

Columbia, SC (WL TX) - Kirkman Finlay has
won State House District 75.
Final results released just after 6: 30 p. m.
Wednesday showed Finlay, a Republican,
defeated Democrat Joe McCul loch by a final
vote tally of 6,771 to 6,506.
A string of problems which took place on
election day led to the delay in results.
Malfunctioning machines (or too few at
some precincts) led K long lines and
people casting ballots hours after the polls
closed. A broken scanner stopped vote
counting in the middle of the night, and
that efort didn't resume until mi d
Wednesday morning.
McCulloch was leading after the electronic
bal lots were counted, but was edged out
when absentees were tabulated.
Finlay would take over for Jim Harrison,
who didn' t seek re-election. Finlay, a local
restaurateur, previously served on the
Columbia City Council and ran
unsuccessfully for Columbia mayor in
201 0.
The race will be cerified after provisional
ballots are counted on Friday.

Columbia, SC (WL TX) -- Lawmakers are
launching an investigation into what caused
problems at the polls in Richland County,
l i ke long lines and broken machines.
"We know that somebody messed up and
we're gonna find out who that person is,"
said Rep. Todd Rutherford.
"It is outrageous that someone would have
to take four hours from their work to vote.
That is denying, I think, to that fundamental
right," said Rep. James Smith.
Both lawmakers showed up at the county
election office with questions about what
went wrong at the polls.
"To figure out what happened, to find out
who's responsible, " said Rutherford. "To
make sure it never happens again."
The entire Richland County legislative
delegation will join with Richland County
council member for a hearing next Tuesday
at 1 1 a. m. to get answers on what
happened, but Rutherford already has an
idea about one thing that wasn't right in
many county precincts.
"It violated the law, we in the state house
make sure that there's one machine for
every 250 people voting in a precinct that
was not present yesterday," said
Rutherford.
"We're gonna make sure the public
understands what occurred so they can
have confidence and know that there's
gonna be a legitimate fix in place and it's
not gonna be a problem going forard,"
said Smith.
South Carolina Republican Chairman Chad
Connelly has also called for an independent
investigation into the Richland County
Election .

voter frustration were just a few of the issues the Richland County
Election Commission dealt with on Tuesday as a higher than
expected turnout caused headaches for voters and poll workers.

We went straight to the head of the Richland County Election Commission to get answers.
Complaints rolled in just after the polls opened of too few voting machines for 4,700 registered
voters at Ridge View Hi gh. State law requires 1 9 machines. We spotted 1 0, and one was broken,
sparking arguments between poll workers and voters.
Poll workers told us the precinct was down to six machines for most of the day.
"They've been waiting here the same amount of time, so everyone is aggravated, but they feel that
it's a need to stay here and vote," said Owens.
The story was exactly the same in Ward 25.
"I'm going home to get some hot dogs, Cokes and sell them to people in line, give the money to the
elections commission," joked one Ward 25 voter.
We went to the Election Commission around midnight and watched as voting machines rolled in. We
also found Elections Director Lillian McBride, who was unable to talk because she was beginning the
process of checking the voter machines.
We spent the next two hours waiting for McBride and her staff to finish checking in voting machines.
At 2:30 a.m., we watched the last machine come in, then went to find the director.
McBride said she was unsure what happened to cause fewer machines to be available, but she did
say that enough machines were out for the election.
"We'll find out tomorrow and go over and see exactly what happened and whatever. We' ll make sure
we take care of it so it won't happen in the future," said McBride.
The South Carolina Elections Commission calls it ridiculous.
"There's no reason a voter should have to wait in line six hours to vote, " said Chris Whitmire,
spokesman for the state Elections Commission. "That's unacceptable."
Especially when that wasn't the case four years ago and the turnout was closer to 2004, which also
didn't see the problems of this year. The Election Commission heard from voters about the lack of
machines compared to the numbers standing in line. There is a state standard.
"State law sets a standard of one voting machine for every 250 registered voters," said Whitmire.
That law also provides some leeway, allowing officials to be or as near there as to what maybe
practical.
The state law bases it off of registered voters in that precinct," said Garry Baum with Richland
County Elections Commission. "We also use other numbers such as historical voter turnout.
Depending on what elections are going on in what preCincts."
If a county doesn't comply, we found there's no one enforcing the state law or punishing those who
don't meet it.
"[Richland County1 is going to have to take a close look at their plan for allocating voting machine,
allocating poll managers, and other resources on Election Day," said Whitmire.
State Election Commission officials say every voting machine should have been tested in advance
of yesterday with test ballots run.
The county denied our request to interiew the elections director Wednesday morning or to provide
details on what happened.
However, the county did provide a statement on its website, saying they made "every effor to get
additional voting machines and to provide technical assistance to fix voting machines that went
down,"
