THE SITUATION
Neha narrated an incident. Neha an employee had been living with her family in Eknath Sadan ,Dadar West. The building was constructed in 1947. A few tenants have been residing in the same building. Being tenants, they paid rent for the property . Due to some personal incident a tenant family vacated the rented house for a period of 6 months, without informing the land lord. The room was left unattended for that particular duration. There were termites in the furniture, leakages in their house and a few more. Rent was also not paid for that particular duration After that period the family again wanted to stay in the same house with the same rent. Neha faced an ethical dilemma to allow the tenants to stay in the same house or to discontinue their stay as the law allows any landlord to vacate his/her premises, if the tenants refrain from staying in the property or they dont pay the rent.

THE RESOLUTION Neha took the decision in favor of the ethical values. Not much process was followed to take the decision. The tenants were allowed to stay on the same property. Rent of six months was later accepted from the tenants.

ANALYSIS & COMMENTS


I would have taken the decision on the following basis: 1. Defined the problem / dilemma. 2. Gathered the necessary facts. 3. Listed the possible alternative solutions. 4. Analyzed the consequences of each alternative. 5. Recommend a plan of action.

Ethical Dilemma: Ethical dilemma was to allow the tenants to stay in the same house or to discontinue their stay as the law allows any landlord to vacate his/her premises, if the tenants refrain from staying in the property or they dont pay the rent. Necessary Facts : 1. Tenant personal details. 2. Legal Options : Rent Control Act ,Maharashtra Rent Control Act etc. 3. Better Options for renting the property. Possible Alternative Solutions: 1. Allow the tenants to stay in the same property. 2. Introduce new tenants in the property. 3. Sell of the property. Alternative Solutions Analysis: 1. Allow the tenants to stay in the same property : This would improve the relationship with the tenants , at the same time such incidents can happen again. 2. Introduce new tenants in the property : New tenants need not be as trustworthy as the old ones. The property was constructed in 1947, the tenants would have been staying at the same location from a quite long time. Its difficult to replace the old tenants by new ones.

3. Sell of the property: The cost of property would be more in the area, yet the owner might prefer to retain the property Plan of Action: 1. I would have analyzed all available options. 2. Taken a legal perspective. 3. And taken a decision.
