ALLEN, INDIVIDUALLY AND AS REPRESENTATIVES OF A CERTIFIED CLASS OF MEMBERS, TO APPOINT CHAPTER 11 TRUSTEE David A. Wilhelm (Wilhelm) by and through his counsel, Gordon & Rees LLP, hereby files his Joinder in Debtors Opposition to Motion of Cheryl M. Foley, Thomas Wilner, Jane Wilner, Charles Jackson, Mary Jackson and Kevin B. Allen, Individually and as Representatives of a Certified Class of Members, to Appoint Chapter 11 Trustee (the Joinder) and states as follows: 1. Wilhelm hereby joins in the Opposition to Motion of Cheryl M. Foley, Thomas Wilner, Jane Wilner, Charles Jackson, Mary Jackson and Kevin B. Allen, Individually and as Representatives of a Certified Class of Members, to Appoint Chapter 11 Trustee (the Opposition) filed by Cordillera Golf Club, LLC (Debtor) and incorporates the Opposition herein by reference. 2. Cordillera Golf Holdings, LLC (Holdings) holds one hundred percent (100%) of Debtors membership interests. Holdings is owned by Cordillera Development, LLC (Development). Wilhelm made a loan to Debtor. In exchange, Debtor received a security interest in Debtors real and personal property. 3. Grounds for appointment of a trustee, including fraud or gross mismanagement, do not exist in this case. // // // //
