BALLOTS FOR ACCEPTING OR REJECTING JOINT LIQUIDATING
AMENDED PLAN OF FASTSHIP INC. AND ITS SUBSIDIARIES PURSUANT
TO CHAPTER 11 OF THE UNITED STATES BANKRUPTCY CODE
I, Scott M. Ewing, hereby declare as follows:
1.

I am a member of Omni Management Group, LLC (Omni), the court

approved claims administrator and noticing agent in the above-captioned chapter 11

cases.
2.

Pursuant to the Order Approving (I) the Disclosure Statement; (II)

Procedures for the Solicitation and Tabulation of Votes to Accept or Reject the Debtors
Chapter 11 Plan; and (III) Related Notice and Objection Procedures (the Disclosure
Order) [Docket No. 99], Omni solicited and tabulated votes from all Holders2 of Claims
or Equity Interests in the Voting Classes.
3.

I am authorized to submit this declaration on behalf of Omni. Unless

otherwise stated in this declaration, I have personal knowledge of the facts set forth

FastShip, Inc., (8309)(Case No. 12-10968 (BLS)), FastShip Atlantic, Inc. (0980)(Case No. 12-10970 (BLS))
and Thornycroft, Giles & Co., Inc. (1142)(Case No. 12-10971 (BLS)). The mailing address for the Debtors
is 1608 Walnut Street, Suite 501, Philadelphia, PA 19103.

Capitalized terms not otherwise defined herein shall have the meanings given to them in the
Disclosure Order.

herein and, if called upon as a witness, I could and would competently testify as to all of
the matters stated herein.

In order for a Ballot to be counted as valid, the Ballot must have been

properly completed in accordance with the Disclosure Order, executed by the relevant
Holder (or such Holders authorized representative), and must have been received by
Omni by June 25, 2012 at 5:00 p.m. (EST) (the Voting Deadline).3
5.

Pursuant to the Disclosure Order, all completed Ballots were required to

be mailed to FastShip, Inc. et al. Claims Processing, c/o Omni Management Group, 5955
DeSoto Avenue, Suite 100, Woodland Hills, CA 91367, which address was listed on the
Ballots, so as to be received by Omni no later than the Voting Deadline.
6.

I was primarily responsible for supervising the employees of Omni in

connection with the tabulation of the Ballots received for the acceptance or rejection for
the Plan.
7.

The pertinent information from the Ballots received from Holders of

Claims or Interests in the Voting Classes was recorded on the ballot tally sheets (the
Ballot Tally Sheets) attached hereto as Exhibits 1-5. Copies of all of the counted
Ballots are available for inspection upon request. The Holders of Claims or Interests in
the Voting Classes voted as follows:
