DEBTORS MOTION FOR AN ORDER SCHEDULING CONFERENCE TO DISCUSS STATUS OF THE DEBTORS PLAN OF REORGANIZATION The above-captioned debtors (collectively, the Debtors) hereby move the Court (this Motion) for the entry of an order, substantially in the form of Exhibit A, scheduling a conference to discuss the status of the Debtors plan of reorganization, including the status of their ongoing negotiations with their principal creditor and customer constituencies. Jurisdiction 1. The Court has jurisdiction over this matter pursuant to 28 U.S.C. 1334.

This matter is a core proceeding within the meaning of 28 U.S.C. 157(b)(2). 2. 3. Venue is proper pursuant to 28 U.S.C. 1408 and 1409. The statutory basis for the relief requested herein is section 105(d)(1) of

the Bankruptcy Code, 11 U.S.C. 101-1330 (the Bankruptcy Code). Background 4. On May 17, 2005 (the Petition Date), the Debtors filed their voluntary

petitions for relief under chapter 11 of the Bankruptcy Code. The Debtors are operating their businesses and managing their properties as debtors in possession pursuant to sections 1107(a) and 1108 of the Bankruptcy Code. No trustee or examiner has been appointed in these cases. On the Petition Date, the Court entered an order jointly administering these cases pursuant to Rule 1015(b) of the Federal Rules of Bankruptcy Procedure. 5. On May 24, 2005, the United States trustee appointed an official

committee of unsecured creditors pursuant to section 1102 of the Bankruptcy Code (the Committee). 6. The Debtors and their non-debtor affiliates are leading global suppliers of

automotive components, systems and modules to all of the worlds largest vehicle manufacturers, including DaimlerChrysler AG, Ford Motor Company, General Motors Corporation, Honda Motor Company, Inc., Nissan Motor Company Unlimited and Toyota SA. 7. On August 30, 2006, the Debtors filed the Joint Plan of Reorganization of

Collins & Aikman Corporation and Its Debtor Subsidiaries [Docket No. 3234] (the Plan) and the disclosure statement related thereto [Docket No. 3233].

On September 27, 2006, the Court entered an order [Docket No. 3395]

extending the Debtors exclusive right to (a) propose and file a reorganization plan to October 27, 2006 and (b) solicit and obtain acceptances of such a plan to December 27, 2006. 9. In connection with their Plan, the Debtors have been, and continue to be,

engaged in several negotiations with their principal customers regarding the global resolutions necessary to satisfy certain conditions to confirmation and for the Debtors to emerge from chapter 11. In addition, the Debtors and the unofficial steering committee for the Debtors senior secured prepetition lenders (the Steering Committee) have been, and continue to be, engaged in a dialogue with the Committee regarding a consensual plan of reorganization. The subject of these negotiations reflect very sensitive and confidential commercial matters. Relief Requested 10. By this Motion, the Debtors request the entry of an order, pursuant to

section 105(d)(1) of the Bankruptcy Code, scheduling a conference with the Debtors, the Committee, the agent for the Debtors senior secured prepetition lenders (collectively, the Prepetition Lenders), the agent for the Debtors senior secured postpetition lenders (collectively, the Postpetition Lenders) and the United States trustee on October 26, 2006 at 2:00 p.m. prevailing Eastern Time, to discuss the status of the Debtors Plan, including the status of their ongoing negotiations with their principal creditor and customer constituencies. Given the sensitive and confidential nature of the information to be discussed, consistent with section 107 of the Bankruptcy Code, the Debtors request that this status conference take place in chambers or in a sealed courtroom.

Basis for Relief 11. The Bankruptcy Code authorizes the Court to hold a status conference

regarding any case or proceeding under [the Bankruptcy Code] after notice to the parties in interest. . . . 11 U.S.C. 105(d)(1). 12. As this Court is already aware, on August 30, 2006, the Debtors formally

initiated discussions with each of their six principal customers by distributing initial drafts of comprehensive global settlement agreements. Reaching global settlement agreements with their principal customers is critical to strengthening the basis on which the Debtors long-term viability is dependent. As set forth in the Debtors Sixth Motion for an Order Extending the Debtors Exclusivity Periods to File a Chapter 11 Plan and to Solicit Votes Thereon, several other negotiations and actions are ongoing. The Debtors strongly believe that it is appropriate to update the Court regarding the status of these negotiations and actions near the end of this month. 13. The Debtors respectfully submit that it would be beneficial to the Court to

hold a status conference, at which time the Debtors would apprise the Court of the general status of each of their ongoing negotiations and address any questions or concerns the Court may have. As the Debtors will discuss very sensitive and confidential commercial matters in this status conference that fall within the scope of protected material under section 107 of the Bankruptcy Code, they request that this status conference take place in chambers, or in a sealed courtroom, with the Committee, the United States trustee, the agent for the Prepetition Lenders and the agent for the Postpetition Lenders.
