The Treasury Board Secretariat has advised that there is no "government-wide" policy

Canadian Radio-Television & Telecommunications Commission
(a) The Canadian Radio-Television & Telecommunications Commission has not requested any content
removal issued to Google Inc. for the periad of April 1 ,2011 to June 19,2012.
(b) The CRTC does not have a pQlicy or procedure concerning the requests for removal of content posted
on the internet. The CRTC is charged with regulating Canadian telecommunications common carriers and
broadcasting undertakings. It does not have the mandate to regulate Google Inc. Canadian Braadcasting
undertakings operating over the Internet are largely exempt from CRTC regulation imposed under th,e
Broadcasfing Act. These undertakings must, however, abide by certain requirements. Where the CRTC
determines that such a requirement has been breached, it could, under appropriate circumstances, order the
concerned undertaking to cease providing access to a given program. Such an order would only be issued
after a Commission process.

The CRTC's jurisdiction to control content broadcast over the Internet under the Telecommunications Act is
very limited. The only applicable provision is s.36 which provides that:
,36. Except where the Commission approves otherwise, a Canadian carrier shall not control the
content or influence the meaning or purpose of telecornmunications carried by it for the public.
Library and Archives Canada
(a) Library and Archives Canada has not requested any content removal issued to Google Inc. for the period
of April 1, 2011 to June 19, 2012.
(b) Library and Archives Canada does not have a policy or procedure concerning the requests for removal of
content posted on the internet.
National Battlefields Commission
(a) The National Battlefields Commission (NBC) has not requested any content removal issued to Google
Inc. for the period of April 1, 2011 to June 19, 2012.
(b) The Commission has no such governmnt-wide policy, as no third-parties is allowed to post content on
NBC's website.
National Film Board
(a) The National Film Board (NFB) has issued 5 content removal requests issued to Google Inc.
(i) There were two requests on July 27, 2011, two requests on December 12, 2011 and one request
on January 18, 2012.
(ii) Requests were made by the NFB.
(iii) NFB has used Google video administration tool to have content remove when: 1) a Google video user
posts an NFB production on the site without written permission from the NFB. The NFB holds the copyright
and distribution rights for its productions and rnany of its co-productions. Films put online on Google Video
can be seen free of charge and this has a negative impact on our ability to generate revenues. 2) An NFB
production or co-production may be under exclusive or non-exclusive license for distribution bya third-party.
(iv) The content has been removed.
b) NFB films are placed online by non NFB personnel on Google Video or Youtube from time to time.
Whenever the Board discovers this type of thing (as part of our social media monitoring activities or
marketing operations and through targeted internet searching, NFB personnel, partners and clients report
the existence of an NFB production on Google;) using the Google administrative function for this purpose,
we ask the video to be removed from Google video. Unfortunately, another Google user can put the same
film online again, so with certain new and popular NFB releases, the Board might have to repeat the
procedure several times over. In ail cases however, the film is removed after our request to Google.
Public Service Commission
(a) The Public Service Commission has issued one request to Google Inc. to remove content from YouTube.
(i) ln January 2012
(ii) The Public Service Commission
(iii) Two videos were posted on YouTube that infringed on the Commission's copyright by reproducing its
material without implicit or explicit permission. One video was originally posted on the Commission's '
internai website and was intended for internai use only. The second video was modified to include
derogatory statements. As weil, the person who posted the videos did not indicate that the reproductions
were not produced in affiliation with, nor endorsed by, the Government of Canada.
(iv) The videos were removed from YouTube.
(b) There is no "government-wide" policy concerning the requests for removal of content posted on the
internet, nor does the Commission have a policy or procedure in place for these types of requests.

affich sur Internet. Le CRTC est charg de rglementer les entreprises de tlcommunication et de
radiodiffusion canadiennes. Il n'a pas le mandat de rglementer des entreprises comme Google Inc.
Les entreprises de radiodiffusion canadiennes exerant des activits sur Internet sont gnralement
soustraites aux dispositions rglementaires nonces dans la Loi sur la radiodiffusion. Elles sont cependant
tenues de respecter certaines exigences. Si le Conseil conclut q'une exigence donne n'a pas t
respecte, il pourrait, si les circonstances le justifient, ordonner l'entreprise en cause de retirer ('accs
une certaine mission. Ce genre d'ordonnance ne serait mis qu'au terme d'une instance mene par le
Conseil.

Aux termes de la Loi sur les tlcommunications, le CRTC jouit d'un pouvoir trs limit pour contrler le
contenu diffus sur Internet. La seule disposition pertinente est l'article 36, qui stipule que:
36. Il est interdit l'entreprise canadienne, sauf avec l'approbation du Conseil, de rgir le contenu ou
d'influencer le sens ou l'objet des tlcommunications qu'elle achemine pour le public.
Bibliothque et Archives Canada
a) Bibliothque et Archives Canada n'a fait aucune demande de suppression de contenu adresse
Google Inc. pour la priode du 1er avril 2011 au 19 juin 2012.
b) Bibliothque et Archives Canada ne dispose d'aucune politique ou procdure concernant les demandes
de retrait de contenu affich sur Internet.
Commission des champs de bataille nationaux
a) La Commission des champs de bataille nationaux (CCBN) n'a fait aucune demande de suppression de
contenu adresse Google Inc. pour la priode du 1er avril 2011 au 19 juin 2012.
b) La Commission n'a pas une telle procdure puisqu'aucun tiers ne peut afficher de contenu sur le site
Internet de la CG.SN.
Office national du film
a) L'Office national du film (ONF) a fait 5 demandes de suppression de contenu adresses Google Inc.
(i) Il ya eu deux demandes qui ont t faites le 27 juillet 2011, deux demandes le 12 dcembre 2011 et une
demande le 18 janvier 2012.
(ii) Les requtes ont t faites par l'ONF.
(Hi) L'ONF a utilis l'outil d'administration de Google Vidos 'pour faire supprimer du contenu dans les cas
suivants: 1) lorsqu'un utilisateur de Google Vidos diffuse une production de ,'ONF sur le site sans
autorisation crite de ,'ONF. L'ONF dtient les droits d'auteur et de distribution sur ses productions et bon
nombre de ses coproductions. Les films mis en ligne sur Google Vidos peuvent tre visionns
gratuitement, ce qui a une incidence ngative sur notre capacit gnrer des recettes. 2) Lo'rsqu'une
production ou une coproduction de ,'ONF peut tre sous licence exclusive ou non exlusive aux fins de
distribution par un tiers.
(iv) Le contenu a t supprim.
b) De temp$ autre, des personnes qui ne sont pas l'emploi de l'ONF mettent des films en ligne sur
Google Vidos ou Youtube. Chaque fois que nous dcouvrons une telle situation (dans le cadre de nos
activits de marketing ou de surveillance des mdias sociaux et par l'entremise de recherche cible sur
Internet, ou encore lorsque du personnel de l'ONF, des partenaires et des clients nous signalent l'existence
d'une production de ]'ONF sur Google), nous utilisons la fonction administration Google pour faire supprimer
Ip vido. Malheureusement, un autre utilisateur de Google peut remettre le mme film en ligne, et pour ce
qui est de certaines nouveauts et flms populaires, nous devons parfois rpter la procdure plusieurs fois.
,Mais dans tous les cas, Google supprime le film aprs rception de notre demande.
Commission'de la fonction publique
a) La Commission de la fonction publique a demand une occasion Google Inc. de retirer du contenu de
YouTube.
(i) En janvier 2012
(ii) La Commission de la fonction publique
(iii) Deux vidos reproduisant du matriel de la Commission ont t affiches sur YouTube sans permission,
explicite ou implicite, en infraction aux rgles sur le droit d'auteur. L'une des deux vidos, affiche l'origine

sur le site intranet de la Commission, tait destine exclusivement un usage interne; l'autre a t modifie
de mani$re y intgrer des commentaires dsobligeants. n outre, la personne qui a affich les vidos en
ligne n'a pas prcis qu'elles avaient t reproduites sans le concours et sans l'aval du Gouvernement du
Canada.
(iv) Les vidos ont t retires de YouTube.
b) Il n'y a aucune politique pangouvernementale concernant les demandes de retrait de contenu affich sur
Internet, et la Commission ne dispose d'aucune politique ou procdure pour ce genre de demandes.

a) La Commission des relations de travail de la fonction publique n'a fait aucune demande de suppression

Citizenship and Immigration Canada (CIC) confirms its data. As Google does not post on behalf ofthe department,
CIC has not issued a content removal request to Google Inc.
Insofar as the Immigration and Refugee Board of Canada (IRB) 1S concerned:
( .
(a) The IRB has made two requests to Google to rem ove cached results ofsearches, the
first request in February, 2008 and the second in November, 2011. In February 2008 it
came to the attention of the IRB that information regarding individuals who appeared
before the IRB could be accessed simply by doing a Google search, rathei than a se arch
of the lRB website. As a result, the IRB started to use a web robot exclusion protocol to
exc1ude search engines from scanning specifie folders on the IRB website.
Simultaneously, in order to ensure that the information was no longr being listed on
Google, the IRB made a submission to Google to rem ove their cached results from their
systems. The IRB used Google's automated web application to make this request and the
Google automated response indicated that the request was received and the normal
processing time would be 3 :'5 business days to complete.
The second request was in November 2011. As a result of changes that the IRB made to
the information technology systems to address the CLF 2.0 Treasury Board compliancy
requirement, information was aga in being listed on search engines. To mitigate this, the.
IRB updated the web robot exclusion file and again submitted a request through the
Google automated application for content removal in order to prge the identified links
that was cached on their systems. The same automated response was received from
Google.
(b) On May 27,2009, the Heads of Federal Administrative Tribunals Forum (ofwhich
the IRB is a member) adopted a statement on the use of personal information in decisions
of administrative tribunals and the posting of decisions on the websites of administrative
tribunals, which inc1uded encouraging each of its member organizations to apply the
"web robot !!xclusion protocol" to aIl full-text decisions containing personal information

Citoyennet et Immigration Canada (CIe) confirme que, puisque Google n'affiche pas au nom du ministre, aucune
demande de suppression du contenu n'a t prsente Google Inc.
En ce qui concerne la Commission de l'immigratiori et du statut de rfugi du Canada
(CISR): .
a) deux reprises, la Commission de l'immigration et du statut de rfugi du Canada
(CISR) a demand Google de supprimer des rsultats de requte mis en cache: d'abord
en fvrier 2008, puis en novembre 2011. En fvrier 2008, la CISR a remarqu qu'il tait
possible d'accder aux renseignements concernant les personnes ayant comparu devant la
CISR au moyen d'une simple requte dans Google plutt qu'en cherchant sur le site Web
de la Commission. Par consquent, la CISR a commenc utiliser un protocole
d'exclusion des robots informatiques afin d'empcher les moteurs de recherche
d'analyser certains dossiers particuliers du site Web de la Commission. Paralllement,
pour veiller ce que ces renseigriements ne soient plus rpertoris dans Google, la CISR
a demand Google de supprimer les renseignements de la mmoire cache de leurs
systmes. Pour ce faire, la CISR a utilis l'application Web automatise de Google; une
rponse automatise indiquait que la demande avait t reue et que le dlai de traitement
serait de trois cinq jours ouvrables.
La seconde demande a t prsente en novembre 20 Il. la suite de changements
apports par la CISR aux systmes de technologie de l'information pour se conformer
l'exigence Normalisation des sites Internet 2.0 du Conseil du Trsor, les renseignements
taient nouveau rpertoris dans les moteurs de recherche. Pour remdier ce
problme, la CI SR a mis jour le dossier d'exclusion des robots informatiques et a
prsent une nouvelle demande de suppression de contenu au moyen de l'application
automatise de Google afin que certains liens prcis soient supprims de la mmoire
cache de leurs systmes. La mme rponse automatise a alors t envoye par Google.
b) Le 27 mai 2009, le Forum pour les prsidents des tribunaux administratifs fdraux
(FPT AF), dont la CISR est membre, a adopt une dclaration relative l'utilisation par
les tribunaux administratifs de renseignements personnels dans leurs dcisions et
l'affichage de dcisions sur leurs sites Web, dclaration qui encourage chacun de ses
membres appliquer le protocole d'exclusion des robots informatiques toutes les
dcisions intgrales affiches sur son site, Web qui contiennent des renseignements

the same.
OF AIT has not issued any content removal requests to Google Inc.
Passport Canada
To Passport Canada has. asked Google Inc. to remove one video fram YouTube, a request that was"
made on September 30,2011. The video in question features an individual urinating on a Ganadian
passport and subsequently attempting to flush the travel document down the toilet. Passport Canada asked
that the video be removed, as the Canadian passport must never be intentionally altered or damaged.
Pursuant to the Canadian Passport Drder, Canadian passports remain at ail times the pra pert y of the
Government of Canada and are issued to the bearer on condition that every precaution be taken to
safeguard it. Desecrating property of the Government of Canada is not something we will support or
condone. Furthermore. it is unfortunate that anybody would so flagrantly abuse this privilege when so many
are tryililg to gain Canadian citizenship. Passport Canada will take ail efforts to continue to protect the ::
security and .integrity of Canadian travel documents.
Google did not comply with the request to remove the video from YouTube and Passport Canada did not
further pursue the matter.

Le MAECI n'a pas fait de demandes de suppression de contenu adresses Google Inc.
Passeport Canada
ce jour, Passeport Canada a demand Google Inc. de retirer une vido de YouTube. La demande a t
formule le 30 septembre 2011. Il s'agit d'une vido dans laquelle un individu urine sur un passeport
canadien et tente par la suite de s'en dbarrasser dans les toilettes. Passeport Canada a demand ce
que la vido soit retire, puisque les passeports canadiens ne doivent en aucun cas tre altrs ou
endommags intentionnellement.
Conformment au Dcret sur les passeports canadiens, les passeports canadiens demeurent en tout temps
la proprit du gouvernement du Canada et sont dlivrs la condition que le titulaire en prenne le plus
grand soin. Nous ne soutenons et ne tolrons pas la profanation des biens du gouvernement du Canada.
En outre, l'agence trouve regrettable le fait que quelqu'un ait abus de ce privilge de faon flagrante
quand tant de personnes essaient d'obtenir la citoyennet canadienne. Passeport Canada continuera de
dployer tous les efforts possibles pour veiller la scurit et l'intgrit des documents de voyage
canadiens.
Google n'a pas rpondu la demande de suppression de la vido de YouTube et Passeport Canada n'a
. pas poursuivi l'affaire.
