BIASED: When a judge or hearing officer has obviously lost his cold neutrality in handling his functions as arbiter, a party litigant may petition that the former inhibit himself so that the decision on the pending issues can be arrived at with impartiality. The defense panel in the CJ Corona impeachment case used this rationale as they threatened to move for the inhibition of senator-judges who they claim, are favoring the prosecution with their leading questions to the witnesses. On the other side of the hall the prosecutors are seemed overwhelmed by the regular berating they receive from one sharp-tongued senator-judge. This one is obviously biased in favor of the defense and her acts and declarations (lectures) are oftentimes out of bounds. The senator treats the honorable congressmen (all of whom were elected by their constituencies) as minions, ignorant of the law. Opinions Unlimited believes that enough is enough. lecturing on the prosecutors, she excuses herself by saying she has hypertension. Waah! Not too long ago, she promised to commit hara-kiri if she is proven wrong in her pronouncements. Later on, she recognized her mistake. When asked by the media why she is not performing her promise, she casually brushed aside the question, saying I lied!. I shudder to think that in due time, she will join the International Court of Justice as Philippine representative. (True, she graduated with honors from UP, but I am sure my 84.80% rating in the 1969 Bar is higher than hers! [yabang lang po]. HAZING: The death of a San Beda law student from a hazing session conducted by his would-be fraternity brothers once again bring to the fore the need to enforce the law which was passed after such similar deadly incidents occurred in the past. Initiation prior to admission of applicants for fraternity membership has its justification. It is the hazing ceremonies that destroy the nobility of joining a school support group. I joined the Nu Kappa Phi (Nueva Caceres Finest) Fraternity when I was taking up Accountancy, and the Rho Tau Gamma (The Thinker) Fraternity when I was in the College of Law of Enverga University. My personal experience as fraternity member (leader) highlights the importance of fraternal groups. With the help of my brothers (and sorority sisters) I attained student leadership and scholarships which carried me through university life and even up to now. US-RP TRADE: Many years ago whenever Philippine foreign trade is discussed it always refers to our bilateral relations with the USA. However not too long ago, the US lost said role as our prime partner to Japan. Chinas trade with us looms not too far down the line. All these are happening despite the multitude of Filipinos residing in the USA either as naturalized citizens, immigrants or informal residents (TnT). US Deputy Trade representative Demetrios Marantis proudly announced recently in a gathering of business people in Makati City that the USA intends to regain its erstwhile status as primary trading partner of the Philippines which is Americas most loyal ally in Asia. Bilateral US-RP trade in 2011 aggregated to just US$22 billion which is considered disproportionate to the Pinoy population in the United States who certainly contributes well to the US economy. CREDO: So much of our future remains unclaimed because of the false strength we draw from our past.
Let Go
My childhood is made up of happy bits and pieces of events and experiences. In the past, our family used to have regular excursions to nearby swimming resorts in our city. One weekend, me and my siblings were on our way to one of these places. For us, it was a very exciting event that even the night before we already bought and prepared all that we need to bring with us the next day from our towels, swimming gears to our snacks and lunch... Arriving too early, we were the first excursionists and and enjoying the whole day experience under the sun and water, we were the last to leave the place when everybody else have already left for home in the late hours of the afternoon. Actually, since it was not that often that we do it, we still would like to stay longer behind. However, we were told that nightswimming have a separate fee other than that we have paid for at the entrance gate earlier in the day. Tired and already too sleepy but nevertheless having a full day, we went home aboard our rental jeepney. We called it a day. However, in our hearts, we are longing and looking forward to another similar full day in that swimming resort in the coming days. Even during our meals together, we would often relive in our conversations our happy experiences which we all underwent before. We often end up our meals with another exciting excursion plan somewhere nearby. With the onset of Ash Wednesday, the Lenten season has just started and for me, as a priest, I have just took out from the bookshelf the third volume of my Liturgy of the Hours. The third volume of the Liturgy of the Hours in which we, clergy members, and , lately, it is being encourage among interested laity to be made as a devotion, are oblige to pray it everyday according to the proper season of the year. Its difference from the single volume Christian Prayer is that it include the Office of Readings which lengthen it to comprise four volumns, in all. While taking out the third volume, I was a bit feeling nostalgic that the liturgical season is again breaching the middle part of the year. In my mind, I still have fresh remembrance late last year when I also plucked out the first volume of my Liturgy of the Hours which is for the Advent and Christmas seasons. In me, it was as though I can still smell and hear the last of the firecracker powder exploding up in the air. Then, there is the eventual arrival of the short Ordinary Season and, now, we are again on our way to completing another meaningful liturgical season. Everyday, whenever I pray the Liturgy of the Hours, be it in the morning, daytime or evening, while going through the pages, I have this feeling of selfishness. It is as if, I would like to hold on to time. I have this feeling deep inside me wherein it is as if I do not want the day to end. I am so happy to read the Office of Readings everyday early in the morning. However, I want to hold on to the crispy pages of my prayer book and not let go. LET GO. This is the message for us every Lenten season. In our lives, there are many things that we would like to hold on to firmly. It is no wonder why our lives got clogged filling it up with unwanted rotting garbages. We got blinded to the grace of God. We sunk into the sweet wiles of temptation and eventually commit sins. We would like to hold on to happy memories. We would like to hold on to our youth and beauty. We would like to hold on firmly to our seats of power and authority, our strengths ... LET GO. Bigger things are being prepared for us by God only if we learn to let go and do away with the things that keep us away from a holiness of life- a divine relationship with God. LET GO. If God be for us, who can be against us? Romans 8:31 Dont fear or be afraid of anything anymore, at all. God will be with us carrying us through the pain and sorrows of life towards the triumph of the cross. From the death due to sin, we will be resurrected to new life. We will have a new life with him !

Flores (May 14, 1997), the Supreme Court en banc unanimously dismissed from the servicewith forfeiture of all retirement benefits and accrued leaves and with prejudice to reemploymenta Regional Trial Court (RTC) interpreter for dishonesty and for failure to disclose in her SALNs her business interest, which was a stall in the market. The Supreme Court held: Section 8 of Republic Act No. 6713 provides that it is the obligation of an employee to submit a sworn statement as the public has a right to know the employees assets, liabilities and net worth and financial and
business interests. Section 11 of the same law prescribes the criminal and administrative penalty for violation of any provision thereof. Paragraph (b) of Section 11 provides that (b) Any violation hereof proven in a proper administrative proceeding shall be sufficient cause for removal or dismissal of a public official or employee, even if no criminal prosecution is instituted against him. In Concerned Taxpayer vs Doblada (June 8, 2005), an RTC sheriff was dismissed for his failure to declare a true and detailed SALN for several years. There were discrepancies, inconsistencies and omissions in his SALNs, consisting of properties and business interests acquired but which were declared in his SALNs only two or more years later. Accuracy of entries required. Flores vs Montemayor (June 8, 2011) reiterated the penalty of dismissal for the respondents unjustified failure to declare two expensive cars in his 2001 and 2002 SALNs. My accolades are for these people. In my more active days in the media, there were over a dozen crusading newsmen in the Bicol Region. Like the heroes in Greek mythology, they had no bed of roses. Some found themselves six feet below the ground, others woke up inside prison. Ariel Ayque ended his flourishing radio career in jail on a rape charge. His friends said Ariels misfortune was the handiwork of politicians antagonized by his exposes.True or not, there is a very real danger of landing in prison or below the ground. Elmer Bandol spent three days at the Ligao jail on the libel complaint of an Albay governor. He was arrested on Christmas eve by Daraga policemen who were armed to the teeth.
Former Albay solon, Dr. Pete M. Marcellana , Jr. bailed him out with a cash bond on a borrowed money from a friend. The days of libel suits are apparently over. But do not rejoice. Libel cases have been replaced by the more sinister threat of isang bala ka lang. You cross the path of a political warlord and you are a goner. The late Ruel Endrinal of DWRL ended his life this way. John Villanueva of DZGB died by bullets. Justice has eluded them both until now. Who will follow? Blamed for the repeated killings is the culture of impunity which emboldens criminals. The utter helplessness of the government has given lawless men a shield against prosecution. The countless unsolved murder cases attest to this disappointing picture.This atmosphere has placed the lives and limps of journalists in great peril.

PILI, CamSur Anything good is worth doing well, but more importantly, anything good done well is well worth doing all over again. This aphorism must have already been in the back of Governor LRay Villafuertes mind after he launched the El Verde Movement at about this time last year. El Verdes investiture February 23 last year did indeed end up a very good thing, in fact, a resounding success. The launching was graced by national officials headed by President Benigno Simeon C. Aquino, Jr. himself who lauded the activity as an exemplary, if not the most concrete and sincere project in earnest implementation of the greening program of the national government. Along with the approbation of the chief executive, Governor Villafuerte, El Verde also earned for CamSur the distinctive accolade of getting into the Guinness Book of World Records for planting the most number of trees in one hour. town of Siruma of world-famed Caramoan Peninsula, a virtual army of 6,893 people representing a cross-section of the provincial constituency planted a total of 64,096 trees in only 15 minutes, an awesome exploit witnessed and confirmed by onsite Guinness adjudicators who declared the feat eclipsed by Indias record of 50,033 trees planted in one hour by 9,313 people in October 2010. Moreover, the 64,096 record-setting trees planted in Siruma was only part of a total of 585,566 trees planted within one hour provincewide on the same day in a synchronized simultaneous planting thrust participated in by 52,530 constituents. To cap this years monthlong celebration of El Verde Movements first anniversary, CamSur is set and keenly determined to outdo its own recordsetting exploit by targeting to plant along the coast of Ragay Gulf in Barangay San Rafael, Ragay no less than 1.2 million mangroves in one hour on March 8. The massive planting activity will coincide with the provinces official commemoration of International Womens Day, thus the activity will be dedicated to the women, environment and future of CamSur and will banner the theme Million Mangroves for Women, Environment and the Future.

College, St. Joseph School, Ragay National Agricultural and Fisheries School, and schools of the Department of Education of the city, namely Naga City Science High School, Cararayan National High School and others attended the writing workshop, which is part of a series of free write-shops to be undertaken by the NCCA desk this year. Scheduled for the Philippine Heritage Month celebration on May is a tigsik writing workshop and a lecture on dotoc. Tigsik is Bikols traditional poetic joust while the dotoc is a unique form of sung-prayers and dance paeon still performed in Minalabac, Camarines Sur during the town fiesta. The tigsik and dotoc are considered intangible heritage treasures of the region. Also scheduled on May is a lecture on the Heritage Law by Atty. Trixie Angeles, legal officer of the NCCA, and the Tigsik Bagsik. The said tigsik reading session is the Luzon leg of the NCLA Bukambibig poetry reading and literary performances series, which shall have separate staging in Quezon City, Catbalogan, and Iligan sites strategically selected to represent the cultural hubs of Luzon, National Capital Region, the Visayas,

Francis Barja, Naga City sports coordinator, said that delegations from the elementary and secondary levels are expected to arrive starting March 9 from different provinces and cities across Bicol Region. Palarong Bicol 2012 will formally open on March 11, to be highlighted by opening parade at 3:00 pm from Plaza Quezon to the Naga City Coliseum. Barja said that other sports actitivies will be held in different venues, including SM City Naga for boxing, LCC Mall for Taekwondo, ALDP Mall for table tennis and arnis, Naga City Civic Center for lawn tennis and badminton while major events will be held at the Metro Naga Sports Complex. Billeting of the delegates is already arranged, security measures are in placed and public utility vehicles operators and drivers were already briefed to ensure a visitorfriendly environment. Sports events for the weeklong Palarong Bicol included archery, arnis, athletics, badminton, baseball, basketball, boxing, chess, gymnastics, sepak takraw, sipa, soccer football, softball, swimming, table tennis, lawn tennis, taekwondo and volleybal, Barja added.

to empower and train people or communities to become effective partners of DENR in the sustainable management of forest resources. The DENR also seeks partnership with Local Government Units (LGUs), NGOs, and other groups in the implementation of CBFM program. CBFM applies to all areas classified as forest lands, including allowable zones within protected areas not covered by prior vested rights. Participants in the program are people actually residing within or adjacent to forest lands. They could actually be tilling portions of the area or traditionally using the forest resources for livelihood. The participants are organized into peoples organization which represents the interest of the members, protect and maintain forest land entrusted to their stewardship. The DENR and LGU identify CBFM areas, and organize and prepare CBFM communities. In the Bicol region, there are now 117 Community-Based Forest Management Agreements (CBFMAs) covering 49,140.33 ha with 117 peoples organization, and benefiting 9,327 individual household members from the provinces of Albay, Camarines Norte, Camarines Sur, Catanduanes, Masbate, and Sorsogon.
The BAC will issue hard copies of Bidding Documents (BDs) at DPWH, Camarines Sur, 3rd Engineering District Office, Tigaon, Camarines Sur, upon payment of non-refundable amount as stated above. All preparations are complete for the March 8 D-Day, including the preparation of bamboo planting stakes, seedlings, manpower and other logistics, Governor Villafuerte said. Since El Verdes launching last year up to the present a total of over 5.3 Million new trees have been planted around the province, close to half of El Verdes final target of 12 Million trees by the end of 2012. A brainchild of Governor Villafuerte and a component of the comprehensive provincial development agenda, the El Verde is projected to plant no less than 12 Million trees in CamSur by the end of 2012, and spearhead the environment protection and enhancement thrust in the province. More than just a reforestation project that will contribute to neutralizing the negative effects of global warming and climate change and enhance local watersheds, El Verde includes the establishment of special zones and protected areas that will also help in the preservation of wildlife, lakeshore, riverside and coastal as well as urban greening. proceeding shall be sufficient cause for removal or dismissal of a public official or employee, even if no criminal prosecution is instituted against him. Respondents deliberate attempt to evade the mandatory disclosure of all assets acquired was evident when he first claimed that the vehicles were lumped under the entry Machineries/Equipment or still mortgaged, and later averred that these were already sold by the end of the year covered and the proceeds already spent. Under this scheme, respondent would have acquired as many assets never to be declared at any time. Such act erodes the function of requiring accuracy of entries in the [SALN], which must be a true and detailed statement. It undermines the [SALN] as the means to achieve the policy of accountability of all public officers and employees in the government through which the public [is] able to monitor movement in the fortune of a public official, [as] a valid check and balance mechanism to verify undisclosed properties and wealth. In Pleyto vs PNP-CIDG (Nov. 23, 2007), petitioner was negligent for failing to provide a detailed list of his assets and business interests and for relying on the family bookkeeper/ accountant to fill out his SALN and in signing the same without checking or verifying the entries therein. Here, the Supreme Court ruled that petitioners negligence was only simple and not gross, in the absence of bad faith or intent to mislead or deceive on his part his SALNs actually disclose[d] the full extent of his assets and his wife had other business interests. Hence, the penalty imposed was only suspension for six months, without pay, not dismissal. Since petitioner had already retired, an amount equivalent to six months pay was forfeited from his retirement benefits. In OCA vs Usman (Oct. 19, 2011), the Supreme Court imposed only a fine of P5,000 even if the respondent clearly violated (Sec. 7, RA 3019 and Sec. 8, RA 6713) when he failed to file his SALN for the years 2004-2008. It seems that failure to disclose assets, when proven to show dishonesty, is more severely penalized than the failure to file the SALN. integrity, uprightness. Indeed, Ombudsman vs. Pelio (April 14, 2008) held: Under the laws governing civil service, dishonesty is classified as a grave offense the penalty of which is dismissal from the service at the first infraction. A person aspiring to public office must observe honesty, candor and faithful compliance with the law. Nothing less is expected. This ideal standard ensures that only those of known probity, competence and integrity are called to the challenge of public service. It is understood to imply a disposition to lie, cheat, deceive, or defraud; untrustworthiness; lack of integrity; lack of honesty, probity or integrity in principle; lack of fairness and straightforwardness; disposition to defraud, deceive or betray. Dishonesty is a malevolent act that puts serious doubt upon ones ability to perform his duties with the integrity and uprightness demanded of a public officer or employee. In sum, the penalty for the failure to disclose assets is dismissal if such omissions amount to dishonesty and are not due to clerical errors done in good faith. Otherwise, it is suspension. To stress, the Supreme Court decided the above administrative cases on the basis of strict legality. For impeachment cases, the Senate, after hearing the parties, has a wider policy discretion to decide whether the respondent is still fit and qualified to remain as the highest magistrate of the land.

President Benigno S. Aquino III has deputized the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) to assist the Commission on Elections (Comelec) in ensuring the conduct of a free, orderly, honest, peaceful and credible elections for the position of Mayor in Siruma, Camarines Sur on March 10, 2012.
The political exercise was being pursued following the Comelecs issuance of SPC No. 10-002 on May 19, 2011 which annuls the proclamation of then incumbent Mayor Sandy Ondis and ordering the holding of a special election in Barangay Butawanan of the said municipality. The said issuance was made after 247 uncounted ballots pertaining to the previously mentioned precincts disappeared. Section 2 (4), Article IX-C of the Constitution prescribes that the Comelec, with the concurrence of the President, is empowered to deputize law enforcement agencies during such activities.
