The Supreme Court ruling prohibited the Federal government from forcing States to expand Medicaid. For the same reasons, the Exchanges have always been VOLUNTARY. By actively assisting the Federal government in setting up Exchanges and/or expanding Medicaid, States are: http://www.scribd.com/doc/114197309/Summary-Section-1311-ExchangeProvisions-of-PPACA-and-Reconciliation-2010-Health-Care-Law Agreeing to make decisions which are not all consistent with pro-life principles (See PPACA Section 1311, (e)(1)(B)(iii)) Being irresponsible: the Federal Department of Health and Human Services has repeatedly failed to provide detailed information and can later change many elements AT WILL Commits the State to permanent expenditures, whether money is available in the budget or not (See http://grassrootsne.com/?p=19531 and http://www.samhsa.gov/Financing/post/CBO-Cost-Estimate-of-the-Repeal-ofthe-Maintenance-of-Effort-Requirements.aspx) Abdicates State Sovereignty and essentially hands Michigan's budget over to the Secretary of DHHS Exposes the State to liabilities that would only fall upon the Federal government if the State refuses complicity in implementing the law Takes away the State's ability to mount additionally available legal challenges in future - once the State gives its consent to participating in Exchanges (or expands Medicaid), that's over As chief Justice Robert's noted in his majority opinion ruling "And it seems to me that they have compromised their status as independent sovereigns because they are so dependent on what the Federal Government has done, they should not be surprised that the Federal Government, having attached the they tied the strings, they shouldnt be surprised if the Federal Government isnt going to start pulling them.

If the State refuses to do anything with the Exchanges or to expand Medicaid, the Federal government likely has no choice but to go back to the drawing board AND States and others will likely have basis for additional legal challenges:

 There are no provisions for "State Partnership Exchanges" in the health care law - this entity is purely constructed by the Secretary of DHHS and therefore, likely unlawful There are no appropriations in the law for "State Partnerships" or solely Federal exchanges - by law DHHS is required to request appropriations from the House of Representatives - which is Republican controlled No State Obamacare Exchange Still Best Choice http://www.michigancapitolconfidential.com/17969, There are no provisions for solely Federal exchanges to either provide subsidies to individuals (a new entitlement) or to provide some logistical elements necessary to implement them Feds Face Challenges in Launching Health Exchange http://www.nationaljournal.com/healthcare/feds-face-challenges-in-launchinghealth-exchange-20111219 Exchanges and Medicaid expansions - both State-controlled programs - are THE two conduits through which coverage, subsidies, AND penalties are primarily delivered.
