This motion outlines when and how the defense was denied information of James condition and then denied access to him. The defense is asking the court to grant immediate access to James Holmes.

3 Order Re: Disclosure of Records Pursuant to the Colorado Open Records Act (C-17)

This is the motion granting access to UCD records: Student Names: The court believes it may be imprudent to release names but passes that decision back to UCD. Law Enforcement Records: The court believes it may be imprudent to release those records the decision is once again passed to UCD. Education Records: The court states that the Defendant, State, and UCD have all have sufficient time to become familiar with the records and CORA requests diminishing the possibility of wrongful disclosure. The court has restricted access to the records for four months giving everyone involved adequate time to get it all ready for public disclosure. The court finds that UCD is required to address any pending and future CORA requests pursuant to state and federal law, while considering the interplay with this courts previous orders. This Order does not serve as a blanket release of all information held by UCD regarding James or as to make public any information that is otherwise protected by state or federal statutes or by rules and regulations of the supreme court or any state agency. Motion for Partial Relief from Court Orders Regarding Pre-trial Publicity to Discuss Case with Mark Hurlbert, Who Will Be Appointed Assistant District Attorney Effective January 8, 2013 [P-33] (filed 1119-2012)

The State points out that George Brauchlers term of District Attorney will begin January 8, 2013 and the preliminary hearing is January 7, 2013. Brauchler has appointed Mark Hurlbert as Assistant District Attorney. The State believes Hurlbert needs to be aware of the facts, evidence, and status of this case. Doing so without the Court's permission would violate the gag order. Hence this motion.
