Questions and answers


Budget Q: Whats the budget for the project? Will the CCAP contract be paid out of the EUR 2.2 million or separately? A: The total budget of the programme is EUR 2.2 million. We are not disclosing the estimate for the assignment at this stage, but we can confirm that the CCAP contribution forms part of the total programme budget. Accordingly, the amount available for this assignment will be reduced commensurately. Language skills requirements Q: Is it a requirement that the seven positions mentioned shall be fluent English speaking persons or whether applicants are allowed to include another mix of language skills as long as the applicants demonstrate a strong management structure to handle the language challenges. A: The firm should demonstrate a strong management structure to handle the language challenges. Language skills requirements may be adjusted in the final ToR to be issued to the shortlisted consultants. Language skills of key experts will form part of the criteria for evaluation of Technical Proposals but not of evaluation of Expressions of Interest. Please note that you are not supposed to propose candidates for the posts or to submit their CVs at this stage. Involvement of Center for Clean Air Policy (CCAP) Q: What is the precise role of CCAP in this mandate? A: CCAP will act as advisors for policy components of the project. This is as a result of in-kind contribution from one of the financiers. Q: Where can we find the Annex referred to in the draft Terms of Reference regarding CCAPs participation? A: The final ToR will include the detailed breakdown of CCAPs tasks and will be distributed with the Request for Proposals to the shortlisted firms. The guideline is, though, that CCAP takes responsibility for the activities, where it is the lead, outlined in the ToR and the successful Consultant shall assume liability for its own work (ie all other tasks). Q: Can we assume that CCAP will take care of carrying out and funding all the subtasks that the draft ToR refer to as CCAP has proposed? A: Yes Q: Will there be a single contract, or separate contracts for CCAP and the other Supplier(s)? A: There will be separate contracts for CCAP and the other Supplier(s).

Q: Would you expect the Consultant to meet CCAP in the US or during the missions in Peru only? A: We do not foresee missions to USA.

Eligibility/Conflict of interest Q: The request states that firms submitting proposals or participating in a proposal as a joint-venture partner or sub-consultant shall not have conflict of interest and cites as an example firms that have previously been involved in consultancy tasks related to the Peru component of the NPI activities are not eligible to be awarded this contract. Would this include the firms involved in the prior feasibility study (i.e. GreenStream and ClimateFocus, with input from FONAM and COWI)? A: Yes, firms involved in the preparation of the Terms of Reference are excluded. These firms have been informed. Regarding the eligibility of consultants in the next stage of the NPI work in Peru: 1. Involvement of COWI, Climate Focus and Green Stream in tender (who did the feasibility report and the ToRs): a. Are they allowed to participate on their own? No b. Are they allowed to participate in a consortium/partnership? No c. Are they allowed to participate as sub-consultants? No d. Are the persons who worked for Climate Focus and/or Green Stream allowed to participate as free consultants (e.g. take time off from Climate Focus and Green Stream and work as individual consultants)? No if they did work for the FS and ToRs of NPI. Other employees of CF and GS can participate as individual sub-consultants for some other firm of consortium 2. Involvement of the local consultants that worked with the feasibility study: a. Are they allowed to participate in any way? Not if the companies or their personnel were in any way part of writing the Terms of Reference. In this case FONAM is not excluded.

Q: I am a former employee to one of the companies involved in the feasibility study; I have since then left the company (Company A) to become director for another company (Company B). Is it acceptable for you, if Company B becomes part of a consortium participating in the bidding process, it being understood that I will NOT be personally involved and that to safeguard independence, Company B will be represented by a designated of-counsel? A: The fact that you are currently employment at Company B, is not considered to place Company B in a conflict-of-interest situation regarding the possible contract for consulting services for NPI Pilot Programme in Peru. But as also mentioned by yourself, it will not be possible for you to be involved in the project. Q: Would a government-owned entity be eligible to submit or participate in a proposal as a jointventure partner? A: Government owned entities from countries other than Peru can submit EOI alone or as jointventure partner or sub-consultant. They shall, however, function under commercial law (when providing such services), not to have immunity from being prosecuted and be able to provide a bank guarantee for advance payment. Participation in more than one consortium Q: We would like to know if is possible to participate in more than one bidding consortium during this phase? We are considering several Consortium options, and we would like to know if it is allowed to present more than one EOI as part of different consortiums?

A: A company can be a party in several EOIs submitted by different consortia. However, not more than one such consortium will be shortlisted for submission of proposals, as a company being party in submitting several proposals would be considered to have conflict of interest. You cannot know which one, if any, of the consortia you are in will be shortlisted. Therefore, your participation in several EOIs would be a serious risk to your partners as it would result to one or several of your consortium partners being excluded from submitting proposals. Miscellaneous Q: We are a large international corporation, will it count as a whole firm and all of our experience can be considered or do we need to group some country offices to gather all the expertise necessary for the project? A: In case of large international corporations, the Expression of Interest should be presented in the name of the unit or units of the corporation that would actually be involved in providing the services. Only the competencies and resources of those units will be considered when preparing the shortlist and should therefore be clearly distinguished from those of the head office or of other corporation units. Q: Do you see the assignment as predominantly a desk study (plus several missions to Peru), or do you expect the experts to spend considerable time in the country? As to the at least 6 country missions, what duration would you expect (say, 1 week per mission?). Would they be to Lima, only, or to several other departments of Peru? Will all international experts have to participate in the mission, or are key team members sufficient? A: More details on this may be provided in the final ToR to be issued tot he shortlisted firms. This will depend on the workplan and the mix of local/international specialists but experts should be prepared to spend extended periods as required. Q: As to the local experts, can these be free-lance consultants or would we need to team up with a local firm? A: Local experts can be either staff members of a local firm or individual consultants or both. Q: Could a private company involved in waste management participate as part of the consultant team? A: A private company providing waste management services could be part of consulting team unless they would be considered to have conflict of interest with their other current contracts. Participation in this assignment might also lead to them being disqualified from some other contracts in the future. Q: Please clarify to which extent the related process is kept confidential, particularly in terms of the contents of documents submitted in response to the request for expressions of interest. A: The Expressions of Interest will be accessible only to persons involved in their evaluation and related decision making, and their assistants, within NEFCO, NOAK and MINAM. The same will concern the documents and reports related to evaluation of the EOIs. The EOIs and the related documents and reports will not be classified as confidential but will, as deliberative information, not be subject to public disclosure. Q: Can the Curriculum Vitae attached to the proposal be in English, if the other parts of the EOI are in Spanish and English? A: No CVs are needed at this stage (Expressions of Interest).
