To Whom It May Concern: Family Crisis Shelter ofEI Paso is committed to assist families that refuse to be broken due to hornelessness. We provide shelter to families consisting of both parents or single mothers or fathers with their children. Here they can take warm showers, prepare homemade meals, and sleep on a bed in their own private room every night. I know that the building is not up to code, but I have been trying very hard to fix all the problems from the first day I was made aware of them. I have had a difficult time doing it on my own, due to the fact that I have, been funding the shelter from my personal business, and this is why I'm asking for your help. The court has ordered to vacate the shelter by September 28,2011, and I am asking for your help to find shelter for 14 families. The families consist of26 adults and 34 children. I have the support of Judge Daniel Robledo, who is committed to assist me and overseeing this case until it gets resolved. I am asking the city to please take an urgent humanitarian action to avoid sending these families to the streets. I need to do the remodeling as soon as possible and re-open the shelter. All I want is to meet this basic need, to provide a place that can assist them until they become self-sufficient. I am requesting a meeting with Bill Lilly from the Community Development Department, Mayor John Cook and City Manager Joyce Wilson. I have spoken almost 2 weeks in person with my Representative Cortney Niland, District 8 and have not heard from her to assist me in relocating the 14 families that are living in the shelter. To all Billy Lilly and myself were invited by Mr. David Arellano the director of the Family Crisis Center located at 2900 Rosa Ave. Our intention, was to inform the occupants upon condemnation of the property next week, there would be space for them at the Salvation Army. We wanted to make sure they knew that arrangements had been made and they had options ( and Mr. Arellano agreed we could do this). Mr. Lilly and I requested PD join us in order to insure peace. We arrived at the facility at 10:00 a.m. this morning and peacefully with the EPPD, the Salvation Army director, a case worker, Bill Lilly and myself approached the facility and asked if we co~ld come in and let the occupants know about the arrangements that had been made on their behalf. The discussions were , civil and productive until the arrival of Ms. Arrelllano who apparently is the sister to Mr. Arellano and the director of Dame La Mano. Ms. Arrellano was very hostile, yelling and demanded we leave othe facility. Once again, I remind you she is not the director of this facility and the director himself (Mr. Arellano) had invited us. Ms. Arellano screamed, yelled and told the Family Crisis Center occupants the arrangements that had been made on their behalf thru the city: "were not safe because the Salvation Army is infested with bugs and women get raped there." Both of these statements are false. The family crisis center facility is inhabitable and unsafe. I am concerned for the occupants safety and am worried about any director that uses fear and coercion when dealing with these at risk people. The Salvation Army director invited the occupants to lunch today and told them he would provide them with a tour of the Salvation Army facility so they could see for themselves the condition of the facility. Some ofthe occupants (about 6 women) took them up on his offer. Some questionable inquiries from the occupants arose during the tour with the director of the Salvation Army: the occupants of the Family Crisis Center asked the director of the Salvation Army 11 How much do we have to pay to live here?" The director who was taken back said, "nothing ....why? The occupants of the Family Crisis Center told her that at the Family Crisis Center and Dame La Mano : occupants are required to forfeit half oftheir pay check and all of their food stamps. This gives me even more concern. If they are stealing these homeless citizen's food stamps, that is a felony. I would like a full investigation launched into both facilities ASAP. I am truly concemed for these people welfare. Special thanks to Mr. Lilly, Commander Austin, and John Martin with the Salvation Army for their help in this sensitive manner.

Good Afternoon! As per the information that you had shared with Carol and I last Thursday ~egarding the Family Crisis Center (Dame La Mano) and the court order; John, Carol and myself were able to discuss it further after our meeting and scheduled a meeting for the following day. Attendees at the meeting were John Martin, Loraine Velasquez (S.A. Shelter Director), David Arellano (Family Crisis Center), Carol and myself. David came well prepared to the meeting, he had a detailed list of the number of families and their composition which Salvation Army needed. The end result was that Salvation Army was going to take in the majority of the families; 2 families already had other arrangements. We had also agreed to a press release depicting how these two agencies are working together to help homeless families. So when Lorraine called me late yesterday and gave me the bad news, I was shocked. You probably are already aware, but wanted to let you know.

Per our last conversation with David from Family Crisis Shelter on Friday the 16th of Sept. Salvation Army agreed to help provide shelter to the families that were going to be displaced due the construction at Family Crisis. We the Salvation Army agreed to take in up to two families per day beginning Monday the 19th of Sept. Yesterday, the 19th of Sept. Salvation Army employee Gina Estrada received a phone call from David stating that no families would be coming to stay at our shelter. David stated that two families were housed and the rest simply did not want to come and stay. We the Salvation Army currently have a large waiting list that was put on hold to help accommodate the needs of David's shelter; however once we were informed that none of the families would be coming we opened up our list and have been successfully filling our spaces. At this point if Family Crisis Shelter still needs assistance they would have to be placed on the waiting list. Thank You, Shelter Supervisor Lorraine Velasquez

I received a visit today from Rose Arellano and Rosa Cabrera of Dame La Mano. They were inquiring what they needed to do to obtain a permit for a tent and portable bathrooms, to be located at 1014 Virginia, to house the occupants required to vacate 2900 Rosa. They indicated the residents went to the Salvation Army today and were told they had a waiting list. I told them that it was probably because David Arellano of Dame La Mano called the Salvation Army on Tuesday and informed the Salvation Army that the occupants simply did not want to move there. They then C1hangedthe story and said the residents did not want to go there because the Salvation Army had bedbugs. I took them to BPI and met wi Tom Maguire. Mr. Maguire indicated to them that the City would not be able to issue a permit to allow individuals to be housed. I followed up wi a call to John Martin at the Salvation Army and explained what was going on. Mr. Martin indicated they still had room to house families ancl they would welcome Dame La Mano relocates. A call was then made to David Arellano to inform him there was still availability at the Salvation Army. Mr. Arellano's position was he could not force them to go to the Salvation Army. I indicated we were aware of that but just wanted him and them to know arrangements were made and are still available. I As an editorial, I believe Dame La Mano is doing everything they can to keep the residents und1erthe auspices of Dame La Mano. I am the owner of the Family Crisis Shelter of EI Paso located at 2900 Rosa which is a non-profit organization. I am giving this statement voluntarily to Detective Vanessa Acosta # 2057. I have not been forced, promised, or threatened in any manner to give this statement. I also understand that willful misrepresentation of any fact in a sworn document can subject me to possible charges of Perjury. About the first week of September 2011 I met with a Judge Robledo reference a court enforcement to shut down the Family Crisis Shelter of EI Paso. After the court hearing I was ordered to shut down the crisis center by September 27 or September 29, 2011. Everything was in process right after the court hearing to try to place residents at other bousing facilities. I went in person to Courtney Niland office in person asking for assistance in August 2011 because prior to the court hearing I knew I had to close the shelter down to renovate the building. She told me that she could not help me because she didn't put those people in danger there and that it was my problem not hers of the city. Ms. Niland told me that it was illegal and no one knew families were staying there. I told her that the Mayor knew and had called me in the past to assist a family between November -December 2010. Even Mr. Robinson from City Hall cooked a Thanksgiving Dinner for the residents at the shelter. I told Ms. Niland that she was new and didn't know the homeless situation. Ms. Niland told me that she was done and couldn't help me. After I left her office I made other attempts to get assistance from Courtney Niland but she never returned my calls. I then sent an email on September 15, 2011 to the Mayor, Bill Lily, City Manager and the City Attorney telling them Ms. Niland would not return my phone calls. I then contacted the Homeless Coalition and we set up a meeting to find housing for the residents at the family crisis center. I met with Camille and Carol from the Homeless

Coalition and John Martin and two of his staff members from the Salvation Army. We all came to the conclusion that the Salvation Army was going to take all of the families. I believe after that meeting we couldn't do anything right away because there were no case workers on the weekend for the Salvation Army. That weekend I explained to all the residents that we had found housing and the Salvation Army was going to take them in. That Monday of that week two of the families decided not to go to the Salvation Army. I believe the families stayed somewhere else. I don't remember if I called the Salvation Army or if they called me. I spoke to John Martin and told him the families refused to go and that I could not force them to stay there. I then believe that the Salvation Army bad contacted Courtney Niland telling her the residents refused to move there. I then received a phone call on September 22, 2011 from Ms. Niland who was very angry. Ms. Niland told me that how come I hadn't sent all the residents to the Salvation Army. I told Ms. Niland that I could not force them to go to a place where they did not want to go. I believe I was in conference with Mr. Bill Lily and her over the phone. I told Ms. Courtney Niland that she is welcomed to come to the Family Crisis Center and tell the residents that there was room in the Salvation Army. I told Ms. Niland that I no longer wanted to talk to her because she didn't want to help me before this. I invited Courtney Niland only and I did not invite all the people she brought to the Family Crisis Center. I believe that was on a Thursday when I spoke to Ms. Niland and Mr. Lily. On Friday September 23,2011 I received a phone call from Sylvia Contreras who is a volunteer and calls me and tells me there is a lady there with six to eight cops and telling the residents they need to leave. I asked Sylvia if they had an eviction letter or any documents that they could go in. I told Sylvia if they didn't I told her to ask them to leave. At that time I did not know it was Courtney Niland and I was working at the time and I couldn't go at the moment so I called my sister Rosa Cabrera to go to the Family Crisis Shelter of EI Paso to see what was going on. My sister from there took over once she arrived at the Family Crisis Shelter of EI Paso and I believe asked them to leave. I was advised by Detective Acosta that the investigation is against Internal Affairs could not investigate the city representatives. the officers and that at

Mr. William Lilly: This letter is in response to a letter sent to Dame La Mano on September 22, 201 1. We are an organization that began helping people over 17 years ago. We don't just consider ourselves a grassroots organization, we also consider ourselves a "heartroots" organization, because our mission and goals to heJp people come from our heart. There is a documented need for shelters for homeless families in the City of El Paso. Our Family Crisis Shelter was opened, not because we read a report documenting that there was a need, but because we met these homeless families, saw their faces and understood their needs. We love am community, these are the people we interact with on a daily basis. When you consider that we receive minimal government funding and in fact depend on internal fund-raising for 80% of om working budget, it is quite an accomplishment that we are able to assist approximately 1600 women and children (on a yearly basis) who would otherwise be homeless or living in abusive homes. Om understanding as to why the homeless families (occupants) "simply did not want to stay at the Salvation Army", is tbat they are concerned about the bed bug infestation at the Salvation Army, as we have seen children with bed bug bites on their bodies. Om plan for the Family Crisis Shelter, is to apply next week for a Temporary Certificate of Occupancy for the 1st floor only. We will continue to work on the needed improvements to bring the building into full compliance as soon as possible. Our-plan fOT the families is trr offer tnenr alternative emergency 'housing with privateindividuals and local churches that have made a commitment to help us in OUT commitment to help these homeless families. Today, September 23rd, City staff came to our shelter accompanied by police lofficers. Maybe there is a difference in people's frame of reference, but we fail to see why City staff would bring police officers and enter the property without permission or a warrant. We are considering pursuing legal action regarding this incident. I There is one issue that we believe may be due to some miscommunication, regarding audited financial statements. OUf CPA, Mr. Fernie Aceves, has completed yearly audits of our financial statements since 2000. We can't seem to find any records of a Certified Public Accountant, Pro bono publico, conducting an audit of our financial records. We would appreciate additional information to update our records. -
We appreciate the help provided to us by the staff from the Building Permits and Inspections Department, we will continue to work with them to ensure that we come into full compliance. We do understand that the City of EI Paso must follow the "rules and guidelines established by Federal, State and Local funding agencies." Sometimes our activities do not seem to quite come together as planned, but we tend to follow the needs of the homeless, who are usually in crisis situations. Sincerely,

Dear City leaders: I am writing to you and have enclose a letter due to the malicious action taken by my city representative for district 8 Niland, who came in to our second shelter located at 2900 Rosa escorted with the police intimidating our clients and harassing the homeless population, never did she called me to make an appointment to come and speck to the clients along with the Salvation Army shelter, in fact we personally went to her on September 1, 2011 to informed her about the severe situation in relocating the homeless residents, she told us that "she cannot support our agency because we put theses families in these situations, and then she told she will give me a call of what she could do, but she nv~ c~lIed me, I called multiple times and she never replied. I would of welcome her with open arms, just -as I have welcomeour last city representative Beto O'Rourke who demonstrated his compassion and integrity in helping the homeless population, yet she came in with out a search warrant escorted with 9 police officers and traumatizing the children from our shelter and putting the clients in panic she became aggressive yelling and saying this place will be shut down on Monday! due her actions we currently have a child severely anxious and depressed. Instead of Ms. Niland acting with compassion and civil for her the district she represents she enter the shelter hostile, she was forcinq the homeless clients to go into the Salvation Army where is infested with bed bugs, I have made arrangements with the United Methodist to take families until we get funds to do the repairs. I am demanding that Ms. Courtney apology for her actions because she wasted tax money in using the police officer to come and break the law by entering into a property with no search warrant.

Instead of Ms. Niland acting with compassion and civil for her the district she represents she enter the shelter hostile, she was forcing the homeless clients to go into the Salvation Army where is infested with bed bugs, I have made arrangements with the United Methodist to take families until we get funds to do the repairs. I am demanding that Ms. Courtney apology for her actions because she wasted tax money in using the police officer to come and break the law by entering into a property with no search warrant.

I also advised you to withhold any funds/contract until all issues were resolved. That is our statement to the media if we need to make any. I just received a visit from David Arellano of Dame La Mano. He indicated he was visiting because of several calls he has received from the media regarding an investigation of Dame La Mano that allegedly was initiated by Rep. Niland. He indicated that the news media was going to be at Dame La Mano at noon, today.
After talking with him he indicated he knew what the allegations were and he cited specifically the Social Security allegations and the food stamp allegations. I informed him that I was aware of the allegations and that any investigation would have to run its course and if the allegations had no merit then the issue would be resolved.
He indicated his primary concern was that he believed a City Representative informed him I was not aware of that.
The City Council awarded a 2011-2012 Emergency Shelter Grant in the amount of $10,000 to Dame La Mano. We have not executed the contract pending completion of the investigation, as the allegations, if substantiated, may be violations of Federal and State laws. If it is determined that the investigations have
merit, we would then propose that the awarded funds be reprogrammed. If the allegations are determined
to be unsubstantiated, we would then propose to execute the contract for implementation. 2

Dame La Mano, a provider of homeless shelter services, was issued a court order to vacate its premises at ____________ . During the course of that vacation conflicts occurred with resistance to the City's efforts to help relocate displaced residents, along with allegations that warranted follow up investigation. Those investigations have been on-going in the EPPD for the past . As of today, there are still outstanding investigations that have not been closed. This corrects information provided late last week that EPPD had closed out its review. Only one component ofthe the EPPD review has been closed. Until such time that all investigations are concluded, no public funds will be released from the City of EI Paso to this organization. If the organization is fully cleared, we will immediately release all approved funding. All communications on this matter should be directed to the Director of Community and Human Development as he is communicating with EPPD on all investigations and oversees the contract for this service. The District 8 representative has no oversight of this process and was only involved early on in an effort to assure that the displaced residents had access to alternate housing. The District 8 representative did not initiate any complaints nor order any investigation. Those were directed administratively and by EPPD officials based on allegations made by some of the relocated residents of the facility. We will continue to update as new information is available.

However if he didn't say we HAD to, he strongly suggested we fund them. No one on our committee wanted to give them $$. Bill never mentioned that CD had gotten any pressure from Reyes or HUD. Bill just came up to our table were we meeting, leaned over the table and said "give them $10,000". We re1uctenly voted the $10,000 with the stipulation that we be kept informed of their progress. So far I haven't heard a word from staff concerning their progress. John Martin did say that his collaberative would help Dame La Mano if they were funded. During her presentation the executive director of Dame La Mano said they had applied for 7 years and had never been funded. In MY opinion, the reason was that their application was a disaster. Poorly written, not accurate figures for the budget, case was not stated clearly, etc. It is my understanding now they have a real grant writer so we shall see how their application looks this year. I think the applications are due to staff in December to be graded. If they make a 70 or above by staff the application will move on to the collaberatives and the CDBG steering committee. I don't mean to "stir the pot" but the $21,000 that they got if not used properly should go to the
other organizations in the collaberative who CAN provide services for the homeless.
