COMPLAINT The undersigned complainant under oath accuses TONY PABICO y BACURIN and RENEE ZANTUA y SENDON, of the crime of RECKLESS IMPRUDENCE RESULTING TO SERIOUS PHYSICAL INJURIES, committed as follows: That on the 21st day of December, 2006, at about 10:30 in the evening, at Brgy. Lag-on, Municipality of Daet, Province of Camarines Norte, Philippines, and within the jurisdiction of this Honorable Court, while the herein complainant on board a passenger jeepney with Plate No. EVO-473 registered in the name of Leonida O. Pabico, the above-named accused Tony Pabico y Bacurin, being then the driver of said passenger jeepney, did then and there, willfully, unlawfully, and feloniously, while driving along San Vicente Road, Lag-on, Daet, Camarines Norte, and as he was traversing the intersection at Diversion Road, in a reckless and imprudent manner, without due respect to traffic rules and regulations, crossed the intersection, and while thereat, an ELAVIL Bus with Body No. 3678, being driven by the accused Renee Zantua y Sendon, also in a careless, reckless, and imprudent manner, suddenly bumped and collided with the said passenger jeepney wherein the undersigned complainant is one of the passengers therein, and due to the impact caused by the collision, complainant suffered serious physical injuries with deformity of close fracture of the 6th, 7th, 8th, 9th, and 10th ribs right, which require and have required medical attendance for a period of twenty one days and have incapacitated the undersigned complainant of his customary labor for more than two months, and as a consequence thereof, the undersigned complainant suffered damages by way of moral, medical, and consequential expenses amounting to P50,000.00, to the damage and prejudice.
