Call for Nominations: Local Committee Members for the Kwazulu-Natal Liquor Authority

The Liquor Authority will be established in terms of the KwaZulu-Natal Liquor Licensing Act, 2010 (Act. No. 06 of 2010). The Act sets out the objectives that the Province wishes to achieve with regard to liquor licensing and micro manufacturing. It also extends beyond the process of licensing and aims to balance the imperatives of providing a stable social environment while promoting the growth of the liquor industry. The objectives of the Liquor Authority are to: 1 2 3 4 5 Consider, grant or reject liquor licence applications in the Province; Issue licences in terms of Chapter 6 of the Kwazulu-Natal Liquor Licensing Act of 2010; Enhance accessibility of liquor licences in the Province; Ensure a uniform, fair, equitable and transparent process in the issuing of liquor licences; Work with the responsible Member of the Executive Council, the Department, municipalities and the liquor industry in the Province to implement and promote national and provincial liquor policies and norms and standards; and To implement and promote initiatives which address the objectives of the Act.

The responsible Member of the Executive Council is calling for nominations, as specified in the Kwazulu-Natal Liquor Licensing Act of 2010, for the area of a district or metropolitan municipality in the province to serve as a local committee member for the Kwazulu-Natal Liquor Authority. The following are the district municipality and towns.

Requirements for nomination

- Durban - Pietermaritzburg - Newcastle - Port Shepstone - Ixopo - Vryheid - Mkuze - Dundee - Ladysmith - Stanger - Richards Bay

Each committee consists of eight members, being fit and proper persons, appointed by the responsible Member of the Executive Council. The composition of each of the eleven local committees would consist of the following members:

One person who is in possession of a legal qualification, with a least five years experience in the legal profession or the administration of justice; One person representing an organised commerce body who has knowledge of the liquor industry but has no direct vested interest within the liquor industry, for the area in which the local committee is established; A representative of the municipality within which area the local committee is established, being an employee of the municipality concerned who is experienced in, or in charge of, business licensing or similar function within the municipality; Two representatives appointed from the community in the area of the local committee, appointed by reason of their knowledge in the field of welfare or socio-economic development, social services or health; A member of the Community Policing Forum from the South African Police Services Cluster within the district of the local committee concerned, nominated by the Kwazulu-Natal Provincial Secretary of the Community Policing Forum; A Councillor elected by the district or metropolitan municipality concerned; and A member of the South African Police Services from the South African Police Servicer Cluster within the district of the local committee concerned.

We are seeking these professionals with the relevant expertise to serve these Local Committee for a minimum 3 (three) years term. The Member of the Executive Council shall designate a Chairperson and Deputy Chairperson. The powers and functions of the local committees would consist of: 1 2 Dealing with and considering all applications for licences made; Making recommendations in respect of all applications to the Liquor Authority after considerations of the applications; Advising the Liquor authority or furnish a report or recommendations on any matter referred to it by the Liquor Authority for consideration and arising from the application of the KZN Liquor Licensing Act of 2010; Performing such other functions as my be assigned to it based on the KZN Liquor Licensing Act of 2010; and Attendance of committee meetings.

Criteria for selection All nominees experience and background will be considered to determine a most suitable candidate. A nominee may not be appointed as a member of the local committee if that person: 1 Is not a South African citizen and resident in the Province;

Is an unrehabilitated insolvent; Is subject to an order of a court declaring such person to be mentally ill or disordered; Has at any time been convicted of any offence involving dishonesty provided that a disqualification ends three years after the sentence has been served; Has at any time been removed from an office of trust on account of misconduct; or Has a direct or indirect financial interest in the liquor industry, or whose spouse, life partner or close relative has a direct or indirect financial interest in the liquor industry, where such relationship in the opinion of the responsible Member of the Executive Council constitutes a conflict or potential conflict of interest.

Nomination procedure Your nomination should include the following: Completed Nomination Form. Cover letter (maximum of 3 pages) detailing why you are nominating this person for this position (you can also nominate yourself). The letter should also include the following information, which will be used in considering the nominee for the committee: Expertise and experience relevant to the Liquor Authority mandate and or Liquor Industry; Professional standing or recognition relevant to the Liquor Authority mandate and or Liquor Industry; and Demonstrated experience working in a committee environment.

Nominee's curriculum vitae (maximum of 5 pages). Please ensure that the nominee is advised and is willing to have their name put forward as a potential member of the Local Committee for the KZN Liquor Authority. If you are nominating yourself, include a letter of support from two relevant organisations describing why you should be selected for membership on this committee.

The responsible Member of the Executive Council shall consider all nominations submitted in response to this notice and may appoint a selection panel of no less than four Departmental senior officials to review all nominations and make recommendations on the nominees. The responsible Member of the Executive Council will after considering the nominations and recommendations, if any, appoint the members of the local committees.
