Plaintiffs served Defendant Joseph on December 1, 2012 with a Complaint requiring a response to be filed by December 24, 2012. MEMORANDUM IN SUPPORT OF DEFAULT Federal Rule of Civil Procedure 55(a) provides that when a party against whom a judgment for affirmative relief is sought has failed to plead or otherwise defend as provided by the Rules and the proof of service is made to appear by affidavit or otherwise, the Clerk shall enter the partys default.
