SHOPS & ESTABLISHMENT ACT 1947

This Act is a state legislation to regulate the working and employment conditions oI
workers in the so-called un organized sectors i.e. the shops and establishments including
commercial establishments, which are not covered by Factories. Act or Mines Act or
any other Act regulating the employment conditions. The Act generally provides the
working hours, rest intervals, over time, holidays, leave, termination oI service and
other obligations by the employers and rights by the employees. The Act applies to the
Iollowing type oI establishments.

a) A shop carrying out trade or retail or rendering a service

b) OIIices oI all types oI organizations whether sole proprietor, partnership, private
agency/company, public company etc.,

c) A storeroom, godown, warehouse etc. used in connection with trade and business.

d) Auctioneers, banks, insurance organizations, stock exchanges, share brokers,
commission agents and money changers.

e) Journalist and printing establishments with less than 10 employees.

I) Educational institutions Ior private gains

g) Factories and clerical departments oI Iactory not covered under Iactories Act.

h) Residential Hotels providing meals and accommodation or eating houses, clubs,
canteens, Theatres/ cinema halls and other places oI public amusements.
