This Software License Agreement ("Agreement") is made and effective upon accepta nce by and between Twilight Render Developers("Developer") and the End User("Lic ensee"). Developer has developed and licenses to users its software program marketed unde r the name Twilight Render for Google SketchUp (the "Software"). NOW, THEREFORE, in consideration of the mutual promises set forth herein, Develo per and Licensee agree as follows: 1. License. Developer hereby grants to Licensee a non-exclusive, limited license to use the Software as set forth in this Agreement. 2. Restrictions. Licensee shall not modify, copy, duplicate, reproduce, license or sublicense the Software, or transfer or convey the Software or any right in the Software to an yone else without the prior written consent of Developer; provided that Licensee may make one copy of the Software for backup or archival purposes. 3. Fee. Licensee agrees to payment of the license fee prior to delivery of the Software. 4. Warranty of Title. Developer hereby represents and warrants to Licensee that Developer is the owner of the Software or otherwise has the right to grant to Licensee the rights set forth in this Agreement. 5. Limitation of Liability. Developer shall not be responsible for, and shall not pay, any amount of inciden tal, consequential or other indirect damages, whether based on lost revenue or o therwise, regardless of whether Developer was advised of the possibility of such losses in advance. In no event shall Developer's liability hereunder exceed the amount of license fees paid by Licensee, regardless of whether Licensee's claim is based on contract, tort, strict liability, product liability or otherwise. 6. Evaluation Period The Licensee may operate the Software in it's Evaluation, or Demo, mode for any period of time. While operating in the Evaluation, or Demo, mode, the Licensee agrees to make no attempt to remove the Watermarks imposed upon the rendered ima ges, nor make any attempt to circumvent the Evaluation restrictions placed on th e software. 7. Modifications No individual or entity, except the Developer, is permitted to make any modifica tions of any kind to the Software. Any individual or entity who makes, or attem pts to make, such modifications will be subject to prosecution to the fullest ex tent of the law, governed by the laws of the Developer's country of residence, t he United States of America. 8. Distribution No individual or entity, except the Developer, is permitted to distribute the So ftware in any form. Any individual or entity who distributes, or attempts to di stribute, the Software, any part of the Software, or any modification of the Sof tware or its parts, will be subject to prosecution to the fullest extent of the law, governed by the laws of the Developer's country of residence, the United St ates of America. There is no warranty for the Software. Software is provided "as is" without any warranty of any kind, either expressed or implied. All risk for the quality an d performance of the program is assumed by the Licensee. In no event will Licen see, or any other party, hold the Developers liable for damages, including any g eneral, special, incidental or consequential damages arising from the use of, or inability to use, the Software, including but not limited to loss or corruption

of data, even if Developer has been advised of the possibility of such damage. Developers are in no way associated with Google, Google Sketchup, or Kerkythea. Developers make no implications of relationship with aforementioned entities. Google Sketchup is a registered trademark of Google.
