Sovereignty [sov-rin-tee], n. Status or authority, supreme and independent power of a government over a territory; inherent characteristic of a state The Philippines is a not sovereign stateat least, as various internal and external forces threaten to crumble the established state and its machineries. As the saga begins anew in this historical juncture, the Philippines sovereignty is challenged at two frontsthe prospects of development and peace in its South, and a brewing tempest fueled by foreign powers in its West. In such instances, asserting the countrys sovereignty becomes the logical response. Yet, the Philippine governments track record of maintaining the countrys sovereignty speaks of failurea state that is willing to trade its peoples welfare for mutual foreign support. Indeed, the struggle for dominance and political power continues, as gross inequality, poverty, and social injustice especially in the country sides, prevail with impunity. Until such time that the government begins to stand for its peoples social and economic interests, a sovereign Filipino nation is merely a grand, unrealized dream. To assert sovereignty after all, means pursuing radical and pervasive development, and breaking free from shackles that have long trapped the country to poverty and underdevelopment.

In The face of uncerTaInTy, there is no room for leniency. The filipino people have scored an initial victory against the assailed republic act 10175 or the cybercrime Prevention act of 2012 (cPa) last october, when the Supreme court (Sc) issued a temporary restraining order (Tro) against the law after much public clamor both online and offline. and as the Sc commenced the oral arguments for the 15 petitions filed against the cPa last week, various sectors of society have once again formed a united front and showed their disgust for the piece of legislation now popularly nicknamed as the aquino regimes e-Martial Law. and the people were wise to do so, for uncertainty clouds the future of free speech and other civil rights while the said law exists. for while the said law operates under the guise of

promoting the responsible exercise of constitutional rights, it only serves to frustrate any attempts to assert even the most basic of civil liberties. By institutionalizing alarmingly vague provisions that expanded the ambits of libel, the cPa becomes a potential tool for the authorities to silence dissent and regulate cyberspace. under this law, any one can be tagged as a criminal. under this law, the government becomes a leviathan invested with new powers to control the exchange of ideas and to police online activities. for instance, the cPa empowers the Department of Justice to block or take down any online content which they deem as libelouseven without a warrant of arrest. Thus, it is not without lack of reason when we assert, both in court in the streets, that cPa deserves only utter defeat. for the fate of our democratic

freedom hangs in the balance as long as the said law remains a threat. all hope of amending the cPa through legislature has been lost as far as the 15th congress is concerned. amendatory bills crafted to correct the mistakes of the legislature have perished in the halls of congress, with both houses set to adjourn in a few days without even moving an inch to rectify their erstwhile blunder of passing a gravely unconstitutional law. all eyes are now turned to the high tribunal, which now has the sole power to strike down the repressive law. however, should the Sc fail in its duty to junk the cPa once and for all, we can only anticipate the worst: the fate of our basic civil rights will remain at the mercy of those in power, our mere Likes and retweets will be enough grounds to incriminate us, while the government can

monitor even our facebook and Twitter posts, e-mail, and chat messages. our momentous, though temporary, victory last october is a testament to the potency of the filipino peoples collective action against the maneuverings of the government. Thus, we must continue our collective action in repealing cPa, not only through protests online but also in the real world where warm bodies flood the streets and call for protest against the implementation of the repressive law. While the fate of the cPa remains in legal limbo, there must be no other ultimate goal but the utter defeat of the said law. until then, there is no other course of action but to hold our ranks, remain vigilant during this crucial period in our fight, and strike towards decisive victory.

UP loses P380 million in tax breaks and interest income, COA reveals
THE UNIVERSITY COULD HAVE saved P179 million in tax exemptions and earned P201 million in interest income if it was able to exercise fiscal and institutional autonomy as the national university, the Commission on Audit (COA) reported in its recently released 2011 Annual Audit Report. As the national university,, UP is exempted to pay taxes on all assets and revenue used for educational purposes, according to Section 25 of Republic Act 9500 or the 2008 UP Charter. The absence of a body of implementing rules and regulations (IRR) however is needed to operationalize the general objectives of the said law. As early as June 2008, the university has consistently requested the BIR to issue specific regulations which would allow the university to enjoy its tax benefits, but the said agency has so far failed to issue such rules. As a result, the administration still had to pay P179 million in taxes for goods and services used for educational purposes in 2011. The continued absence of an IRR for the UP Charter has revealed not only the governments reluctance to allow tax breaks for UP but also underscored the governments general policy of abandonment of its financial obligation to its own institutions like UP, said Student Regent (SR) Cleve Arguelles.

AUDIT OVERVIEW: Other important findings in the 2011 COA Annual Audit Report
1. Unreported earnings of the University Hotel

The UP administrations 2011 financial statement did not include the University Hotels (UH) assets of P34.1 million and net income of P3.28 million, echoing the insistence of past administrations that the UH is a separate and distinct entity from UP. COA however maintained that, as a property donated to UP in 1983, the UH operates under the name and authority of UP and is thus not registered or licensed with any government regulatory agencies.

Missed opportunity
UP could have earned an additional P201 million on its own in 2011 if it invested its corporate funds in private universal banks (PUBs), or banks which participate in both commercial and investment activities, said COA. Currently, UPs corporate funds are invested in government banks, such the Development Bank of the Philippines. The UP administration failed to conduct a study on alternative interest rates offered by PUBs, which may yield higher revenue for the university, COA said. The audit agency also cited Section 24 of the UP Charter, which says that UP may form an independent trust committee

(ITC) which shall recommend five PUBs that will manage UPs corporate and other funds through trust agreements. The said ITC will be composed of the UP President as chair and one representative each from the Bankers Association of the Philippines (BAP), the Investment Houses of Association of the Philippines, the Trust Officers Association of the Philippines, and the Financial Executive Institute of the Philippines. In the absence of an ITC [which would direct] appropriate investment objectives, UP was not able to maximize its interest earnings from investments, COA said. As of press time, the creation of the said ITC is already underway, with the administration now only waiting for the BAP to nominate their representative to the committee, pending the approval of the BOR, the universitys highest decisionmaking body, said UP President Alfredo Pascual. Arguelles however cautioned against UPs investment ventures, saying funds should instead be channelled to meet the needs of the university rather than being invested to generate income.

Delayed procurement of equipment


Meanwhile, COA also disclosed that the purchase and release of high-end scientific equipment for UP had been delayed, based on reports from the universitys researchers. Under Republic Act 9184 or Government Procurement Act, UP had to undergo an estimated 5-month public bidding process for local suppliers even if the needed equipment can only be supplied by foreign manufacturers. UP may coordinate with the Government Procurement Policy Board of the Department of Budget and Management to fast-track the procedural requirements UP had to go through when importing equipment abroad, COA recommended. These predicaments, if not properly addressed, hamper the researchers conduct of timely research and discourage them from pursuing more complicated

and bigger research projects, added the audit agency. To facilitate the procurement of equipment in the future, the UP administration is currently working on forming joint memorandums of agreements between UP and government regulatory agencies, such as the Bureau of Customs and Bureau of Treasury, said Pascual. Meanwhile, the administration has also formed a Technical Working Group for Special Legal Concerns, spearheaded by the Dean of the College of Law, to formulate an IRR for the UP Charter, Pascual added. While UP must practice fiscal prudence in the management of its finances, the national university however must also defend its identity as a government-funded institution, Arguelles said. UP students should be concerned more on preserving and defending the public character of UP instead of tax breaks [or corporate investment], he added.

The universitys financial statement is also short of P103.19 million in property, plant, and equipment (PPE), P106.79 in income from grants and donations, and P3.6 million in expenses, COA revealed. Unreported assets in UPs 2011 inventory include the P100million GT-Toyota Building, where the Asian Center Library is located. The audit agency cited unreported items were due to the inadequacy of donation guidelines and the non-adherence of the heads of units or colleges to existing rules. The UP system administration said the UP Diliman administration will take the initiative on the preparations of the said guidelines.

3. Unverified income from TechnoHub lease

The COA was also unable to verify the accuracy of the reported P169-million income of UP from the lease of the UP-Ayala TechnoHub property. The UP administration failed to provide supporting documents, such as a breakdown of all spaces sub-leased by Ayala to other companies and the corresponding rental amounts, COA explained. The audit agency also reiterated issues which remain unresolved, such as the implications of Section 2.5.c of the 2006 contract with Ayala. The said provision authorizes ALI to sublease the land, the buildings or improvements or parts of the office component to persons not engaged in science and technology industries. With this clause in the contract, the project may eventually be commercialized in order to ensure the income of [Ayala], COA said. The said contract however was inked between Ayala and the previous administration under former UP President Emerlinda Roman, which limits the current administrations role to ensuring that Ayala adheres to the conditions laid down in the contract, Pascual said. Pascual also maintained that though TechnoHub is now host to a number of commercial companies not directly engaged in research and development, the revenue collected from the rentals are still used for educational purposes.

Gabriela pushes for revised law on violence against women

REPRESENTATIVES OF WOMENS party-list group Gabriela are pushing for amendments to Republic Act (RA) 9262 or the Anti-Violence Against Women and Children Act (VAWC) as an alternative to the AntiCybercrime Laws provisions on cyber violence against women. In 2009, Congress passed RA 9995, or the Anti-Photo and Video Voyeurism Act, but the said law only covers acts of capturing or broadcasting of images or videos of sexual acts or private parts without the consent of those involved and does not mention other forms of online violence. If passed, HB 6815 will include EVAW as a criminal offense which encompasses all acts that use ICT which cause or are likely to cause mental, emotional, or psychological distress to the victim. HB 6815 will also cover other acts of online violence such as uploading images or videos of sexual acts and private parts without consent, using a victims name or picture on a program or application depicted in a bad light, and harassment, threatening, or stalking through ICT. Perpetrators of EVAW will also be fined up to P500,000 and imprisoned for up to six years. Law enforcement agencies will also be required to immediately remove any uploaded or broadcasted EVAW content.

Although the Cybercrime Law has provisions for sexual content, it penalizes those in the video and not those who uploaded the content, said Gabriela Internal Deputy Secretary General Gertrudes Libang. Sinasabi na one of the merits of the Cybercrime Law is its provisions on E-VAW when in fact it does not uphold the rights of women [and children], said Libang. The Cybercrime Law tackles EVAW in Section 4c1, under Cybersex, defined as willful engagement, maintenance, control, or operation of any lascivious exhibition of sexual organs or sexual activity, with the aid of a computer system. This implies that those seen in sex videos will be penalized, whether or not the video was uploaded with consent, Libang. Lumalabas na dalawang beses nadedehado ang babae. Necessary amendments
Enacted in 2004, the current VAWC offers protection to women and children who have been victims of physical, psychological, and financial abuse but does not explicitly cover those who are abused through electronic means.

The UPDP immediately dispatched a mobile unit after an unnamed security guard near the site reported the mishap. The victim was identified as Maria Luzvimin and the errant driver as Juan Alfonso Maria, a third year student from the College of Engineering. UPDP Field Investigator Romy Rangos has been assigned to investigate the case. 2 PM, when a group of three men suddenly opened the car doors. One of the men forced Verzano to yield his wallet, with contained IDs and P7,750 in cash. The three attempted to flee the crime scene but were immediately apprehended by guards stationed nearby. The UPDP identified the thieves John Michael Bermudez, Marlo Bello, and Ronnie Velasquez, who are all residents of Barangay UP Campus. The stolen wallet and its contents were recovered and returned to Verzano, who decided not to press charges against the three. stolen a mobile phone and a wallet from a third year student at the College of Human Kinetics on January 16 at around 6 PM. The victim, identified as Anna Buenafe, said the thief probably stole the said items while she was on her way to Palma Hall aboard a Katipunan jeep. The UPDP reiterated its reminder to students to be careful with their personal belongings while in public places and to immediately report any incidences of theft.

POET-ACTIVIST AND POLITICAL detainee Ericson Acosta is undergoing treatment for serious kidney problems at the National Kidney and Transplant Institute (NKTI) in Quezon City after being granted medical reprieve by the Gandara Regional Trial Court in Samar. The former Collegian literary editor is staying indefinitely at the NKTI for further tests after a preliminary diagnosis revealed he is suffering from nephritis, or the swelling of the kidney, a condition characterized by hematuria, or the presence of blood in urine, lower back pains, and high fever. Around 10 fully armed Bureau of Jail Management and Penology (BJMP) personnel have taken over as Acostas new security detail on January 21, and imposed stricter rules for visitors such as a ban on the use of mobile phones. Col. Joseph Vela of the BJMP however revoked his initial order to handcuff Acosta to his hospital bed, after Acostas supporters condemned the said order as overkill. Acosta first requested the court to allow him to seek medical treatment in July 2012, but the fiscal prosecutor required him to present a medical certificate of his condition before the court could reach a decision. His family, however, had been unable to find a doctor who would be willing to visit Acosta, until Public Attorneys Office (PAO) Chief Persida Rueda-Acosta flew in from Manila with medico-legal consultant Dr. Erwin Erfe who issued the necessary certificate. Other doctors were afraid of threats of harassment from the squad of infantry soldiers deployed at the Calbayog Sub-Provincial Jail where Acosta had been detained for two years, he said in an interview with the Collegian. Arrested by the military while doing research work for a local peasant group in 2011, Acosta was accused of illegal possession of explosives and of membership in the New Peoples Army. The poetactivist has maintained he only had a laptop and other personal belongings at the time. Despite a petition for review filed in September 2011, the court has yet to set a date for the first hearing of the charges against Acosta. Acosta also condemned the conditions at the prison where he had been detained, saying more than a dozen men share a single cell and that some prisoners had to sleep on the floor. Our lone source of ventilation is an air hole rather than a window, he added. My experience is definitely a validation of theories of abuse and of violation by the state. It proves that state repression and fascism does exist, said Acosta. According to reports from human rights group Karapatan, there are 401 political prisoners in the country, 123 of whom were detained under the Aquino administration. In December 2012 alone, over 28 individuals were arrested, including union leaders and human rights workers. This is the direct result of a government that criminalizes political opposition and arbitrarily tags [those who do oppose] as enemies of the state, said BAYAN secretarygeneral Renato Reyes Jr.
