The PCO, after receipt of Legal & Other Requirements and/or its amendments shall identify whether the law is applicable to the organization or not. If determined to be applicable, it shall be registered Registry of Legal and Other Requirements. Otherwise, a copy of the law shall be endorsed by the PCO to the EMR for future reference.

The Legal & Other Requirement is subscribed by the organization. The Legal & Other Requirement states that there may be periodic inspections to the
organizations premises by local or national authorities agencies. The Legal & Other Requirement requires reports or permits to be submitted to local or national authorities / agencies. The Legal & Other Requirement has general provisions that need to be observed / complied by the organization or its subcontractors. 5.3.1

All applicable Legal & Other Requirement shall be registered in the Registry of Legal and Other Requirements by the PCO. Registration shall include the assigning / listing of reference number, legislation number, title of law, source of law, short summary, applicability to the organization operations and permit or test required (if applicable).

5.3.2 5.3.3

Document Controller shall then issue a copy of all applicable legal & other requirements to the PCO through the Document Control procedure. The EMR shall be responsible in the maintenance, updating and reviewing the Registry of Legal and Other Requirements.

5.4.2

If the PCO identified the need for support of other departments in order to achieve compliance, he/ shall communicate to the concerned department personnel their duties and responsibilities to comply with the concerned legal & other requirement through Environmental Meetings. 5.4.3 The key characteristics on how environmental tests are to be conducted or reports to be submitted shall be specified in the Legal and Other Requirements Environmental Management Program.

5.5

Compliance with Applicable Legal & Other Requirement

5.5.1

The PCO shall be responsible in the maintenance, updating, monitoring and reviewing the Registry of Required Reports and Permits. 5.5.2 The PCO is responsible for complying with legal and other requirements such as but not limited to, submission of relevant reports, application and renewal of permits and certificates to regulatory agencies and other interested parties unless otherwise specified in the legal & other requirement.

5.5.3

If a concerned legal & other requirement requires environmental compliance tests to be conducted where the organization is not capable of, the PCO shall require the assistance of external environmental testing centers or laboratories to conduct such tests.

5.5.4

If compliance to applicable legal & other requirement requires specific processes to have operational controls, such operational controls shall be specified in the concerned Environmental Management Program, procedures or process instructions by the EMR.

5.5.5

All applicable legal & other requirement, especially those with required reports and permits shall be considered in the determination of the significance of the environmental aspects and impacts.

5.5.6 Updates to compliance to applicable legal and other requirements like submission of reports & acquisition of permits, etc shall be reported and discussed on a quarterly basis during the Environmental Meeting. 5.6 Evaluation of Compliance to Legal and Other Requirements

5.6.1

The compliance of the organization to legal and other requirements shall be evaluated through the regular internal audit.

The EMS Committee shall evaluate the organizations compliance to legal and other requirements on a quarterly basis through the Environmental Meeting. The evaluation and status of organizations compliance to applicable Legal and Other Requirements shall be reported by the PCO during the Management Review. 5.6.4 Measurement of Environmental Objectives and Targets pertaining to compliance to legal and other requirements shall be specified in the Legal and Other Requirements Environmental Management Program.

5.7

Checking for new and amended Legal and Other Requirements

5.7.1

The EMS Committee shall be responsible in checking and monitoring for new legal & other requirement or any amendments to existing ones on a continuous basis either by regular communication with government agencies or by browsing their websites. 6.0 RECORDS

The EMR shall be responsible for filing and maintenance of the Registry of Legal and Other Requirements.
