October 7, 2011 at approximately 4:20 p.m. 1. I Andre Murray, maintaining the Peace, was traveling by my mechanical conveyance on October 7, 2011 at approximately 4:20 p.m. near the curb travelling East on the right side of the Street known as Aberdeen Street, in the area known as the City of Fredericton, further in the area known as the Province of New Brunswick. 2. I heard the squealing sound of a vehicle turning the corner quickly onto Aberdeen Street and for my own safety I pulled off the roadway of Aberdeen Street, onto the sidewalk, so as to remove myself from possible danger. 3. From behind me and to my left a Black and White Marked Police car with its window rolled down pulled up beside me. 4. 5. 6. 7. I heard a voice which said stop. I kept traveling. 8. The marked Police Car quickly pulled across the side walk and stopped in front of me, blocking my path of travel. I turned left behind the back truck area of the car and continued on my way.

9. A man now identified as Constable David Beck, jumped out of the Marked Police Cruiser drivers seat and ran towards me, football style tackling me off my conveyance. We landed on the other side of the Road, between the curb and the sidewalk. Constable Comuzzi then jumped on me as well. I was arrested, hand cuffed and searched. 10. I immediately declared to all present that I do not consent and I waive all the benefits. I attempted to inform Constable David Beck and Constable Comuzzi regarding the correct application of Statutes and City By-laws, but they intended to remain in ignorance, until informed otherwise the Courts. 11. I was provided a copy of a 50 Fine pursuant to The City of Fredericton By-law T-4, Section 15 for Riding Bicycle on the sidewalk, number: 219324.
