STUDENT SENATE BILL 2013-1002 TITLE: 700 Codes Fairness and Transparency Act AUTHOR: Senator Morgan Vollrath

SPONSORS: Senator Matt Pesek, Senator Daniella Saetta REPLACES Chapter 700 of the Student Body Statutes with the following
715.4 The Supervisor of Elections contingency plan must be approved by a 2/3 majority of the Senate. 728.0 If a candidate slated with a political party or an individual with a position or affiliation with a political party is found in violation of any portion of the Student Government Election Code, it will be within the reasonable discretion of the Elections Commission to determine whether the candidate acted on his or her own or with the consent of his or her political party. Determination of the consent of the political party must be made beyond a reasonable doubt. 728.01 The Election Commission has the authority to determine the party affiliation of any individual during the election cycle. 744.1 A political party may not be held liable for the actions of individuals or organizations supporting it unless there is evidence beyond a reasonable doubt that a political party actively solicited an individual or organization to specifically violate any provision of the Student Government Election Code in support of a candidate or party. If a complainant can demonstrate by clear and convincing evidence that the candidate or political party solicited the individual, or organization to violate any provision of the Student Government Election Code in support of a candidate, the Elections Commission may hold the candidate or political party responsible. If the Elections Commission determines by preponderance of the evidence that an individual or organization deliberately violated this chapter in an attempt to penalize a candidate, the Elections Commission may refer the individual or organization to the Supreme Court for prosecution, or, if the Supreme Court cannot accept jurisdiction for any reason, the Elections Commission may refer the individual or organization to Student Judicial Affairs for prosecution. 761.1 Campaign Activities begin on the first day of the active election cycle and ends immediately after the close of polls on the final day of elections. 761.2 Campaigning begins one week before the first day of elections, and ends immediately after the close of polls on the final day of elections. 761.3 The maintenance of a campaign website shall be permitted four weeks prior to the first date of fall and spring election and shall conclude at the end of both the fall and spring election.
