The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s): Count 1 Burglary-2nd Degree-Dwelling - Attempted In Violation Of: 609.582 subd. 2(a)(1); 609.582 subd. 2(a) Penalty: 10 years imprisonment and $20,000 fine On or about February 2, 2013, within the County of Mille Lacs, the defendant did unlawfully and wrongfully attempt to enter a building without consent and with intent to commit a crime, or enter a building without consent and committed a crime while in the building, either directly or as an accomplice and the building is a dwelling.

STATEMENT OF PROBABLE CAUSE The Complainant states that the following facts establish probable cause: On or about February 2, 2013, within the County of Mille Lacs, Sergeant Richard Dukowitz and Deputy Bret Erickson of the Mille Lacs County Sheriff's Office responded to a reported burglary at 8792 Eyota Way in Onamia, MN. Upon arrival at the residence, Deputy Erickson spoke with the reporting party, Eric Jenson, who is responsible for resort security in the area. Jenson reported to Deputy Erickson that he was driving by 8792 Eyota Way when he noticed a security light come on. He then observed two males at the home and then saw a vehicle parked on the road next to the driveway. He observed two females in the car, one driving and the other in the passenger seat. Deputy Erickson then located the vehicle with MN licence plate 409HHA in the ditch. The driver was identified as R.L.R. (9-25-1995) and the passenger was T.R.E. (4-28-1995). Deputy Erickson also approached the house. He observed a glass door at the front entrance with the outside pane of glass broken. He observed the second pane of glass to be in tact. Deputy Erickson also observed a large rock with scuff marks lying on the deck on front of the broken glass. Two sets of tennis shoe foot prints were also observed and photographs were taken of the footprints and the damaged door. Deputies also observed tracks that led out on to the lake. Two males were soon apprehended out on the lake by North Central Drug Task Force Agents Ryan Sullivan and Pat Broberg. Deputy Erickson and Sergeant Dukowitz interviewed one of the males, identified as, MORGAN CLARENCE GRAMS, (5-27-1978) who stated he was traveling from the Twin Cities area with the juveniles who were traveling to one of the girl's grandmother's house. Grams reported they were lost and needed directions and that approached the residence to "take a piss". Grams claimed the girls drove away from the residence because they were scared. Grams stated he did not know who damaged the door window and that he ran when he heard the window break. Deputy Erickson and Sergeant Dukowitz also interviewed R.L.R. who agreed to speak with them after being read a Miranda warning. R.L.R. stated she was driving the vehicle and that they were all at the residence because they were lost while attempting to find T.R.E.'s grandmother's home. R.L.R. also claimed she initially left the residence because she was afraid. Deputies also took a Mirandized statement from T.R.E. who initially stated that they were in the area to visit her grandma but then admitted that they had come to the area to break into a house. Deputy Erickson took a Mirandized statement from D.R.E., DOB: 7/21/96, the second male apprehended on the lake. D.R.E. stated that they had "messed up". D.R.E. stated that their

intent was to "rob" the house and that GRAMS had broken the window. D.R.E. stated that when their vehicle left, they got scared and ran.

Complainant requests that Defendant, subject to bail or conditions of release, be: (1) arrested or that other lawful steps be taken to obtain Defendant's appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
