Sir/Madam,
1. I have the honour to inform you that the Air Navigation Commission, at the eighth
meeting of its 185th Session held on 9 December 2010, considered a proposal for the amendments of
Annex 2 Rules of the Air and Annex 11 Air Traffic Services. The Annex 2 amendment addresses
speed variations from current flight plan and the Annex 11 amendment is consequential to reduced
vertical separation minimum (RVSM) monitoring requirements in Annex 6 Operation of Aircraft. As a
result, the Commission authorized its transmittal to Contracting States and appropriate international
organizations for comments.
2. The proposed amendments, as modified by the discussions of the Commission, are
contained in Attachment A to this letter.
3. The purpose of the proposed amendment to Annex 2, contained in paragraph 3.6.2.2 c), is
to reduce the length of time an estimate may vary by before a pilot is required to report such a change.
The reason for the change is to adjust for the increasingly accurate navigation systems and use of reduced
longitudinal separation minima.
4. The proposed amendment to Annex 11 is consequential to new Annex 6 provisions
incorporated in Amendment 34 to Part I International Commercial Air Transport Aeroplanes and
Amendment 29 to Part II International General Aviation Aeroplanes, paragraphs 7.2.7 and 2.5.2.7,
respectively. These RVSM monitoring requirements reflect advancements in RVSM-height monitoring
technology and allow the monitoring data to be used for aircraft group performance analysis.
5. In examining the proposed amendment, you should not feel obliged to comment on
editorial aspects as such matters will be addressed by the Air Navigation Commission during its final
review of the draft amendment.

6. May I request that any comments you may wish to make on the proposed amendment be
dispatched to reach me not later than 13 May 2011. The Air Navigation Commission has asked me to
specifically indicate that comments received after the due date may not be considered by the Commission
and the Council. In this connection, should you anticipate a delay in the receipt of your reply, please let
me know in advance of the due date.
7. For your information, the proposed amendments to Annexes 2 and 11 are envisaged for
applicability on 15 November 2012. Any comments you may have thereon would be appreciated.
8. The subsequent work of the Air Navigation Commission and the Council would be
greatly facilitated by specific statements on the acceptability or otherwise of the proposals. Please note
that for the review of your comments by the Air Navigation Commission and the Council, replies are
normally classiIied as 'agreement with or without comments, 'disagreement with or without comments
or 'no indication oI position. II in your reply the expressions 'no objections or 'no comments are
used, they will be taken to mean 'agreement without comment and 'no indication oI position,
respectively. In order to facilitate proper classification of your response, a form has been included in
Attachment C which may be completed and returned together with your comments, if any, on the
proposal in Attachments A and B.

3.6.2.2 Inadvertent changes. In the event that a controlled flight inadvertently deviates from its
current flight plan, the following action shall be taken:

a) Deviation from track: if the aircraft is off track, action shall be taken forthwith to adjust the
heading of the aircraft to regain track as soon as practicable.

b) Variation in true airspeed: if the average true airspeed at cruising level between reporting
points varies or is expected to vary by plus or minus 5 per cent of the true airspeed, from that
given in the flight plan, the appropriate air traffic services unit shall be so informed.

c) Change in time estimate: if the time estimate for the next applicable reporting point, flight
information region boundary or destination aerodrome, whichever comes first, is found to be
in error in excess of 32 minutes from that notified to air traffic services, or such other period
of time as is prescribed by the appropriate ATS authority or on the basis of air navigation
regional agreements, a revised estimated time shall be notified as soon as possible to the
appropriate air traffic services unit.

3.3 Operation of air traffic control service

3.3.5.1 For all airspace where a reduced vertical separation minimum of 300 m (1 000 ft) is
applied between FL 290 and FL 410 inclusive, a programme shall be instituted, on a regional basis, for
monitoring the height-keeping performance of aircraft operating at these levels, in order to ensure that the
implementation and continued application of this vertical separation minimum meets the safety
objectives. The coverage of the height-monitoring facilities provided under this programme shall be
adequate to permit monitoring of the relevant aircraft types of all operators that operate in RVSM
airspaceThe scope of regional monitoring programmes shall be adequate to conduct analyses of aircraft
group performance and evaluate the stability of altimetry system error.

Note. The number of separate monitoring programmes should be restricted to the minimum
necessary to effectively provide the required services for the region.

3.3.5.2 Arrangements shall be put in place, through inter-regional agreement, for the sharing
between regions of data from monitoring programmes.
