Agreement to Sell This Agreement to sell is executed on this day of January, 2013 by Sri. , aged years, s/o Sri.

residing at herein after referred to as SELLER which term shall mean and include his heirs, executors, administrators and assignees of one part. In favour of 1) aged years, s/o , residing at hereinafter called the PURCHASERS which term shall mean and include their heirs, executors, administrators and assignees on the other part. Whereas the seller had been gifted by his father vide gift Settlement Deed dated registered as Document No: of Book , measuring an extent of Sq. yards or sq. mts. of vacant site of which undivided unspecified share of total extent of sq. yds., covered by plot no , S. No. , of village, from Sri under a registered sale deed dated registered as document no. of Book volume no. pages , in the Office of Registrar, and ever since the Seller has been in uninterrupted possession of the same enjoying it as absolute owner. Whereas the seller intends to sell away the above said property more fully described in the schedule hereto annexed to invest the sale proceeds elsewhere and whereas the Purchasers offered to purchase it for a sum of Rs. ( Rupees only ), which offer the seller has accepted as the said offer is fair and reasonable and reflecting the true and correct market values prevailing in the locality and has agreed to sell the same to the Purchasers on the terms and conditions agreed between both parties mentioned hereunder: NOW THISAGREEMENT TO SELL WITNESSES AS FOLLOWS: 1. The purchasers have paid a sum of ( Rupees only ) to the Vendor by way of cheque, bearing Cheque No. dated from , Branch, as an advance, the receipt of which the seller hereby acknowledges. 2.The Purchasers shall pay the balance amount of Rs. ( Rupees Lakhs only) to the seller at the time of registration of the Sale Deed/ Sale Deeds by availing housing loan from any bank or any financial institutions or any other organizations within . 3. The Seller shall deliver the vacant possession of the schedule mentioned property at the time of registration of the Sale Deed. 4. The Seller shall register the sale deed in favour of the Purchasers or their nominees. 5. The Stamp Duty and Registration fee shall be borne by the Purchasers or their nominees at the time of Registration of the Sale Deed / Sale Deeds.

6. The Seller hereby assures the Purchasers that the property described in the schedule hereto annexed which is hereby agreed to be sold to the Purchasers under this agreement is free from all encumbrances and further assures the Purchasers that he will pay the taxes of all kind on the schedule mentioned property up to the date of registration of said property. 7. The Seller hereby assures the Purchasers that he has un-impeachable title to the said property and the said property Is free from all encumbrances claims, charges, attachments or gifts whatsoever in any manner. 8. The Seller shall produce a certificate of Encumbrance on the schedule mentioned property to facilitate registration of the sale deed. 9. That the Vendor assures the Vendees to handover the vacant possession of the schedule mentioned property at the time of registration of the sale deed.
