Mother grieves over death of hardworking son in landslide


ORMOC CITY- Teresita de la Austria said that she was still in a daze when she recovered the body of her son, Etchield, not only dead but also headless. The 58-year old grieving mother was able to identify her son through the underwear she brought for him at the morgue of the Kananga Hospital, which is 23 kms away from this city. Etchield, 31, was one of the five workers of the EDC (Energy Development Corp.) who were buried alive in a landslide incident coupled with the bursting of a steam pipe reason why the victims suffered some burns when they were retrieved from the mounds of debris. The steam pipe was hit by the falling debris from the mountain reason why it ruptured. I was in total shock when I saw the body of my son without his head. I could not believe that this happen to him, Teresita said, sobbing. She saw her sons lifeless body at around 4 p.m. or seven to page 9

MANILA -- Twelve followers of a Filipino clan occupying a village in Sabah, Malaysia and two police commandos were killed in a 30-minute shootout on Friday, Malaysian authorities reported. Sabah Police Chief Hamza Taib said three Malaysian policemen were also injured in the incident, which ensued when members of the Kiram clan from Sulu, Philippines opened fire. He said the standoff was ongoing, contrary to earlier pronouncements by Philippine authorities that it was over. The followers of Sulu Sultan Jamalul Kiram III landed in the coastal village of Lahad Datu in Sabah state on February 9 to claim the territory as their own, citing ownership documents from the late 1800s.

The Malaysian authorities, particularly the Malaysian police, are now pursuing the group The ambassador said that the standoff is now over, said Hernandez. But Hamza said no one had surrendered. He said clan members remained holed up in the village and that the security operation was ongoing. We will assess the situation again. We want them to surrender peacefully. Sounds of shots were heard in the background while he was being interviewed by phone. On Tuesday, Aquino urged Sultan Jamalul to order his followers to return home and called their action a foolhardy act that was bound to fail.

The standoff elevated the Sabah territorial issue, which has been a thorn in Philippine-Malaysian relations for decades, to a Philippine national security concern. The crisis erupted at a crucial stage of peace negotiations brokered by Malaysia between the Philippine Government and the Moro Islamic Liberation Front, the largest Muslim rebel group in the southern Philippines. Aquino has said the standoff may have been an attempt to undermine his government on the part of those opposing the peace deal, including politicians and warlords who fear being left out in any power sharing arrangements.

US hands off in Sabah crisis


TACLOBAN CITYAmerican Ambassador to the Philippines Harry Thomas, Jr. on Saturday categorically said the US government will not meddle in the Sabah standoff which has already claimed the lives of 14 people. Were not involved in that, came Thomas brief reply in a press conference. Well that is something between Malaysia and Philippine governments. I hope they can have a peaceful solution on this. The ambassador however expressed his sympathy to the families who have lost their loved ones due to the territorial dispute in the area. We give our heartfelt condolences to the families over that incident, Thomas said. Meanwhile the US ambassador maintained they are ready to compensate on the damages at the Tubbataha Reef where the USS Guardian ran aground in midJanuary. Ambassador Thomas was in the city for the launching of their America in 3 D road show featuring Diplomacy, Development, and Defense of the American government, also to deepen the ties between the US and the country. Tanauan mayoralty bets call for professional campaigning


TACLOBAN CITY It will be now his lookout. This was the reaction of Tanauan, Leyte mayoralty candidate Pelagio Pel Tecson over the issue of numbers game operation in their town which according to report the Department of the Interior and Local Government had already issued a memorandum order, banning or stopping all operation of jai alai outside PEZA operation in Cagayan. Reports claimed that jai alai operation in some towns had become the source of illegal gambling operations like swertres, allegedly under the protection of some local officials. The municipal mayor added that the issue over the numbers game operation in the town of Tanauan is used for political assassination against him by his opponent in politics. The operation of numbers game in Tanauan is legal so why should I stop it and besides it is not only in the town of Tanauan where there is an operation of numbers games but in other provinces in the country as well, Pagayanan stressed. He added that with the signing of peace covenant he is hoping that all propaganda against him will now stop and concentrate on professional campaigning. Pecson, on his part, also called for a more civilized and professional way of campaigning this election. We had pledge to put our campaigning into high level, but what is more important is we are able to articulate to our voters the real situation of our place, the truth about our present situation which sometimes really hurts, Pecson stressed.

PRO8 collars 2 in drug bust


CAMP KANGLEON, Palo, Leyte Two men were arrested by the police in separate antiillegal drugs operations in Leyte and Samar recently. We will continue to pursue local drug peddlers to minimize, if not stop, the proliferation of illegal drugs in our communities, said Police Chief Superintendent Elmer Ragadio Soria, Regional Director of Police Regional Office 8 (PRO8). The top police official informed that the first operation led to the arrest of Abel Abella y Parilla, 38, married, jobless, in Brgy. Guiwean, Palompon, Leyte past 4 p.m. last Tuesday after selling a pack of suspected shabu to a poseur-buyer. Seized from Abella was one small sachet of suspected shabu and the P500 buy-bust money by a police team led by Police Chief Inspector Hipolito Delima. Fifteen minutes later in Calbayog City, a police team led by Police Senior Inspector Aaron Raemon Elago raided the house of Patrick Aguilar y Serito, 49, married, jobless, along Rosales Boulevard, Corner Burgos, Purok 5, Brgy West Awang. Armed with a search warrant number 0113-31 issued by Judge Reynaldo Clemens of Regional Trial Court Branch 31 in Calbayog City on February 18, the police were able to arrest the suspect and confiscated a sachet of suspected shabu, P2600 cash believed to be proceeds of his illegal activity and a Nokia mobile phone. The raid was witnessed by Brgy. Chairman Neil Advincula and Kagawad Pablo Diaz of said barangay. Abella and Aguilar were detained at the Palompon and Calbayog police stations respectively while the police is preparing the filing of charges for violations of the provisions of Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act of 2002 against them. Soria said his men have been monitoring the suspects for weeks prior to the arrests. (PR)

TACLOBAN CITY - DepEd City Division is joining the 57-75 education reform movement or ten moves which help to provide ordinary Filipinos and even non-Filipino friends of the Philippines the opportunity to take part in this effort to help address the classroom shortage and aims to solicit the support of companies and donor agencies to raise the needed resources. DepEd Tacloban City Division, Assistant School Division Superintendent Gorgonia Diaz Jr. said that the Ten Moves is a campaign to raise enough resources to build 10,000 classrooms in public schools all over the Philippines. Its main strategy is to get 2 million people to donate P10 per day for 10 months. That will be P300 per month or P 3,000 for the entire 10 months. Because of the huge target and the massive mobilization that this will entail, this public fundraising campaign requires mobilizing a large number of organizations and people around the country, Diaz said. He also said that the campaign is expected to be supported widely by Filipinos and even non-Filipinos working together to address an urgent problem of the country. or generations, women have fought for equal rights. Thanks to the hard work and success of their predecessors, modern women now have opportunities that were once available only to men. This month, we celebrate women power. With the theme Kababaihan: Gabay sa Pagtahak ng Tuwid na Daan, the month-long celebration underscores the need to accelerate womens participation in governance and enhance gender perspective in upholding good governance. The celebration of the National Womens Month is pursuant to Proclamation No. 224 s. 1988 declaring the first week of March each year as Womens Week and March 8 as Womens Rights and International Peace Day; Proclamation No. 227 s. 1988 providing for the observance

of the Month of March as Womens Role in History Month; and Republic Act (RA) 6949 s. 1990 declaring March 8 of every year as National Womens Day. Gone are the days when women suffer from great oppression and inequality. Through the years, these have significantly changed. Today, women have been empowered and have gained enough courage and strength to fight what is right and what is due them. With more women taking control of their lives either in their works, households, or in their communities, it is clearly understood that women are greatly needed to make the country further developed. My staff had previously purchased one card from her. According to the card vendor, every P10 card would entitle me free calls of up to 5 minutes and a certain number (I forgot the exact number) of text messages. Then she broke open the seal of each of my three cards and took out my SIMs from the cards. She explained that she was copying my cellular phone numbers and registering them so that those numbers could be entered in a draw that was scheduled yesterday. Last Thursday, I inserted my SIMS into the phone which an engineer lent me (I have not yet recovered my celfon which I lost inside the Baseybound van last February 11, that despite help from some authorities). Yesterday, I sent a text message to the lady vendor (at her number: +639231118600) to complain that the SIMS were without load and that I couldnt decipher their respective assigned numbers (it seemed the numbers on the cards were incompatible with the SIMs). The $64 question is From where the members of the Administrative Tribunal based their decision? Belarmino was requesting for copy of the Transcript of Record, but, the reply of the SB secretary was he has not yet done it. Amazing! A typical administrative case I have read is the finding of guilt of Cecelio Belarmino, punong barangay of Brgy. Antipolo, Albuera, Leyte. He is charged for Grave Abuse of Authority, Falsification of Public Document, Conduct Unbecoming of a Public Official, and Giving Undue Advantage to Mrs. Merla C. To-ong and is found guilty as charge. The Complainants are all members of the Sangguniang Barangay and the Barangay Secretary. It stemmed from the application of To-ong for Sand and Gravel Industrial Permit. Allegedly, Belarmino prepared Resolution No. 15, Series of 2011, without actual session held. He was suspected of having given favor to To-ong as allegedly always seen in the company of the latter and her relatives. On August 22, 2012, before holding the formal investigation by the Sangguniang Bayan of Albuera, he was slapped with Ninety (90) days preventive suspension upon complaint by Brgy. Secretary Emma T. Gonzaga accusing him for alleged harassment. According to Belarmino he was immediately suspended without giving him the chance to hear the charge. On October 12, 2012, the first hearing was conducted and on November 26, 2012, the formal investigation was terminated. On January 29, 2013, Belarmino received from Barangay Treasurer Linda Onting SB Resolution No. 2013-07, dated January 7, 2013, with attached DECISION dated January 4, 2013, suspending him for a period of six (6) months. In Belarminos appeal before the Sangguniang Panlalawigan (SP), which

he had me read manifested errors committed by the Sangguniang Bayan (SB). In the decision it states that the SB found Belarmino admitted he produced the Resolution and mostly seen together with the family and relatives of Toong on several occasions. Belarmino countered it by quoting: There is no crime when there is no law punishing it is a basic maxim. He emphasized there is no law that prohibits a Punong Barangay being the chief executive to initiate and propose legislative measures to the Sangguniang Barangay. He cites as example mayors or governors, as chief executives, who initiate and propose legislative measures to their respective legislative body. He has a point on that, because he is a member of the three branches of government, that is, executive, legislative and judiciary. As Punong Barangay, he performs the duty of the executive branch; as Presiding Officer of the Sanggunian, he presides the legislative body; and as Chairman of the Lupon Tagapamayapa, he is incharge of the judiciary. Another point he brought out in his appeal is the Minutes of Meeting of the Committee on Environment and Tourism of the SB held on January 17, 2012, conducted by Municipal Councilors Catalina L. Tolero, chairperson; Nelson D. Pepito, vice chairman; and Miguel D. Retuya, member; where the proof of innocence of Belarmino is conspicuously written. By reading the said Minutes, one can read the statement of Complainant Julia D. Gaballo, one of the members of the Sangguniang Barangay and one of the accusers of Belarmino stated: Yes, because that is what the Captain said during the presenta-

No permit, no rally policy unconstitutional


DAVAO -- Militant leaders on Friday described as unconstitutional the no permit, no rally policy that Davao City Mayor Sara Duterte-Carpio said will be enforced by the City Government. Several local officials in Davao, however, supported Dutertes decision, saying the policy should have long been implemented. In a text message, Juland Suazo, spokesperson for Panalipdan-Southern Mindanao, said such policy is a step backward to our democratic gains after Martial Law period. He said the right to peaceably assemble is stated in the Bill of Rights. The Article III, Section 4 provides that: No law shall be passed abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances. Let the people march and speak out. We are not under Martial Law, are we? We should remind Mayor Sara DuterteCarpio that Davao is one of the significant cities that fought hard against the fascist dictatorship and for the restoration of democracy, he said. In fact, Davaos contributions to the struggle are always presented to the people every Araw ng Dabaw, he added. Duterte-Carpio said Thursday that the City Government will release guidelines on no rally, no permit policy, following the scuffle during the dispersal of the picket in front of the Department of Social Welfare and Development (DSWD) office in Davao. He cited a court ruling on the case Reyes vs Bagatsing, 125 SCRA 553, that if the assembly is to be held in a public place, a permit for the use of such place, and not the assembly itself, may be validly required. In text messages on Friday, Duterte-Carpio said that Suazo and Duazo are in the twilight zone. Juland and Sheena are typical specimens of people with nothing to do. She pointed out that Suazo is masquerading as a Supreme Court justice as if its Halloween season. My best advice to him is to sit down and read law books and jurisprudence for four years and pass the bar so that he can intelligently talk about the Constitution. Hes just a paranoid boy mumbling around sentences he read from a tabloid, the city mayor said. Duterte-Carpio added that Juland who is in a perpetual state of sleep, is now in the twilight zone. He is commenting in something that Im sure he hasnt read because the guidelines have not been released. This is the typical problem seen in people talking in their sleep. The mayor also told Duazo: For what is to comment if you dont know what you are talking about? While you were sleeping Sheena, I checked and found out that lo and behold, no guidelines out from my office as of today, for what is to talk if you are not understood by the few who is listening to you? She said her legal team is now polishing the guidelines for the new rule and they will be released next week. But while the guidelines have yet to be released, local officials in Davao Region have expressed support for Duterte-Carpios decision. That should be the appropriate action. On the allegations that the portion of the road being repaired along the Naga-Naga-Anibong Section is still in good condition, the office would like to explain that; - The specific road sections being rehabilitated had a lot of transverse and longitudinal cracks which had previously been sealed with asphalt sealant. Pictures prior to breaking of this damaged blocks had been taken as part of the documentation and standard operating procedures attesting to the extent of damage/deterioration of the pavement blocks. - Rainwater penetrates into the subgrade through the cracks in the pavement which saturates and triggers swelling of the soil underneath and farther damage the pavement foundation. 2. On the allegation that projects are done for the sake of compliance, without proper planning, and thus wasting government funds, we would like to emphasize that; - Prior to allocation of funds for repair/rehabilitation projects, the Maintenance Section of the District evaluates the condition of all national roads within the districts area of jurisdiction through the conduct of the Road Condition (ROCOND) survey done on a yearly basis. - Data result of the Road Condition Survey is entered into the DPWH system, designed to assist the DPWH in the prioritization of improvements. - Output data from the system is re-assessed and re-evaluated by engineers from the Central Office to check if data entered by the district RBIA coordinator to the system is correct before finalizing and endorsing the section for repair/rehabilitation and funding. - In view of the above premise it is unlikely that the district office will initiate projects for compliance, much more, be branded as wasting government funds. 3. On the issue that the DPWH-TCDEO did not coordinate with the concerned local government units which resulted to wastage, duplication non-programmed, and useless work, the office would like to say that; - The DPWH is the agency solely responsible with the construction and maintenance of National Roads. All projects funded under the General Appropriations Act (GAA) for the construction, repair, rehabilitation, and improvement of national roads are released to the DPWH through a suballotment advice addressed to the implementing region and district office which in the case of the project in question is the Tacloban City District Engineering Office. - On the other hand, the Local Government Unit is incharge with all local roads within their area of jurisdiction. However, for projects to be implemented with funds released to the DPWH District Office, implementation thereof is done by the DPWH but with coordination with the local government units concerned, specifically the barangay where the project is to be implemented. - The Rehab./Reconst. of Damaged Paved National Rd. along Naga-Naga-Anibong Rd. is a GAA Project for CY 2013 and appropriations for the project was released by the National Government coursed through the Department, hence, the local government has nothing to do with the project. However, Collaborative Project reports are submitted to the City Mayor, the Governor, and the Representative of the First District of Leyte on a monthly basis for their information. Let it be noted that the aforementioned project is a DPWH regular project Funded under the CY 2013 approved GAA, and as a front loading project, we have been mandated to bid said projects before end of CY 2012 (short of award), and to commence work as soon as Sub-Allotment Release Order (SARO) of the project is released, because front loading projects are included in the yearly State of the Nation Address of the President. Lastly, traffic congestion is a given consequence of development hence, signages, traffic advisories and coordination with TOMECO is always part of the project implementation procedures to mitigate the negative impact of the undertaking. In this regard we appeal to the public for cooperation and understanding for the inconvenience brought about by development in the delivery of safer and more convenient traffic efficient roads in Tacloban City. And besides he was my son and I can recognize him, the grieving mother said. He described her son to be hardworking who tended some chicken and pigs to help augment his income and that of his family. Aside from de la Austria, others killed in the incident at the Upper Mahiao, Barangay Lim-ao, Kananga last Friday at around 10a.m., were identified as Bonifacio Polinio; Cabarsi, Edgardo Sr.; Belly Abella and Joel Milay. All the dead bodies were brought at the Saint Peter Funeral Homes, Ormoc. Nine others are still missing with the EDC rescue team together with the help of the rescue group of the city government of Ormoc with the assistance of the local police of Kananga and the Philippine Army still conducting their retrieval operations at the site of the incident which is within the EDC complex. During the incident, 45 workers were in the area. The workers were hired by the J.E Arrazada Construction and Supply, which is based this city. The survivors were brought to the EDC Clinic and at the Clinic Gatchalian Hospital in Ormoc. The management of the Clinic Gatchalian Hospital refused the request of the Inquirer to interview any of the six survivors confined at said hospital. Dave Devilles, information officer of the EDC, said that the company will shoulder all the expenses of the victims as well as those who survived the incident. Among these projects are path walks, school buildings, health stations, road, water supply system, drainage canal, and shoreline protection, Co said. With the $120 million additional funding from MCC, the project will continue serving municipalities previously covered and expand its reach as additional municipalities in Luzon and Visayas are now covered.
