WHEREAS, on February 20, 2013, plaintiffs filed with this Court Plaintiffs

2 Notice of Motion and Motion for Summary Judgment (ECF No. 85), Memorandum 3 of Points and Authorities in Support of Plaintiffs Motion for Summary Judgment 4 (ECF No. 84), and Statement of Uncontroverted Facts and Conclusions of Law in 5 Support of Plaintiffs Motion for Summary Judgment (ECF No. 86) (collectively, 6 Plaintiffs Original Summary Judgment Filings); and 7 WHEREAS, counsel for Intervenor-Defendant has objected that (1) the

8 typeface of the footnotes in Plaintiffs Memorandum of Points and Authorities in 9 Support of Plaintiffs Motion for Summary Judgment (ECF No. 84) does not 10 comply with Paragraph 7(c) of this Courts Standing Order (ECF No. 6), and (2) 11 Plaintiffs Statement of Uncontroverted Facts and Conclusions of Law in Support 12 of Plaintiffs Motion (ECF No. 86) does not comply with L.R. 56.1 of the Local 13 Rules of this Court on the ground that it contains legal conclusions and argument; 14 and 15 WHEREAS, counsel for Plaintiffs (1) agree that the footnotes in the

16 Memorandum of Points and Authorities in Support of Plaintiffs Motion for 17 Summary Judgment (ECF No. 84) are less than 12-point typeface, but (2) disagree 18 that the Statement of Uncontroverted Facts and Conclusions of Law in Support of 19 Plaintiffs Motion (ECF No. 86) does not comply with L.R. 56.1 of the Local 20 Rules of this Court; and 21 WHEREAS, counsel for Plaintiffs, in order to advance this case and avoid

22 motion practice, now wish to withdraw Plaintiffs Original Summary Judgment 23 Filings and to file new summary judgment papers; and 24 WHEREAS, Intervenor-Defendant intends to cross move for summary

25 judgment; and 26 WHEREAS, counsel for Plaintiffs and Intervenor-Defendant have agreed

27 that their statements filed pursuant to L.R. 56.1 of the Local Rules of this Court 28 1

1 shall include only statements of fact that they contend are material and that they 2 contend are not the subject of any genuine dispute, and will omit all legal 3 arguments and purported conclusions of law; and 4 WHEREAS, counsel for all parties have agreed on a briefing schedule for

5 such motions; 6 NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED,

7 by and between the undersigned, attorneys of record for all parties to the above8 captioned action as follows: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2 1. Plaintiffs withdraw Plaintiffs Original Summary Judgment Filings. 2. On or before March 4, 2013, Plaintiffs will file with the Court a new summary judgment motion and supporting papers that address Intervenor-Defendants objections. Plaintiffs will include in their new statement filed pursuant to L.R. 56.1 of the Local Rules of this Court only statements of fact that they contend are material and that they contend are not the subject of any genuine dispute. Plaintiffs will omit from their new statement filed pursuant to L.R. 56.1 of the Local Rules of this Court all legal arguments and purported conclusions of law. 3. Not later than March 18, 2013, Intervenor-Defendant will file its opposition to Plaintiffs new summary judgment motion and will file its cross-motion for summary judgment. Intervenor-Defendant will include in its statement filed pursuant to L.R. 56.1 of the Local Rules of this Court only statements of fact that it contends are material and that it contends are not the subject of any genuine dispute. IntervenorDefendant will omit from its statement filed pursuant to L.R. 56.1 of the Local Rules of this Court all legal arguments and purported conclusions of law.

4. Within 21 days after Intervenor-Defendant files its opposition to Plaintiffs new summary judgment motion, Plaintiffs will file their reply. 5. Within 21 days after Intervenor-Defendant files its cross-motion for summary judgment, Plaintiffs will file their opposition and Federal Defendants will file their response to both Plaintiffs new summary judgment motion and Intervenor-Defendants cross-motion for summary judgment. 6. Within 14 days after Plaintiffs file their opposition to IntervenorDefendants cross-motion for summary judgment, Intervenor-Defendant will file its reply. 7. Within 14 days after Federal Defendants file their response to Plaintiffs new summary judgment motion and Intervenor-Defendants cross-motion for summary judgment, Plaintiffs and Intervenor-Defendant may, if they choose, file replies to Federal Defendants response. 8. Argument on Plaintiffs new motion for summary judgment and Intervenor-Defendants cross-motion for summary judgment will be set for May 6, 2013, or as soon thereafter as is convenient for the Court. 9. Counsel for all parties have conferred and agree that, in light of the numerous significant and complex issues in this case, the briefing schedule stipulated and agreed to herein represents an appropriate and efficient manner in which to brief up those issues for the Courts consideration. 10. Counsel stipulate and agree that the Court should enter the Proposed Order submitted herewith.
