4. All database "lessons learned" that exist for the exercises listed in Item 2.

However, database lessons learned were provided that are titled
"Amalgam Virgo Series Exercises" - not Amalgam Virgo 01
("NORAD Corrective Action Board Amalgam Virgo Exercise"
NCT0056999).
Commission requests LtColJones contact NORAD and verify that the
database lessons learned submitted are in fact all of the Amalgam
Virgo 01 database lessons learned that exist.

5. All documents related to the Concept Development Conference (CDC) and the
Initial Planning Conference (IPC) for Amalgam Virgo O2, including the
exercise planning schedule. This request includes, but is not limited to, drafts
of the Concept and Objectives Statement (C&O), the Exercise Specifications
(EXSPEC), the Exercise Plan (EXPLAN), the Master Scenario Events Listing
(MSEL), and the Control Staff Instructions (COSIN) as they existed prior to
9/11/01. For each of the documents responsive to this request, please provide
information sufficient to determine the date the document was initially drafted,
and, if applicable, the date the document was finalized.

However, upon review the documents they submitted were in fact 74
database lessons learned from Vigilant Guardian 01 (ROOD
04013691).

12. All documents of NORAD intelligence offices, from January 1, 1998 through
September 20, 2001, that relate to the issue of an aircraft being used as a
weapon. This request includes, but is not limited to, documents responsive to
this request in the possession of Lt. Col. Stuart at NEADS.
* Documents held up since roughly 12/19/03 due to review by OGC Stu
Aily. Rationale provided to Commission was that they believed the
docs provided had already been submitted in response to previous
document requests, and DOD didn't want to be redundant in what it
provided.
* 21 documents delivered afternoon of 1/9/04.
* 4 briefs prepared by LtCol Stuart submitted. Notably, however, the
March 24, 1999 brief by LtCol Stuart on terrorist use of aircraft as
weapons was not provided. (LtCol Stuart told the Commission staff
about this specific brief in an interview).
* LtCol Jones has for-action a request to NORAD to provide the March
24, 1999 brief if it exists.

13. The NORAD Agreement and subsequent renewals, described in paragraph 4.1
of N110-37 ("NORAD Planning and Requirements System (NPRS)), as drafted
and/or approved by the CINCNORAD from January 1, 1998 through
September 20, 2001.

14. The NORAD Vision, described in paragraph 4.1 of NI 10-37 as drafted and/or
approved by the CINCNORAD from January 1,1998 through September 20,
2001.

* Documents delivered ("NORAD into the 21s1 Century" and "NORAD
Vision 2010.. .and beyond") do not have any date on them that conveys
when they were published or originally created.

of the two documents submitted.

15. NORAD Requirements Review Report, described in paragraph 5.2 of Nil 0-37, Comment: POSSIBLY NOT
RESPONSIVE
as drafted and/or approved by CINCNORAD from January 1, 1998 through
September 20, 2001.

* However, the documents are titled "NORAD Mission Area Analysis
Report" (1999, 2000, and 2001 submitted).
* LtCol Jones has for-action to contact NORAD and verify that either no
"Requirements Review Reports" exist for the timeframe requested,

and/or that the Mission Area Analysis Reports submitted are similar,
(For example MARS may have been implemented in place of RRRs)

16. The NORAD Integrated Priority List, described in paragraph 5.3 of NI10-37, Comment: POSSIBLY NOT
RESPONSIVE
as drafted and/or approved by CINCNORAD from January 1, 1998 through
September 20, 2001.

* IPLs labeled FY01, FY02, FY03, and FY04 were submitted. However,
it is not clear when the documents were originally produced (for
example was the FYOS 1PL produced in 1998?)
LtCol Jones has for-action to verify when the documents submitted
were created.

17. NORAD Mission Need Statements (MNS), described in paragraph 6 of NI10- Comment: NOT RESPONSIVE
37, regarding the subject of hijacked aircraft and drafted from January 1, 1998
through September 20, 2001.
* According to LtCol Jones. DOD OGC assessed what NORAD
provided in response to Item 17, and deemed the documents not
responsive. It appeared that DOD was going to leave it at that (no
information was provided that DOD was coordinating with NORAD to
resolve Item 17).
* On 1/8/04 Commission staff requested LtCol Jones to contact NORAD
and resolve the issue, as clearly, the request in Item 17 still stands.
LtCol Jones has for-action.

The Commission requests that the documents requested above be provided as soon as they are
available, even though all requested documents may not be provided at the same time, through
means of a "rolling" production.

If any requested documents are withheld from production, even temporarily, based on an alleged
claim of privilege or for any other reason, the Commission requests that the respondent, as soon as
possible and in no event later than the production date, identify and describe each such document or
class of documents, as well as the alleged basis for not producing it, with sufficient specificity to
allow a meaningful challenge to any such withholding.

If the respondent does not have possession, custody or control of any requested documents but has
information about where such documents may be located, the Commission requests that the
respondent provide such information as soon as possible and in no event later than the production
date.

If the respondent has any questions or concerns about the interpretation or scope of these document
requests, the Commission requests that any such questions or concerns be raised with the
Commission as soon as possible so that any such issues can be addressed and resolved prior to the
production date.
