United States House of Representatives 2245 Rayburn House Office Building Washington, DC 20515 Dear Congresswoman Moore: I'm a constituent requesting your help in obtaining information from the US Centers for Disease Control and Prevention (CDC). Please find attached: - A November 8, 2010 letter from Special Agent Elton Malone at the Office of the Inspector General at the Department of Health and Human Services (HHS) stating that, in response to a complaint, concerns regarding the Save-A-Life Foundation and Douglas Browne, a CDC employee, have been referred to the CDC for review. - A June 5, 2012 letter from CDC Chief Operating Officer Sherri A. Berger to blogger Peter M. Heimlich, stating that the review had been completed. Would you please write to Ms. Berger, ask her to provide you with the following information, forward to me a copy of your letter to her, and then provide me with a copy of her response? 1) The name of the CDC employee assigned to conduct the review and the name of the employee who made the assignment. 2) The names of all CDC employees who participated in the review. 3) The date when the review began and the date it was completed. 4) Copies of all related records used in the review. 5) All correspondence related to the review including, but not limited to, all correspondence with HHS officials including the Inspector General's office. 6) A copy of the report, if any, produced by the review. If no report was produced, would you please ask Ms. Berger to provide you with a detailed letter describing all aspects of the review? In your letter, you allege potential misconduct on the part of Douglas Browne, an employee of the Centers for Disease Control and Prevention (CDC). Specifically you state that CDC may have improperly approved Browne's outside activities with the Save-A-Life-Foundation, and that Browne may have exceeded the scope of the approval which he received from CDC management. HHS/OIG/OI/SIB has reviewed the information you provided, and has determined that there is not enough information presented to warrant an investigation for potential violation of criminal statutes. HHS/OIG/OI/SIB has referred this matter to CDC for further review, and appropriate administrative action as this matter appears to be more appropriately addressed through CDC's administrative review process.
