Objective: Student will be able to Students will be able to identify how lawyers conduct opening and closing statementas as well as the Direct and Cross examination of a witness during a trial. Identify open-ended questions that allow the witness to tell his story and closed-ended questions designed to elicit yes or no answers. Evaluate a "leading" question when it is asked. Identify how to effectively direct and cross examine a witness. Students will be able to identify when lawyers should object during witness testimony as well as evaluate the different types of objections. Identify how facts are introduced to a jury in a trial setting. Identify the differences between various types of Homicide crimes (Murder in the first degree , First-degree manslaughter (reckless) , and Second-degree manslaughter (negligence)) as well as evaluate the elements of each crime. Evaluate the role of a jury in a criminal trial. Identify the different steps in a criminal trial. Focus: How well have I learned the material in Criminal Law? Do Now/Motivation: Get into your groups for the final exam. Notes/Lesson Narrative: 6/12/09 Mini Lesson: Students will take out the Mock Trial Packet for their 2009 Final Exam. Students will identify: The different roles they will play. The facts of the case. The affidavits of all witnesses The New York State Penal Code regarding the issues at hand. The cases that can be cited as precedent. The grading rubric. TODAY IS FINAL EXAM PRESENTATION DAY Activity: The teacher will explain to students that the presentation for their final exam from criminal law BEGINS today. Students will be participating in a Mock Trial competition. Over the past few days Students worked in their cooperative learning groups The teacher will lay out the schedule for the final exam for the students. The teacher explained the roles of each of the students during the mock trial Pace

Students were asked to: Read the "Stipulated Facts" of the THE PEOPLE OF THE STATE OF NEW YORK, Prosecution, vs. TERRY C. ONEAL, Defendant case. Students read the case and assign roles for the Mock Trial Each group will need: Mock Trial Roles: Lawyers: 1. Lawyers for the Prosecution 2. Lawyers for the Defendant STATE WITNESSES: 1. Casey Dunsworth 2. Pat Young 3. Officer Morgan Wilson DEFENSE WITNESSES: 1. Terry ONeal 2. Jamie Anderson 3. Kirby Martinez Summary: The teacher will explain that the final exam continues tomorrow with the witnesses for the defense and the closing statements. Reminder: TIME LIMITS The following time limits apply: Opening statements 5 minutes for each team Direct examination 7 minutes for each witness Cross examination 5 minutes for each witness Closing arguments 5 minutes for each team Time limits will be enforced at the discretion of the judge.
