(Certification Guidelines) II CERTIFICATION GUIDELINES 1 General 1.1 1.2 These Guidelines have been developed for the use of the Administration for the issuance of ship safety certificates. Members of the International Association of Classification Societies (IACS) and other organizations/entities recognized/authorized by the Administration, may be requested to perform the inspections necessary for issuance of the ship safety certificates on behalf of the Administration. When acting on behalf of the Administration, certificates issued by IACS and other recognized/authorized organizations/entities will assume the format prescribed by the Administration. 1.2.1 Guidance issued by the IMO together with existing policies of the Administration regarding recognition of organizations for the purpose of issuing statutory certificates, shall be followed. Recognized Organizations/Authorized entities shall be guided by a Memorandum of Agreement which shall be entered into by the Administration and said RO's.

The Company shall assume responsibility in ensuring that all the relevant information, statutory certificates and class rules to which the ship is certified and classed, are provided to the Administration or Recognized Organization performing the inspection.

Types of Ship Safety Certificates 2.1 Passenger Ship Safety Certificate (PSSC) shall be issued after an initial or renewal survey to a passenger ship which complies with the relevant requirements of PMMRR 97, as amended, SOLAS 74 as amended, and any other relevant requirements of the present regulations and their amendments; 2.2 Cargo Ship Safety Certificate (CSSC) may be issued after an initial or renewal survey to a cargo ship which complies with the relevant requirements of PMMRR 97, as amended, SOLAS 74 as amended, and any other relevant requirements of the present regulations and their amendments, and as an alternative to the certificates in Section 2.3, 2.4 and 2.5; 2.3 Cargo Ship Safety Construction Certificate (CSSCC) shall be issued after an initial or renewal survey to a cargo ship which complies with the relevant requirements of PMMRR 97, as amended, SOLAS 74 as amended (other than those relating to fire

(Certification Guidelines) systems and appliances and fire control plans), and any other relevant requirements of the present regulations and their amendments; 2.4 Cargo Ship Safety Equipment Certificate (CSSEC) shall be issued after an initial or renewal survey to a cargo ship which complies with the relevant requirements of PMMRR 97, as amended, SOLAS 74, as amended and any other relevant requirements of the present regulations; 2.5 Cargo Ship Safety Radio Certificate* (CSSRC) shall be issued after an initial or renewal survey to a cargo ship which complies with the relevant requirements of PMMRR 97, as amended, SOLAS 74 as amended, and any other relevant requirements of the present regulations and their amendments (* Required inspection as well as issuance of certificate shall be undertaken by the National Telecommunications Commission); 2.6 High-Speed Craft Safety Certificate (HSCSC) shall be issued after completion of an initial or renewal survey to a craft which complies with the requirements of the High Speed Craft Code; 2.7 Minimum Safe Manning Certificate (MSMC) shall be issued to a ship specifying the minimum safe manning level that is established in accordance with the provisions of the PMMRR 97, as amended, and other existing principles, recommendations and guidelines and is adequate in all respects for the safe operation of the ship and for protection of the marine environment; 2.8 Certificate of Fitness (CF) shall be issued after completion of an initial or a periodical survey of a particular Class of ship which complies with the requirements of the applicable Code; 2.9 Fishing Vessel Safety Certificate (FVSC) shall be issued after an initial or renewal survey to a fishing vessel which complies with the relevant requirements of PMMRR 97, as amended, and any other relevant requirements of the present regulations and their amendments; 2.10 Exemption Certificate (EC) shall be issued whenever an exemption is granted a ship under and in accordance with the provisions of PMMRR 97, as amended, and SOLAS 74, as amended, in addition to other required Safety Certificates; 2.11 Other safety-related certificates as may be required by the Administration.

(Certification Guidelines) 3 Duration and Validity of Ship Safety Certificates 3.1 Duration and validity of ship safety certificates shall cover an appropriate interval between inspections based on initial, periodical, renewal, and additional inspection. 3.1.1 3.1.2 A Passenger Ship Safety Certificate and HSCSC shall be issued for a period not exceeding 12 months. A Cargo Ship Safety Construction Certificate, Cargo Ship Safety Equipment Certificate, Cargo Ship Safety Certificate, Certificate of Fitness, Fishing Vessel Safety Certificate and High Speed Craft Safety Certificate shall be issued for a period specified by the Administration, which shall not exceed five years and shall be subject to annual endorsement. A Minimum Safe Manning Certificate shall be valid for a maximum period of five years subject to annual endorsement. An Exemption Certificate shall not be valid for a longer duration than the period of the certificate to which it refers.

A scheme is hereby provided to foster the necessary flexibility in the execution of each inspection: 3.2.1 When the renewal inspection is completed within 3 months before the expiry date of the existing certificate, with no loss of its period of validity, the new certificate shall be valid from the date of completion of the renewal survey up to: (a) (b) 3.2.2 a date not exceeding twelve (12) months from the date of expiry of the existing certificate, for a passenger ship; a date not exceeding five (5) years from the date of expiry of the existing certificate, for a cargo ship.

When the renewal survey is completed after the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal survey up to: (a) (b) a date not exceeding twelve (12) months from the date of expiry of the existing certificate, for a passenger ship; a date not exceeding five (5) years from the date of expiry of the existing certificate, for a cargo ship.

(Certification Guidelines) 3.2.3 when the renewal survey is completed more than three months before the expiry date of the existing certificate, the new certificate shall be valid up to: (a) (b) 3.2.4 a date not exceeding twelve (12) months from the date of completion of the renewal survey, for a passenger ship; a date not exceeding five years from the date of completion of the renewal survey, for a cargo ship.

If a certificate, other than a Passenger ship Safety Certificate, is issued for a period of less than five (5) years, the Administration may extend the validity of the certificate beyond the expiry date up to the maximum period of five (5) years, provided that the inspections prescribed in Chapter III, as applicable when a certificate is issued for a period of five (5) years, are carried out as appropriate. If a renewal survey has been completed and a new certificate cannot be issued or placed on board the ship before the expiry date of the existing certificate, the person or organization authorized by the Administration may endorse the existing certificate and such a certificate shall be accepted as valid for a further period which shall not exceed five (5) months from the expiry date. If a ship at the time when a certificate expires is not in a port in which it is to be surveyed, the Administration may extend the period of validity of the certificate but this extension shall be granted only for the purpose of allowing the ship to complete its voyage to the port in which it is to be surveyed, and then only in cases where it appears proper and reasonable to do so. No certificate shall be extended for a period longer than three (3) months, and a ship to which an extension is granted shall not, on its arrival in the port in which it is to be surveyed, be entitled by virtue of such extension to leave that port without having a new certificate. When the renewal survey is completed, the new certificate shall be valid up to: (a) (b) a date not exceeding twelve (12) months from the date of expiry of the existing certificate before the extension was granted, for a passenger ship; a date not exceeding five (5) years from the date of expiry of the existing certificate before the extension was granted, for a cargo ship.

A certificate issued to a ship engaged on short voyages which has not been extended under the foregoing provisions of this regulation may be extended by the Administration for a grace period of up to one month from the date of expiry therein stated. When the renewal survey is completed, the new certificate shall be valid up to:

(Certification Guidelines) (a) (b) 3.2.8 a date not exceeding twelve (12) months from the date of expiry of the existing certificate before the extension was granted, for a passenger ship; a date not exceeding five (5) years from the date of expiry of the existing certificate before the extension was granted, for a cargo ship.

In special circumstances, as determined by the Administration, a new certificate need not be dated from the date of expiry of the existing certificate as required by aforecited relevant provisions. In these special circumstances, the new certificate shall be valid up to: (a) (b) a date not exceeding twelve (12) months from the date of completion of the renewal survey, for a passenger ship; a date not exceeding five (5) years from the date of completion of the renewal survey, for a cargo ship.

3.2.9

If an annual, intermediate or periodical survey is completed before the period specified in the aforecited relevant regulations, then: (a) (b) (c) the anniversary date shown on the relevant certificate shall be amended by endorsement to a date which shall not be more than three (3) months later than the date on which the survey was completed; the subsequent annual, intermediate or periodical survey required by the relevant regulations shall be completed at the intervals prescribed by these regulations using the new anniversary date; the expiry date may remain unchanged provided one (1) or more annual, intermediate or periodical surveys, as appropriate, are carried out so that the maximum intervals between the surveys prescribed by the relevant regulations are not exceeded.

3.2.10 Safety certificates issued shall cease to be valid in any of the following cases: (a) (b) (c) if the relevant surveys and inspections are not completed within the periods specified under the aforecited relevant regulations; if the certificate is not endorsed in accordance with the present regulations; upon transfer of the ship to the flag of another State. A new certificate shall only be issued when the Government issuing the new certificate is fully satisfied that the ship is in compliance with the requirements of the aforecited relevant regulation. In the case of a transfer between Contracting Governments, if requested within three (3) months after the transfer has taken place, the Government of the State whose flag the

(Certification Guidelines) ship was formerly entitled to fly shall, as soon as possible, transmit to the Administration copies of the certificates carried by the ship before a transfer and, if available, copies of the relevant survey reports. 4 Certification Procedures Issuance of Safety Certificates 4.1 4.2 The Regional Director concerned, upon the favorable recommendation of the Inspector/Inspection Team, may cause the issuance of Safety Certificate(s). In the event that minor deficiencies are noted during the inspection and/or pending submission of pertinent documentary requirements, an Interim Safety Certificate(s) (ISC) shall be issued indicating the reasons thereof. Except under meritorious circumstances, only one ISC shall be issued but in no case shall an ISC exceed three issuances. An ISC shall be valid for a maximum period of thirty (30) days. In the case of classed ships however, the maximum period for an ISC can be up to sixty (60) days. Upon request by a Maritime Regional Office (MRO) to another MRO, an Interim Safety Certificate(s) shall be issued by the office which conducts such inspection within its area of jurisdiction, even if such vessel is not homeported therein. The inspection report shall then be forwarded to the office where the vessel is homeported within 24 hours after issuance of the Interim Safety Certificate(s).

4.3

Suspension of Safety Certificates 5.1 The MRO Director concerned may cause the suspension of Safety Certificate(s). 5.2 Suspension shall be imposed only upon the recommendation of the Inspector(s) after a thorough inspection of the ship or evaluation of all available data surrounding the proposed suspension of safety certificate, all the while observing due process. 5.3 A Ship Safety Certificate shall be suspended if: the ship has been involved in sea accident and/or incident such as, but not limited to: grounding, collision, and hitting of hard objects, that may put into question the integrity of the hull and its integral parts and other affected machineries/appliances.

(Certification Guidelines) non-compliance with mandatory rules and regulations relative to safety and environmental protection is uncovered. a major deficiency relative to the safe operation of the ship is uncovered; a strong evidence of fraud or mis-representation relative to the acquisition of a safety certificate is found during the life or validity of subject certificate; and other related instances that may be uncovered and as determined by the SSIS Committee.

5.4 A Letter-Suspension will be issued, through the MARINA Enforcement Office or any other representative of the Administration, by the MRO Director concerned to the Shipowner/Operator/Master informing them of such suspension and the reason behind such action. 5.5 A suspended Ship Safety Certificate(s) may only be restored/reinstated after correction of deficiency and upon favorable recommendation by the Inspector(s) after a thorough inspection of the ship or evaluation of all available data surrounding the suspension of safety certificate, all the while observing due process. 5.6 A suspended Ship Safety Certificate(s) shall remain suspended until such time that the suspension is lifted; 5.7 The MRO Director concerned shall have the responsibility of lifting the suspension of Safety Certificate(s). 5.8 All records pertaining to the suspension and subsequent lifting of said suspension shall form part of the inspection records of affected ships. 6 Withdrawal of Certificates 6.1 6.2 The MRO Director concerned, upon the recommendation of the Inspector(s), may cause the revocation of the Safety Certificate(s) A Ship Safety Certificate is to be withdrawn if: 6.2.1 6.2.2 any of the required/imposed conditions for the lifting of a suspended Ship Safety Certificate(s) is/are not met; fraud or mis-representation relative to the acquisition of a safety certificate is found during the life or validity of subject certificate is proven beyond reasonable doubt;

Rectification of Deficiencies 7.1 Shipowner/Operator/Master of all ships issued suspension of Ship Safety Certificate(s) shall be given adequate time to correct the deficiencies. The MRO Director concerned, upon the recommendation of the Inspector(s), shall inform the Shipowner/Operator/Master of the ship deficiencies and the period of rectification. Unless otherwise determined by the SSIS Committee, the period for the rectification of deficiencies shall in no way exceed three (3) months. All ships issued withdrawal orders, relative to Ship Safety Certificates, shall first correct/explain deficiencies found before application for the inspection of the ship, for the issuance of the required certificate, is accepted. Acceptance of the application shall be without prejudice to any fines and/or penalties being levied against the proponent.

7.2

Restoration of Certificates A Ship Safety Certificate invalidated by expiry or withdrawal may only be reinstated upon satisfactory completion of an inspection following the procedures specified in chapter III.
