The respondent, a native and citizen of Brazil, appeals the decision of the Immigration Judge,
mailed January 29, 2013, denying his motion to reopen. In denying the respondent's motion, the
Immigation Judge used a frm order wherein he checked several boxes and hand wote several
anotations.
We agee with the respondent that the Immigration Judge's decision, in its present fr, does
not contain sufcient fndings of fct ad conclusions of law to allow fr a meaningfl appellate
review. See Matter of M-P-, 20 I&N Dec. 786 (BIA 1994) (holding that when a motion to
reopen proceedings is denied, the Immigration Judge must identif and flly explain the reasons
fr such decision); see also Matter of S-H-, 23 l&N Dec. 462 (BIA 2002).
Accordingly, the record will be reted to the Immigation Judge fr preparation of a fll
te-written decision that clearly articulates his rationale fr denying the respondent's motion.
Upon prepaation of the fll decision, the Immigation Judge shall issue an order
administatively reting the record to the Board. The Immigration Judge shall sere the
administative ret order on the respondent and the Department of Homeland Security. The
Board will thereafer give the parties an opportunit to submit briefs in accordance with the
regulations. Accordingly, the fllowing order is entered.
ORDER: The record is reted to the Immigation Court fr frther action as required
