TRIPATITE AGREEMENT

______________between Navneet Arora and Avneet Arora s/o Sh. Surinder Arora resident at 326, 49.5 acre scheme, Patel Nagar, Bathinda Hereinafter referred to as the borrower which expression shall unless repugnant to the context, include his/her heirs, executors, administrators and assign of the first part and Improvement Trust, Bathinda (Hereinafer referred to as the authority which term shall include its successors, and assigns of the second part and Indian Overseas Bank a body corporate consitured under the Banking Companies (acquisition &Transfer of Undertakings) Act, 1980( No. 40 of 1980) having its head Office and a branch office amongst other at Kikar Bazar. Bathinda through its Principal Officer and Senior Manaeer Shri R.P.Setia (here after called the Bank which expression shall unless repugnant to the context include its successors and assigns of the third part. Whereas:1 ) That the borrower desires to construct a house allotted to him on 24-12-08 by the authority under its 49.5 scheme (hereinafter referred to as the said scheme) 2) The Bank has allowed a house loan of Rs. 15,00,000/-( Rs. Fifteen Lacs only) to the borrower for the construction of said plot as per the terms and conditions agreed to under loan agreement dated___________entered in to between the bank and the) borrower (hereinafter referred to as the said agreement) one of the conditions here under being that the borrower shall mortgage the said plot to be constructed by him in favor of the bank. 3) The borrower has given full payment of the said plot to the authority.

NOW THE AGREEMENT WITNESS AS UNDER:

In consideration of a sum of Rs. 600000(Rs. Six Lacs Only) alreadydeposited by the borrower with the authority as initial payment of the purchase, of the said property and a further, sum of Rs. Nil (Rupees Nil) to be paid by the bank directly to the authority on behalf of borrower as per the demands for payments by the authority. It is hereby agreed to by and amongst the parties as follows: 4) That the bank will make disbursement of the sanctioned loan by making

payment to the authority directly on behalf of the borrower and any payment made to the authority shall be deemed to the payments made to the borrower and the borrower shall in each case be liable for the amount of loan disbursing on his/her their behalf to the authority as though the same had been disbursed directly to borrower. 5. That is further agreed by the borrower that the bank shall not be responsible

or liable to ensure or ascertain the progress of construction and here demand for payment would be sufficient for bank to effect disbursement as aforesaid. Without prejudice to above and not withstanding anything to the contrary contained herein bank may in its sole discretion refuse to disburse the loan until. a) The borrower has paid his own contribution in full to society i.e the cost of the dowelling unit (including escalation, if any) less the loan and/or b) The progress and need of construction justifies (Bank being the sole judge thereof) the disbursement requested. c) The authority will maintain a separate account for the borrower and adjust payment of housing loan received by it from the bank borrower against the cost

of particular category of plot applied by him. d) On completion of the plot its possession will be handed over to the borrower forth along with the conveyance of the title there after to the bank as security for the said loan as per terms and conditions of the said agreement. e) The cost of the plot in excess of the amount of the housing loan sanctioned will be borne and paid by the borrower. 6) That the borrower withdraws from the schemes or fails to pay the balance amount representing the difference between the housing loan allowed by the bank and actual cost of the plot (including escalation) or dies or allotment of the plot is otherwise cancelled, the entire amount standing to the credit of borrower (including margin money and borrowers contribution) will be refunded by the authority to the bank. The bank shall refund to borrower the balance, if any, after adjusting the entire outstanding dues including interest costs and other amount recoverable by the bank from the borrower. 7) That the covenant here under shall not be construed mean and faster any responsibility upon the bank to observe the payment schedule, if any between authority and the borrower or payment to the authority, as Bank shall not be responsible for any delay or omission in disbursement on account of

breach/default attributable to borrower /society. The borrower shall be responsible to follow up with bank to make disbursement on his behalf as per agreement he may have with the authority . 8) That the authority will give/provide necessary consent no mortgage of the plot by the borrower in favour of the bank. 9) If for any reason there is an increase/escalation in the cost of the plot such increase shall be paid and born by the borrower without any reference to the bank. And until increase is paid bank shall have the right to suspend further disbursement objection for

of his sanctioned loan.

10) That the borrower will not further mortgage charge the plot allotted as above said to any person financial institution for raising any loan without the prior written consent of the bank.

11) That the authority shall not entertain the request of transfer of the plot of the borrower without the prior written consent of bank.

12) In any event in which any refund becomes due and payable under any agreement arrangements executed made between the borrower and authority or otherwise the authority agrees not to pay amount on any account of the borrowers by way of refund or otherwise without the written consent to the bank. In case so required by the bank any such amount shall be paid by the authority to the bank.
