Labour Market Opinion


Every year, Canadian employers hire foreign workers to help address skill and labour shortages. Human Resources and Skills Development Canada/Service Canada, Citizenship and Immigration Canada and the Canada Border Services Agency help ensure that foreign workers support economic growth in Canada. This information sheet is part of a series that provides information on hiring foreign workers and explores the role of Human Resources and Skills Development Canada/Service Canada and Citizenship and Immigration Canada in managing the Temporary Foreign Worker Program. What is a Labour Market Opinion?


In most cases, employers who wish to hire temporary foreign workers must first apply to Service Canada for a Labour Market Opinion. The opinion assesses the impact the foreign worker would have on Canadas labour market or, in other words, how the offer of employment would likely affect Canadian jobs. An employer needs a positive Labour Market Opinion to hire a temporary foreign worker. The foreign worker needs a copy of the positive Labour Market Opinion in order to apply to Citizenship and Immigration Canada for a work permit.

Citizenship and Immigration Canada and the Canada Border Services Agency work with foreign workers who want to work in Canada.

What is the role of Human Resources and Skills Development Canada/Service Canada?
Service Canada assesses the employers application on a case by case basis to make sure the prevailing wage rate and acceptable working conditions are being offered, and that the labour market will likely benefit from the hiring of a foreign worker. Service Canada also pays particular attention to the recruitment efforts that the employer made in Canada.

What is the role of Citizenship and Immigration Canada?


A foreign worker who wants to work in Canada requires a work permit from Citizenship and Immigration Canada. Following receipt of an application for a work permit and a copy of the letter confirming that an employer received a positive Labour Market Opinion (when required), Citizenship and Immigration Canada determines whether the foreign worker is eligible to receive a work permit. In certain circumstances, an application for a work permit may be made at a port of entry.

What is the role of the Canada Border Services Agency?


The Canada Border Services Agency screens foreign workers at Canadian border crossings and airports to ensure that they meet admissibility requirements before issuing work permits and allowing the workers to enter Canada. The Agency has the final say on who may enter the country.

Who is responsible for employment and labour standards?


Temporary foreign workers have the same rights as Canadian workers. Ninety percent of occupations are provincially/territorially regulated and employment and labour standards for those occupations are the responsibility of the provincial and territorial governments. The other 10 percent of occupations are federally regulated and the employment and labour standards fall under the Canada Labour Code. It is important to note that standards vary among provinces and territories. Please check with your ministry responsible for labour and employment standards.

What is required of Canadian employers?


Employers make a job offer to a foreign worker and request a Labour Market Opinion from Service Canada by submitting an application (online, by mail or fax, or in person at a Service Canada Centre). Employers then inform the foreign worker of the results of the Labour Market Opinion assessment.

What is required of foreign workers?


Foreign workers who want to work in Canada must first obtain a job offer from a Canadian employer. They then apply to Citizenship and Immigration Canada for a permit to work temporarily in Canada. Applicants must include a copy of the Service Canada letter confirming that their employer received a positive Labour Market Opinion.

How does Service Canada develop a Labour Market Opinion?


Service Canada assesses the likely impact that hiring a foreign worker will have on the labour market in Canada. Several factors are considered when developing this opinion, such as:

whether the wages and working conditions are in keeping with norms for the occupation; whether the temporary foreign worker is likely to fill a labour shortage; whether or not there is a labour dispute in progress; the efforts made by an employer to recruit or train Canadians or permanent residents; whether hiring the foreign worker will result in transferring skills or knowledge to Canadians or in creating or retaining employment for Canadians; and ensuring that an employer-employee relationship exists where the foreign worker agrees to work full-time for an employer for a specific wage/salary.

Application Process
Step 1: The employer completes the form Foreign Worker Application for a Labour Market Opinion. (PDF 285KB) - View as HTML. The National Occupational Classification (NOC), which contains information on occupations in Canada, can help employers identify the proposed occupation, duties to be assigned, and the prerequisites for the position. Step 2: The employer submits a complete application to the nearest Service Canada Centre that processes Foreign Worker Applications. Step 3: Service Canada reviews the application according to criteria noted above, and develops a Labour Market Opinion. Step 4: Service Canada sends a written letter with results from the Labour Market Opinion assessment to the employer, who then communicates the results to the foreign worker. Step 5: In the case of a positive Labour Market Opinion, the employer sends a copy of the confirmation letter to the foreign worker. Step 6: The foreign worker applies to Citizenship and Immigration Canada for a work permit, attaching a copy of the confirmation letter.
