COREY, State Attorney for the Fourth Judicial Circuit of the State of Florida, in and for Duval County, charges that: COUNT 1 TAMMY LYNN GILL on December 11, 2012, in the County of Duval and the State of Florida, did knowingly write or compose and did knowingly send or procure the sending of a letter, inscribed communication or electronic communication, so written or composed, whether such letter or communication be signed or anonymous, to Mike Ashurian, containing a threat to kill or to do bodily injury to the person to whom such letter or communication is sent, or a threat to kill or to do bodily injury to any member of the family of the person to whom such letter or communication is sent, contrary to the provisions of Section 836.10, Florida Statutes.

COUNT 2 TAMMY LYNN GILL on December 11, 2012, in the County of Duval and the State of Florida, did carry on or about her person a concealed firearm, contrary to the provisions of Section 790.01(2), Florida Statutes. COUNT 3 TAMMY LYNN GILL on December 11, 2012, in the County of Duval and the State of Florida, did then and there operate a motor vehicle upon a street or highway, and did willfully and knowingly refuse or fail to stop such vehicle in compliance with an order to stop by a duly authorized law enforcement officer, or did willfully flee in an attempt to elude such officer after having stopped in knowing compliance with such order to stop, contrary to the provisions of Section 316.1935(1), Florida Statutes. LAW ENFORCEMENT INCIDENT

ADDIT ION AL I NFORMATION

On Tuesday, 12-11-2012 at 0922, Patrol was dispatched to 11901 Atlantic Blvd. (Academy Sports) in reference to a disturbance. A white male, i ndivid ual, who had entered the store with a shotgun, was i nside the store creating a disturbance and was now threatni ng employees with the weapon. Upon arrival, patrol observed the suspect leavi ng i n a white pick-up truck, being driven by another person, a white female. The vehicle was stopped, but started driving off. Upon being ordered to stop, the white male reportedly pointed the gun and fired at the officer. The officer fired his weapon striking the suspect. The driver drove a short distance before pulling over. Rescue responded and the white male suspect was pronounced dead at the scene. Cold Case Homicide Team with conduct a follow-up i nvestigation.

At this time I stopped Officer Hudson's account of the incident and told him that he should only talk to investigators about the incident. He told me the location of the incident. The reason he called is that I am on extended leave. Due to being Officer Hudson's supervisor, I responded to the scene to check on his well being and to see if there was anything I could do for him. Officer Hudson was busy talking to Detectives as well as Sheriff's Staff. I told Officer Hudson I would stand by in case he needed anything. I did not go up to the scene where the suspect vehicle was on Atlantic Blvd.

Dispatch advised that an armed man and woman were in the store. I notified dispatch to send a supervisor and more units. As I pulled into the Academy parking lot, dispatch advised the suspect was now threatening to kill the store employees. I cut across the parking lot to reach the front of the store. Employees began pointing to the rear of the parking lot adjacent to Atlantic Blvd. Dispatch then advised that the suspect was in a white truck leaving the parking lot. I saw the truck and drove toward it. The truck was preparing to leave the lot. I saw Officer Hudson standing outside of his car with his rifle. Officer Hudson engaged the truck as it drove away from him. He shot at the passenger side of the truck cab. As I drove by Officer Hudson toward the vehicle, Officer Hudson yelled, "He pointed a gun at mel" I had no more conversation with Officer Hudson past that. I was behind the suspect's truck as it turned West on Atlantic Blvd. from the parking lot. I called out the direction of travel to dispatch and followed the truck approximately 1/4 mile. The truck moved to the emergency lane and stopped. I was positioned to see the driver from a point of relative safety. I grabbed my JSO rife, charged a round, took the safety off and engaged the female in the driver seat. I did not see a passenger. The female exited the truck, shut the driver door, and put her hands in the air. I gave the female loud verbal orders to get on the ground, while engaging the cab of the truck. The female layed prone on the ground. Officer Hudson took over control of the female. I engaged the cab of the truck and began to see the passenger, not moving, slumped over in his seat. I gave orders to the passenger to show me his hands.I received no response. I saw a shotgun and pistol on the seat directly beside him. The passenger's hands appeared to be empty. Officer Spencer was covering the passenger side of the vehicle. The suspect twitched but appeared lifeless. Officer Carr pulled the suspect from the truck. The truck was then completely cleared. Officer Baughn took custody of the female and took her to my unit. The female's pockets were emptied by Officer Baughn. The female had a pink stun gun in her pocket. I am unsure which pocket. The female had several folded pages of religious type text on them. JFRD #58 medically examined the female and found no injury. The female did have blood about her entire person. The female sat in my unit very calmly. She made no utterances or requests. I asked the female pertinent information such as name, address, phone number, and email address. I did not asked the female any more questions. I spoke to several Detectives about the incident. Officer Baughn took custody of the female and took her from my unit to hers.

Upon my arrival at the store, I came into contact with several employees. I spoke with the managers of the business who advised that a man carrying a shotgun entered the store. When approached by employees to surrender his weapon, the man refused to do so. They added that the man walked to the gun counter where he was contacted by other employees along with employee Gergely. I spoke to a Mr. James Robert Gergely, who was working the gun counter of the store. Per Mr. Gergely, the man entered the store with a shotgun in his hands and came to the gun counter. He advised that once he observed the man with the shotgun in his hands, he approached the man asking if he could be of assistance. The man replied that he was looking for bullets for his gun. Mr. Gergely advised the man that he would need to surrender his gun and then he could assist him. The man advised Mr. Gergely that he is not going to give his gun up and that he is tired of dealing with the Federal Government. The man then held the shotgun at his waist, in the direction of Mr. Gergely and stated, " I WILL SHOOT ANYONE THAT TRIES TO TAKE MY GUN!". At that point, Mr. Gergely backed away from the man and advised his managers of the situation. He advised that the man then got ammunition from the shelf and left the area. Homicide Det. K. Munger #7936 arrived at the scene and I briefed him on what I have done. I then exited to business and wrote my report. I did not talk to the Officer involved in this incident.

I observed two officers removing the unresponsive suspect from the passenger side of the vehicle onto the sidewalk on Atlantic Blvd. I assisted in securing the white female involved but did not question her or hear her make any statements. I assisted in traffic control at the scene of the suspect vehicle and assisted with creating a crime scene perimeter. Once the crime scene was stabilized and traffic was diverted I was sent to Wai-Mart to purchase a case of water for the officers on both crime scene locations. Upon my return to the scene I was assigned to maintain crime scene security over the evidence and scene leading into the parking-lot of Academy Sports (11901 Atlantic Blvd.). I remained at that location until the crime scene was opened. I had no other involvement in this incident and never spoke with or made contact with the involved officer.

On the listed date and time, I responded to the Academy Sports at 11901 Atlantic Bv. in regards to a subject inside the store creating a disturbance with a shotgun. While enroute, HQ advised that the subject had left the store in a truck, and was attempting to leave the parking lot. Moments later I heard Officer Hudson advising that shots had been fired, and that the subject shot at him. Following that I heard a traffic stop being conducted on the truck on Atlantic Bv., followed by rescue being requested for a gunshot victim. On my arrival, I met with Lt. Douberly at the scene of the traffic stop. While there I observed a wm laying on the sidewalk on his back adjacent to a truck and learned that the subject had been shot by Police. I did not observe any movement from the wm. I was then assigned the immediate task of controlling the traffic on Atlantic Bv., then supervising the scene where the shooting had taken place. Once traffic was stopped and redirected on Atlantic Bv. I responded to the western end of the Academy Sports parking lot. Once there I observed Officer Hudson Standing by his marked patrol car. There was crime scene tape in an area around the car, and immediate area of the parking lot. I then asked Officer Hudson if he was ok, and he replied yes. I asked him if he had discharged his weapon and he replied yes. I then asked if it was his pistol or rifle and he replied it was his rifle, and that he had secured it inside his trunk. I then asked Officer Hudson if he could point to the area where the rounds were fired for the purpose of immediately securing evidence at the scene and he replied yes. He then pointed to an area adjacent to the center median of the western entrance of the parking lot. As I walked towards the area, Officer Hudson told me he could not remember if he fired 4-5 shots or 6-7 shots. Once there I observed 7 spent rifle casings. He then stated that he believed the subject had fired a gun at him but he was not sure because he believed he had "auditory exclusion". He stated the suspect pointed the gun and he then saw the gun make a motion as if it was firing. He then fired at the suspect. I then extended the crime scene with tape, requested additional manpower, and assured the scene was secure until processed by crime scene personnel. I also instructed Officers Wynn, and Boyd to act as historians at the scene. I stayed on scene until the processing was completed by crime scene personnel. I did not have any contact with the subject that was driving the vehicle the suspect had been in.

I began to head to the location as an additional unit. While enroute to the location, I heard an officer on the radio say something in an excited tone that sounded like "he tried to shoot me" or something similar. I began to speed to the the location with lights and sirens. I arrived in the area of 11600 Atlantic Blvd (in the East bound lane) in about 1-2 minutes. I observed several officers with guns drawn and pointed at a white pickup truck, which was parked in the West bound lane on Atlantic Blvd, just West of the Academy Sports parking lot. I observed an unknown white female near the left side (driver's) of the truck. She was proned out on the street and appeared to be covered in blood. I handcuffed the female and asked her if she is hurt or "shot" and she calmly said "no". Once cuffed, I rolled her to her side and assisted her to her feet. I then walked her away from the pickup truck and assisted officer L. Baughan #6887, who searched the female. We then placed the female in the back of Officer Sellers patrol car. I then observed other officers pull out an unknown white male from the passenger seat of the white pickup truck. The male appeared to be unresponsive and was laid out on the street next to the pickup truck. I had no other contact with the subjects or officers involved on this date.

The dispatcher advised that the customer was "signal 0" with a gun and was threatening the employees. She further advised that 4 units and a supervisor were enroute. I heard F740 advise he was enroute and shortly afterwards, I heard the dispatcher say the customer I suspect was leaving the store. The next dispatch said the suspect was getting into a white, long bed pickup truck along with a blond haired white female who was accompanying him inside the store. I heard F130 go 10-97 and 10-33 was initiated. Seconds later, dispatch said the suspect vehicle was leaving the parking lot driving past an arriving police car. A few seconds later, an officer (possibly Officer Hudson) came up on the radio in a very excited manner yelling. I was unable to understand the whole transmission but understood what I believed to be the suspect "shot at me". Another officer came up on the radio and announced that the suspect vehicle was leaving Academy Sports and was Westbound on Atlantic Blvd. I left Sub 2 and travelled toward the call. Other officers announced the vehicle was westbound and an officer believed to be Hudson transmitted, "be careful, he shot at me". Seconds later, an officer announced the vehicle was stopped at 11600 Atlantic and they were doing a felony takedown. I then heard an officer request, "rescue 10-68". I arrived on scene #2 (11600 blk of Atlantic Blvd) at 0934 hrs. Upon arrival, I observed the aforementioned white Ford pickup truck stopped in the far right (outside) lane of Atlantic Blvd. westbound. A white male was laying next to the trucks passenger door on his back with a large amount of blood on his head and upper body. He appeared dead and Officer Carr told me the suspect was dead. I saw other officers placing a white female into the backseat of another police car. She was covered in blood. I saw approximately 4 bullet holes thru the window behind the passenger seat of the truck, a shotgun leaning against the truck seat and a handgun (revolver) on the seat (near middle). Engine and Rescue 58 arrived and I told one paramedic to approach and check the suspect for signs of life while officers began to tape the scene. The paramedic told me the suspect was dead. I later learned that the suspect ended up on the ground after Officer Carr extracted him while clearing the truck and due to the close proximity of the weapons. He further stated that at that time, the suspect was "still twitching". Officer Hudson approached me with his rifle on sling over his shoulder. I asked if he was ok and he said "yes". I asked if he fired on the suspect and he said he did. I asked him where this took place and he pointed East towards the Academy Sports and said "back in the parking lot". I instructed him to place his rifle in his trunk and go back to the Academy Sports parking lot (scene 1) with Sgt Vandiver and to show him where the confrontation took place. I then instructed Sgt Vandiver to establish a crime scene perimeter in the parking lot and to manage scene 1. I instructed Sgt Carnes to go to Atlantic and Kernan Rd and to block 3 of the 4 Westbound lanes of Atlantic Blvd and to manage the traffic. We soon ended up blocking off all of Westbound Atlantic Blvd. Myself and Sgt. Kenney remained at scene 2 and managed that until homicide members and staff began to arrive. We maintained the outer perimeter until it was no longer needed.

I was directed by Ofc. L.J. Baughan (6887) to detain a male standing on the south side of Atlantic Blvd. I detained Gary S. Myers (12-10-60). Mr. Myers stated that he was in the woods and heard gunshots but did not see anything. I later learned that an intel bulletin had been issued for Mr. Myers from Jax Beach, who came and took custody of Mr. Myers. I also helped maintain the perimeter of the shooting sight at 11901 Atlantic Blvd. (Academy Sports) and assisted in maintaining a log of persons who entered the perimeter. I was positioned at the intersection of Withrow and Altantic Blvd. I maintained that position until 1355 when the E.T.s finished processing the scene. The log was sent in Ofc. D.H. Wynne's (7417) addendum. I was directed by Sgt. Vandiver to record that Human Resources was notified by Lt. Douberly at 1054 in reference to a CISM officer being sent. At 1056, he was notified that Sgt. Oliver was enroute. I spoke briefly with Ofc. K.A. Spencer (62058) who stated that he did not see the actual shooting. I did not ask him any questions in regards to the incident, nor did I speak with Ofc. B.A. Hudson (5845). I played no other role in the incident or the investigation.

On 12-11-12, at about 0930, I responded to the area of 11901 Atlantic Blvd (Academy Sports) in reference to an armed dispute (CCR 894206) with the suspect still at the scene. While I was enroute, the suspect was spotted by officers while fleeing as a passenger in a truck. I heard Officer Hudson say on the radio that the suspect had shot at him. The truck traveled about one quarter mile westbound on Atlantic Blvd, with officers following. The truck came to a stop, and it was clear to them that the suspect had been shot. As I arrived, somebody announced on the radio that all suspects were in custody and the situation was safe. As I drove past, I saw several officers around the truck and traffic backed up behind them. I began blocking westbound traffic on Atlantic Blvd at the intersection of Withrow Dr, as there were no officers there yet. I was soon relieved by two officers. I then directed Officer Watson to go into the Academy Sports and detain any witnesses or possible victims. In addition, I began to coordinate with Sgt. Vandiver and Sgt. Gidcumb in diverting all traffic from the final resting position of the suspect's vehicle on Atlantic Blvd. I then assisted in coordinating scene security of the entrance/exit driveway to Academy Sports where the shell casings and other evidence were located. At no time did I speak to the officer who fired shots, the suspects, or any witnesses who saw the shooting occur. I left the scene at about 1330.

Upon arrival, I conducted traffic control at the intersection of Atlantic Blvd and Withrow Dr. After this, I assisted in traffic control at the intersection of Atlantic Blvd and Kernan Rd. until I was relieved by a traffic unit. I then assisted in securing the area on the west side of the Academy Sports parking lot until I was instructed by Sgt. D.E. Smith to transport the involved officer with his patrol vehicle to his residence. While transporting the officer, I did not speak to him about the case. I then returned to the scene, retrieved my patrol vehicle and left the scene.

Shortly after this I heard Ofc. B. Hudson announce over the radio that the suspect was in a white Ford truck leaving the area and that the suspect had fired shots at him. Shortly afterwards I heard Ofc. Sellers announce on the radio that they had the vehicle stopped on Atlantic Blvd. I then drove to the scene and arrived where the vehicle was stopped (11601 Atlantic Blvd). a white female was out of the vehicle and on the ground behind the truck. The suspect was still in the truck in the passenger seat. The suspect appeared to be unconscious and was leaning on a shotgun. The suspect was unresponsive to our demands to exit the vehicle. I instructed Ofc. Sellers #5665 to keep his rifle trained on the suspect from the driver's side of the vehicle. I instructed Ofc. T. Carr #19945 to pull the suspect from the vehicle from the passenger side. Ofc. Carr did so and placed the suspect on the sidewalk. The suspect was unresponsive. Fire/Rescue was called to the scene. I then secured the area and coordinated the response of officers to this scene and the scene of the shooting. Ofc. Hudson (who was at the scene with the vehicle) advised that he was involved in the shooting and that it occured back at the Academy Sports parking lot. I had Ofc. Hudson go back to the shooting scene and standby and not to talk with anyone. Lt. Douberly arrived on the scene and called the Homicide/Cold Case Unit. I then coordinated with the Homicide/Cold Case Unit and coordinated traffic re-routing in the area.

I did not speak to the officer involved or any witnesses.

This addendum is being written to document the investigative efforts of Detective M.P. Chizik #7471. 12-11-12, 1002: I received a call from Sergeant B.L. Stevenson #5132, requesting that Detective K.L. Haines #7792 and I respond to the Academy Sports (11901 Atlantic Blvd) and assist the Homicide/Cold Case Unit in reference to an officer involved shooting. 1044: Detective Haines and I arrived at the scene and met with Sergeant T.K. Waters #6866, in the parking lot at the above location. Sgt. Waters requested that Detective Haines and I go into the business (Academy Sports) and interview employee/witnesses. 1105: I conducted an interview of Daniel Casas, Hispanic male, 08-20-66, 8800 Baymeadows Cir E., (Cell) 832-349-2813. The witness is the General Manager for Academy Sports and stated that he was inside his office when the suspect first entered his store. The witness stated that he received a phone call from an employee inside the store, named Chris Lablanc, who informed the witness that a male entered the store with a shotgun and refused to allow employees to make sure it wasn't loaded. The witness stated that he approached the ammunition aisle and observed a white male and white female loading ammunition into a shopping basket. The witness stated that the male suspect was holding what appeared to the witness to be a short barreled shotgun. The witness stated that he dialed 911 and reported the incident. The witness stated that he then entered the aisle and asked the male suspect if he could help him and if he could see his gun. The witness stated that the male suspect replied "If you try to take my gun, I'll blow your fucking head off". The witness stated that he then asked the male suspect what he wanted and he replied "I'm done. I'm out of here". The witness stated that the male and female suspect took the ammunition to the front, paid for the ammunition at register #8 and walked out of the business. The witness stated that the male and female suspect entered a white in color, Ford pickup truck with tool boxes in the bed. The witness stated that the female suspect entered the driver side of this pickup truck and the male suspect entered the passenger side of the truck. The witness stated that the suspect vehicle travelled south through the parking lot and then west towards the exit. The witness stated that he then observed two marked Jacksonville Sheriff's Office vehicles enter the parking lot and drive past the suspect vehicle. The witness stated that he was still on the line with the 911 dispatcher and informed the dispatcher that the police cars just passed the suspect vehicle. The witness stated that the two police cars turned around and got behind the suspect vehicle and a third police car entered the parking lot. The witness stated that the third police car stopped near the southwest exit to the lot and the witness observed the trunk to the police car open. The witness stated that as the suspect vehicle passed the third police car, he (witness) heard what sounded like 5 gunshots. The witness stated that the suspect vehicle continued to exit the parking lot and turned westbound

Synopsis: This is the officer involved shooting investigation which occurred at 11901 Atlantic Boulevard (parking lot of Academy S ports). On 12-11-2012, patrol officers were dispatched to the Academy Sports store in reference to a customer with a firearm inside the store. The responding officers attempted to stop the suspect, who was armed with a firearm, as he was fleeing the parking lot in a white truck. The suspect shot his firearm at a uniformed officer who returned fire, shooting and killing the suspect. The following supplement report is to document the investigative efforts of this writer.

WITNESS: 1.Nathan Ray Newton, w/m, 10-20-1975, 12250 Atlantic Boulevard, Jacksonville FL, 32225, (904) 517-7595.

DETAILS OF THE INVESTIGATION: TIME OF PAGE: TUESDAY/12-11-2012/1002 HOURS TIME OF ARRIVAL: TUESDAY/12-11-2012/1044 HOURS 12-11-12/ 1002: I was instructed by Sergeant B.L.Stevenson #5132 to respond to the Academy Sports store located at 11901 Atlantic Boulevard in reference to an officer involved shooting. 1044: I arrived at the scene and met with Sergeant R. Booker #6801 who requested that I begin interviewing witnesses. 1058: I conducted an interview with witness Nathan Ray Newton who is an employee of Academy Sports. The interview with Newton was conducted inside the Academy Sports store. The following is a synopsis of the interview which was not recorded. Newton said he was working at the front entrance of the business. His job is to greet customers as they enter the business. Newton observed a white male followed by a white female enter the business. Newton noticed the white male was carrying what appeared to be a shotgun by his side. Newton said the white male then attempted to avoid him by walking diagonally away from where he (Newton) was standing. Newton then informed the white male that company policy required that he (Newton) verify that the

shotgun was not loaded. When \,. _,ton told the white male that he would hc. * e to check his weapon the white male said "it's not loaded and it's my weapon." The white male then said "I need to buy ammo" and walked past Newton in the direction of the firearm section of the business. Newton said he then called the hunting/firearm department and spoke with an employee named Bill to let him know that a customer with an unchecked firearm was headed to buy ammunition. A few minutes later Newton observed the white male return to the front of the store where he paid for some items at a cash register and then exited the business. Newton said he did not have any additional contact or conversation with the white male or white female as they exited the business. Newton said he did not see where the white male and white female went to after they passed through the front exit doors of the business. Newton advised that he did not see what vehicle they were driving and that he did not observe the shooting. Newton had no additional information. While at the scene I did not speak with any of the involved officers or overhear any comments made by anyone involved in this incident. This completes my involvement in this investigation.

Sellers #5665 was giving verbal commands to the suspect to show me your hands, but the suspect was not responding. There was a revolver and a shotgun sitting next to the suspect on the seat. Officer Sellers had the suspect at gun point from the driver's side when I opened the passenger's side door and pulled the suspect out of the listed vehicle onto the g round. The suspect appeared to be deceased. Thompson Towing responded to the scene to tow the listed vehicle. I followed the tow truck to the homicide warehouse.

Other officers were attempting to clear the passenger side of the white vehicle. Based on the amount of officers already handling the felony takedown, I began to conduct traffic control in the westbound lanes of Atlantic Blvd until I was relieved to attend to a traffic crash with injuries that occurred at 1045 on the eastbound lane of Atlantic Blvd (CCR# 894332). As Ofc. T. Sellers and I turned into the parking lot from Atlantic Blvd, we were informed that the suspects had left the store and were leaving in a white truck. The truck passed by me as the information was broadcast. As Ofc. Sellers and I turned around to pursue the truck, Ofc. B. Hudson announced that the suspect fired at him as the truck was leaving the parking lot. Ofc. Sellers and I initiated a traffic stop on the vehicle as it pulled onto Atlantic Blvd westbound. After securing the truck, Sgt. Kenney had me accompany Ofc. Hudson back to the area of the shooting to secure the scene. Ofc. Hudson showed me where he was when he fired upon the suspect. Ofc. Hudson and I then located the spent brass from his rifle. I then held the scene for the collection of evidence while Ofc. Hudson stood by his patrol car. I had no further conversation with Ofc. Hudson.

The incident began at the Acaden.7 Sports, 11901 Atlantic Boulevard regart. g an armed customer. Patrol officers responded and engaged the customers as they were driving out of the parking lot which resulted in one of the individuals being shot by the police. The second individual, Tammy Lynn Gill, was taken into custody. Ms. Gill was eventually taken to the Police Memorial Building (PMB) where I interviewed her. Mike Ashourian 7880 Gate Parkway Suite #300 Jacksonville, Fl. 32256 white male D.O.B. 3-11-39 (904)9929000 "Details of the Investigation" Tuesday/December 11, 2012/0940: Sergeant T.K. Waters #6866 asked me to respond to the Academy Sports located at Atlantic Boulevard and Kernan Road regarding an officer involved shooting. I left the Police Memorial Building enroute to the scene. 1000: I arrived at the termination point at approximately 12000 Atlantic Boulevard where I observed a white Ford pick-up truck stopped next to the curb in the westbound lane of Atlantic Boulevard. I also saw a body lying on the sidewalk under a white sheet. I spoke with Detective W.A. Smith #5213 and he asked me to interview a witness. 1005: I began my interview of David William Hickox. He was waiting at his vehicle Which was parked in the median where we were located. Mr. Hickox told me that he was driving west on Atlantic Boulevard after dropping his children off at Landmark Middle School on Kernan Road. Mr. Hickox told me as he was passing the west entrance to Academy Sports (Atlantic Boulevard side) he heard four to six gunshots. Mr. Hickox stated that his windows were up but the shots were very loud. Mr. Hickox stated that he looked over towards Academy Sports and saw a truck with what he thought was a police car behind it. Mr. Hickox stated that it appeared to him that the truck was "possibly moving". Mr. Hickox, who is a photographer for a local news station but was not working at the time, stated that he drove a little farther west on Atlantic Boulevard and turned around to go back to see what occurred. Mr. Hickox stated that after he turned around, he saw a pick-up truck stopped with seven or eight police cars around it. He stated that the officers were outside of their cars and their guns were drawn. Mr. Hickox stated that he stopped his vehicle in the median and watched as the police pulled a woman out of the pick-up truck from the driver's seat. He stated that the driver's door was open. Mr. Hickox stated that he heard someone say, "Get him out of the vehicle". Mr. Hickox stated that he then heard the woman say either, "Ya'll shot him in the neck" or "You can't, he's shot in the neck". Mr. Hickox stated that he didn't see or hear anything else that occurred in the Academy Sports parking lot or at the termination point. Mr. Hickox left after I ensured that he didn't need to provide a sworn statement. 1050: I observed as an evidence technician photographed Tammy Lynn Gill prior to her being taken to the PMB to be interviewed. 1130: I left the scene to go to the PMB to interview Ms. Gill. 1212: I began my interview of Ms. Gill. I began the interview by advising Ms. Gill of her constitutional rights. Ms. Gill told me that she understood her rights and she signed the rights form. Ms. Gill was cooperative in the interview. She provided information regarding her relationship with the individual that was shot by the police, Lesly Cowan. Ms. Gill told me that they met in North Carolina in 2005. She stated that they have been in Jacksonville since February of 2007. During the course of the interview, Ms. Gill signed a "Consent to Search" regarding her truck, her residence at 1089 Atlantic Boulevard #14, an apartment at 310 Mayport Road and Units #206 & #330 at 310 Mayport Road. Ms. Gill also signed a copy of an e-mail that she acknowledged that she read and then sent earlier that day.

He was the person that Ms. Gill said that she sent the above referenced e-mail to. He is also the owner of the business that Ms. Gill worked for. Mr. Ashourian was cordial but he didn't want to speak with me over the telephone. I informed him that a detective would come see him. Mr. Ashourian provided me with the address of his office. I met with Detective G.L. Warkentien #7461 and provided him with Mr. Ashourians contact information. Tuesday/December 18, 2012/1305: I met with Detective Smith and gave him the original copies of Ms. Gill's constitutional rights form and the two consent to search forms. .. Case Status .. On 12-11-12, I responded to the 11600 block of Atlantic Blvd. to assist units calling for help with a felony stop. Upon my arrival, I observed a female, laying in the prone position, on the roadway, adjacent to a white pickup truck. The female had blood all over her. I also observed the passenger of the truck slumped over and several officers pointing guns at the passenger. Officers Kocs handcuffed the female and assisted me in getting the female to a standing position. Officer Kocs and Sellers assisted me in handcuffing and searching the female, who was subsequently detained in Officer Sellers patrol car. While searching the female, I removed several pieces of paper with various scripture and quotes from .. Book of Cowan.. printed on them, all of which were folded into four groups. There was also two make-shift wallets made from cardboard and had a website, names, numbers and other miscellaneous writing on them. One of the ..wallets.. contained $256 and some lottery tickets. The second ..wallet.. contained the female's Florida Driver's License, insurance cards, credit cards and other assorted card type items. There was also a sales receipt from Academy Sports, for ammunition, dated 12-11-12 at 0925. The receipt was retained by Detective Stucki. I ran the tag displayed on the truck (FL-526WTH) and the female's license in order to verify her identity. I then e-mailed the information to Officer Sellers, Sergeants Vandiver, Carnes, and Kenney, as well as Lieutenant Douberly, in case they may need it. At 1127, per the request of Detective Kuczkowski, I transported the female to the Homicide Office for interview. At 1148 I placed the female in an interview room, after the video equipment was started. Detective Kuczkowski responded to the Homicide Office with a green jail uniform and a bag lunch. I then escorted the female into the ladies room where she was afforded the opportunity to change out of her bloody clothes into the jail uniform and clean the blood off of her. Detective Kuczkowski then interviewed the female. I was asked, by Detective Kuczkowski, to stand by until a determination could be made regarding the disposition of the female's involvement in the incident. At approximately 1650 I escorted the female to the restroom and afforded her the opportunity to utilize the facilities. At 1755 I transported the female to the PTDF, per the request of Detectives Warkentine and Smith, who arrested her for the charges of Carrying a Concealed Firearm, Making Written Threats to Kill, and Fleeing and Attempting to Elude. At no time did I speak to Officer Hudson regarding his involvement in the incident, nor did I ask the female any questions regarding her involvement in the incident.

Upon arrival, I observed that several officers were already handling the situation, so I joined Ofc. E. Luciano ID #60846 in conducting traffic control in the westbound lanes of Atlantic Blvd until I was released from the scene by Sgt. D. Kenney ID #7277. I did not speak with the officer involved in the shooting.

The shooting officer involved was identified as Officer B.A. Hudson #5845. Detective W.A. Smith was assigned as the lead investigator. The following report details the investigative efforts of Detective D.E. Meacham #5654. DETAILS OF INVESTIGATION: Time of Incident: Tuesday/ 12-11-2012/0923 Time of Detective Dispatch: Tuesday/ 12-11-2012/0940 Time of Detective Meacham's Arrival: Tuesday/ 12-11-2012/1015 Weather Conditions: Partly Cloudy/70's Lighting Conditions: Daylight, outdoor scene OFFICER INVOLVED: Officer B.A. Hudson, #5845 Assignment: Zone 2 Task Force Date of Employment: 01-21-1991 Right handed Education: High School Diploma Injury: None Weapon Utilized: Knight's Manufacturing Company; SR-15, .223 caliber Shooting Position: Standing Malfunction: No Firearm Discharge History: 4th Shooting Uniform: Issued police uniform, with duty belt, wearing vest Radio Call Sign: 2286 INVESTIGATION 12-11-2012/0940: The Jacksonville Sheriffs Office Homicide Cold Case Unit was requested to respond to 11900 Atlantic Boulevard in reference to an officer involved shooting. The request was received via a text message from the Investigative Dispatcher a short time after the telephone notification. The text information included the address of the incident and the incident reporting numbers. 1015 Hours: Detective Meacham arrived at the scene, where the suspect vehicle stopped on Atlantic Boulevard, and met with the other members of the Cold Case Team. Detective Meacham was directed to respond to the west end of the Academy Sports parking lot (11901 Atlantic Boulevard) where the shooting incident occurred. Once at that location, Detective Meacham was directed to meet with the involved officer, and coordinate with the Crime Scene Unit detectives regarding the processing of that scene and the collection of any evidence. 1020 hours: Detective Meacham met with Officer B.A. Hudson #5845 and obtained his work history with the Jacksonville Sheriffs Office. Detective Meacham explained to Officer Hudson the Officer Involved Shooting Incident Protocol and what his responsibility would be throughout the investigation. Officer Hudson stated he was not injured during the incident, and that he did not experience a malfunction with the weapon he discharged. He was also wearing his duty belt and his ballistic vest. 1040 hours: Detective Meacham met briefly with Fraternal Order of Police Attorney Phil Vogelsang and informed him photographs would be taken of Officer Hudson, and of the rifle fired by Officer Hudson. Mr. Vogelsang is representing Officer Hudson. Detective Meacham then assisted the Crime Scene Detectives with obtaining and inspecting the Knight's Industries rifle used by Officer Hudson. Detective Meacham found the rifle had one round in the chamber and 19 live rounds in the single magazine inserted in the rifle. After being photographed, the rifle was collected as evidence and placed in the Property Room, by the Crime Scene Detective D.E. Anderson #7906. Detective Meacham then left the crime scene area in the parking lot and returned to the location on Atlantic Boulevard where the suspect vehicle stopped. There he met briefly with Detective Stucki before returning to the Homicide/Cold Case Office. 1815 hours: Detectives Meacham and Stucki drove to the Medical Examiner's Office where they were provided a print card with the deceased subject's right thumb print. 1835 hours: Detective Meacham delivered the print card containing the single right thumb print to J.E. Williams #64299 in the Records & Identification Unit. 1930 hours: Detective Meacham contacted the Records & Identification Unit regarding the identification of the print. Detective Meacham was advised the print was not identified locally and had been sent to the Federal Bureau of Investigation. *Note- The FBI later advised they were unable to identify the print. 2000 hours: Detective Meacham later accompanied Detectives W.A. Smith, G.L. Warkentien, G.M. Stucki, and Sergeant R. Booker to several locations in the Atlantic Beach/Mayport area to assist with the search of several structures. Detective Meacham did not locate or collect any evidence from these locations. 01-02-13/1045 hours: At this time, Detective Meacham has had no other involvement in this investigation.

12-11-2012/0940: The Jacksonville Sheriff's Office Homicide Cold Case Unit was requested to respond to 11901 Atlantic Boulevard in reference to an officer involved shooting. The request was received via a text message from the Investigative Dispatcher. The information provided included the location of the incident and the reporting numbers. 1005: Detective Stucki arrived at the scene and met with Homicide Lieutenant R. Schoonover. Detective Stucki learned that two individuals, a white male and a white female, entered the business of Academy Sports. The male subject was armed with a shotgun. When store employees asked to check the gun the male subject refused and threatened to kill several employees. Both subjects left the store and drove off in a white pickup truck. This information was passed on to the Jacksonville Sheriff's Office via a 911 call from store employees. According to Lt. Schoonover, the responding officers observed the suspect vehicle (white truck) driving out of the parking lot. Officer B.A. Hudson engaged in gunfire with the occupants of the truck. After the gunfire, the truck left the parking area and traveled a short distance west bound on Atlantic Boulevard. The truck came to a stop and the female suspect was removed from the driver's side and taken into custody. The male suspect was removed from the passenger side of the truck. He was suffering from gunshot wounds and rescue pronounced him deceased at the scene. After being briefed by Lieutenant Schoonover, I met with the other members of the Investigative Team. Detective W.A. Smith was assigned as the lead investigator. Detective Stucki was requested to assist with the scene investigation where the truck came to a stop. The other team members responded to the shooting scene in the parking lot of Academy Sports (11901 Atlantic Boulevard). 0945: Detective Stucki interviewed Officer T.W. Sellers, #5665 at the scene. Officer Sellers stated he is currently assigned to Zone 2/ Watch 3/ Gold Squad and his DATE OF Employment is January 2004. He is assigned to the F-1 sector of the zone. Officer Sellers stated he was dispatched to the Academy Sports (11901 Atlantic Boulevard) in reference to a white male and white female being armed while inside the store. He stated while driving to the location, he was advised over the Zone 2 police radio that the subjects were causing a disturbance inside the store. Officer Sellers stated he was given a description of the male subject (WM, green shirt, tan shorts) and advised that he was armed with a shotgun. Officer Sellers stated he requested via the Zone radio that additional officers respond. Officer Sellers stated when he approached the store he entered the parking lot of the Atlantic Boulevard entrance at the traffic signal. He stated he cut across the parking lot and approached the front of the store. Officer Sellers stated as he was pulling up there were several employees out front pointing to the southwest corner of the parking lot. He stated the Zone 2 dispatcher then voiced over the radio that the subjects were leaving the store in a white truck. He stated he turned his car around without exiting and immediately observed a white pickup truck traveling toward the Atlantic Boulevard exit of the parking lot. Officer Sellers stated he attempted to catch up to the truck before it exited the lot. He stated as he drove in the direction of the truck, he observed Officer Brad Hudson standing outside of his patrol car with his rifle. Officer Sellers stated Officer Hudson was positioned near the raised median that divided the entry/exit drive of the parking lot. Officer Sellers stated he was still a good distance behind the vehicle when he observed Officer Hudson discharge his rifle at the truck as it passed by him (Hudson). Officer Sellers stated as he tried to catch up to the truck he drove past Officer Hudson. He stated he could hear Officer Hudson yelling something to the effect of ..He pointed a gun at me... Officer Sellers stated the truck left the parking lot and turned west bound onto Atlantic Boulevard. He stated he voiced over the Zone radio the direction of travel. He stated he followed behind the truck for approximately % mile and then the truck pulled over to the side of the roadway. Officer Sellers stated he armed himself with his JSO rifle and approached the female driver. He stated he couldn't see the male subject at this time. Officer Sellers stated other officers arrived and they ordered the female out of the truck. He stated the female complied with their demands by exiting the truck and lying on the ground. Officer Sellers stated he maintained cover on the cab of the truck while Officer Hudson handcuffed the female. Officer Sellers stated he and the other responding officers approached the cab of the truck. He stated as he got close, he could see a white male slumped over in the passenger seat. He stated there was minimal movement by the subject and he described it as ..twitching... Officer Sellers stated he gave verbal commands to the subject to show his hands but he didn't receive a response. He stated he could clearly see a shotgun and a handgun in the truck. Officer Sellers stated he could also see that the subject's hands were empty. Officer Sellers stated as he and Officer Spencer maintained cover, Officer Carr removed the male subject from the truck.

Officer Sellers stated the male s .- A .;ct appeared to be deceased, which w ..onfirmed upon rescues arrival. He stated the female was placed into the backseat of his patrol car. He stated prior to being placed into the car, a search of her person revealed a pink stun gun and several folded pieces of paper containing typed text. Officer Sellers stated other than providing her name, the female didnt make any statements to him. Detective Stucki asked Officer Sellers if he could see what the occupants of the truck were doing as Officer Hudson discharged his firearm? Officer Sellers stated that due to the distance between their vehicles, he couldnt see what the subjects were doing.

1000: Detective Stucki spoke with the female subject as she was photographed by the Crime Scene Unit detectives. The female identified herself as Tammy Lynn Gill (WF, 7-14-1961). She stated she currently resides at a mini-storage warehouse located at 310 Mayport Road in Atlantic Beach. She stated she moved to the Jacksonville area in 2006 after traveling across country from her hometown (Roswell, New Mexico). Detective Stucki asked Ms. Gill if she knew the identity of the male subject. She stated he is her common law husband and his name is Lesly Cowan. She stated his date of birth is 10-04-1956 and he is from Waco, Texas. She stated they met in 2005 and he traveled to the Jacksonville area with her. 1015: Detective Stucki, along with the Crime Scene Unit detectives, began the scene examination of the suspect vehicle. The vehicle was a Ford F150 XL pickup truck displaying Florida tag 526WTF. The truck had three (3) Husky tool boxes affixed to its open bed. There was a box positioned under the rear window and the two others ran the length of the bed rails. The windows of the truck were not tinted which provided a clear view throughout the vehicle. The rear window had a center slide portion which was in the open position. There were four (4) holes in the rear window glass directly behind the passenger seat. There were additional holes in the tailgate and tool boxes. An examination of the interior of the truck produced three weapons that were observed in plain view. A .22 caliber revolver was located on the bench seat next to where the female driver would have been seated (by right thigh). A shotgun was located in the center of the truck cab. The butt stock was on the floor and the barrel was leaned against the front of the seat sticking up toward the roof. A .38 caliber revolver was located on the passenger side floorboard. It appeared it would have been between the male subjects feet prior to him being removed from the vehicle. Additionally, an Academy Sports plastic bag containing assorted ammunition (boxes) was located inside the cab of the truck. Writers Note: For a detailed description of the truck and the evidence collected, refer to the Crime Scene report and scene photographs. 1130: Detective Stucki contacted the District IV Medical Examiners Office and spoke with Investigator Betsy Moore. He provided her with a brief synopsis of the incident and requested they respond to the scene. 1145: The weapons removed from the suspects vehicle were inventoried at the scene by the Crime Scene Unit detectives. Spencer #62058 Patrol East Zone 2/ Watch 1/Gold (E-318) BEGINNING OF INVESTIGATION: 12-11-2012/0941: The Jacksonville Sheriff's Office Homicide Cold Case Unit was requested to respond to 11900 Atlantic Boulevard in reference to an officer involved shooting. The request was received via a text message from the Investigative Dispatcher. The text information included the address of the incident and the incident reporting numbers. 1000: Detective G.L. Warkentien arrived at the scene located at 11900 Atlantic Boulevard and was advised to locate Officer Spencer who was a witnessing officer. 1013: Detective Warkentien met with Officer K.A. Spencer #62058 at the entrance to the Academy Sports parking lot located at 11900 Atlantic Boulevard. Detective Warkentien asked Officer Spencer to provide what information he had related to this incident. Officer Spencer said he and Officer T. Sellers were dispatched to an armed dispute at 11901 Atlantic Boulevard (Academy Sports). Officer Spencer said he and Officer Sellers went into the parking lot of "Academy Sports" at the west entrance off of Atlantic Boulevard . . Officer Spencer also said they had received a description ofthe suspects as a white male with a white female wearing a burgundy shirt. Officer Spencer said he went straight into the parking lot to secure the east side of the store, while Officer Sellers went thru the parking lot towards the front of the store. Officer Spencer said Officer Hudson was also in the parking lot. Officer Spencer said as he was a quarter of the way into the parking lot they received a description of the suspects getting into a white truck with a tool box leaving the store. Officer Spencer said he passed the suspect vehicle in the parking lot of Academy Sports as he was receiving the description. Officer Spencer said after he had turned around Officer Sellers was the first patrol car behind the suspect vehicle. Officer Spencer said; Officer Hudson was at the entrance to the parking lot out of his vehicle with his rifle and "mic" in his other hand running up the driveway (entrance/exit) to the store. Officer Spencer said the suspect vehicle was in the driveway exiting out to Atlantic Boulevard. Officer Spencer said he could hear on the police radio and as he was driving by Officer Hudson saying; "they shot at me, they shot at me." Detective Warkentien asked Officer Spencer if he had seen or heard Officer Hudson shoot at the suspects or suspects shoot at Officer Hudson. Officer Spenser said he did not see or hear the shooting. Officer Spencer said he and Officer Sellers then got behind the suspect vehicle as it turned onto Atlantic Boulevard heading west. Officer Spencer said the truck stopped on Atlantic Boulevard and the driver; which was the white female got out of the truck with her hands up. Officer Spencer said the female was complying with their commands and she yelled the passenger had been shot in the neck. Officer Spencer said while the female was on the ground Officer Sellers checked the inside of the suspect vehicle. Officer Spencer said the passenger was slumped over in the passenger seat and a shotgun was sitting on the floorboard at the center console area leaning on the seat. Officer Spencer also said once they had more officers for cover, Officer T.J. Carr opened the passenger side door of the suspect vehicle while wearing rubber gloves and removed the male passenger from the vehicle and placed him on the sidewalk. Officer Spencer said once the suspect vehicle and suspects were secured he went back to the scene of the

Officer Spencer said he and Officer Hudson located the spent brass from Officer Hudson's rifle. Officer Spencer said he secured the scene for the collection of evidence while Officer Hudson stood by his patrol car. Officer Spencer said he had no further conversation with Officer Hudson. The interview with Officer Spencer was then concluded. 1105: The Cold Case Unit updated the staff on what has been learned thus far about the incident. 1200: Detective Warkentien departed the scene enroute to the Police Memorial Building. 1239: Detective Warkentien made contact with JSO ID/Records Unit to have NCIC/FCIC check on both suspects. Lesly Cowen, white/male, 10-04-1956 Tammy L. Gill, white/female, 07-14-1961 1355: Detective Warkentien departed the Police Memorial Building enroute to 7880 Gate Parkway. Detective Warkentien had learned from Detective Kuczkowski that an email had been sent from the suspects to the female suspect's employer earlier in the morning on the incident date. Detective Kuczkowski relayed to Detective Warkentien that he had made contact with the employer, who did receive several emails from the suspects. 1410: Detective Warkentien arrived at 7880 Gate Parkway, Suite #300 (Beaches 310 LLC.) and made contact with Mike Ashourian and Elaine Ashourian, who is the employer of suspect (Tammy L. Gill). Detective Warkentien introduced himself to Mr. and Mrs. Ashourian and explained that Detective Kuczkowski had spoken to them about an email that was sent by the suspects. Mrs. Ashourian said her area supervisor had an altercation with the suspects on Friday (12-07-2012) over the use of several storage units. Mrs. Ashourian said she started to make notification to "Tammy Gill" (suspect) to discuss the situation with the area supervisor on Friday. Mrs. Ashourian said "Tammy" did not return or answer her calls for three days. Mrs. Ashourian said they were unaware of the email sent by the suspects until their office was contacted by Detective Kuczkowski. Mrs. Ashourian then provided Detective Warkentien with a copy of any email sent from the suspects on Tuesday, 12-11-2012 at 8:55 am. (Writer's note: The email will be made part of the case file. Refer to the email for specific details.) The email contained threats to kill the top management staff and others from the business that employed the suspect {Tammy Gill). 12-11-2012/1802: Detective Warkentien completed an Arrest and Booking Report on the suspect (Tammy Gill) charging her with Written Threats to Kill or Do Bodily Harm to Person or Family Member, Carrying Concealed Firearm and Fleeing/Attempting to Elude a Law Enforcement Officer; After Order to Stop. The suspect was then transported to the Pre-Trial Detention Facility by Officer L.J. Baughan #6887. 1900: Detective Warkentien arrived at 1089 Atlantic Boulevard (Ashland Storage) to assist me in searching the suspect's residence for any items of potential evidentiary value. 12-18-2012/1410: Detective Warkentien arrived at the State Attorney's Office (Felony Filing) to file on the arrest of Tammy Gill. Detective Warkentien filed the case with ASA Joseph Sanson. 12-19-2012/0853: Detective Warkentien received an email from Agent Hooker containing information he had received in reference to the suspect (Lesly Cowan). The only record found on the suspect (Lesly Cowan) was an expired Texas driver's license and no other records. This concludes the investigative efforts of Detective Warkentien.

This is a supplement report to the officer involved incident that occurred on Tuesday; 12-11-12 at 11901 Atlantic Blvd. this report details the investigative efforts of Detective R.M. Gupton # 6053 and Detective W.P. Cullen # 5875. Tuesday/12-11-12/1045: Detective Cullen and I were dispatched to an officer involved shooting at 11901 Atlantic Blvd. 1100 Hours: Detective Cullen and I arrived at the scene, (Academy Sports). Upon arrival, we met with Detective Munger # 7936. Detective Munger requested that we assist him with interviews inside Academy Sports. 1110 Hours: Detective Gupton and Detective Cullen met with the following store employee: William Franklin Hampton, male, white, DOB: 05-19-56 14157 Thomas Pt. Lane Jacksonville, Florida 32225 (904) 221-0997 Mr. Franklin told me he has been employed at Academy Sports for the past two years. I asked Mr. Franklin to tell me what happened during the incident. Mr. Franklin stated he was working in the fishing area when he was contacted by the front store associate and told there was male and a female attempting to enter the store with an unchecked firearm. Mr. Franklin said he observed the male and female walk towards the firearms section of the store. Based on the male not checking his firearm at the front counter, Mr. Franklin said he contacted the store manager, (Daniel Casas). Mr. Franklin also said he observed the male was carrying a shotgun with him. Mr. Franklin said Mr. Casas called 911 to report the incident. Mr. Franklin said he attempted to observe the white male while also getting customers away from the firearms area. Mr. Franklin said the white female was standing near the male and did not say anything while inside the store. Mr. Franklin said the white male bought an unknown amount of ammunition and left the store. Mr. Franklin said the white male and white female got into a white Ford truck and left the store as police were approaching the store. Mr. Franklin said he heard 4-5 gunshots later but was unsure who was shooting. After interviewing Mr. Franklin, Detective Cullen and I observed the victim's vehicle. We observed multiple gunshots to the rear window of the white Ford truck. This concludes our involvement in this investigation.

I met with Detective Meacham #5654 who advised me to standby with him until further directed. 1012: Detective Meacham and I drove inside the entrance of Academy Sports and observed Officer B.A. Hudson # 5845 standing by his vehicle along with Sergeant W. D. Vandiver #5964. 1015: I made contact with Sergeant Vandiver who advised me that there were shell casings in the bushes in front of where Officer Hudsons vehicle was currently parked. (Parking lot exit/entrance, west side of parking lot, Atlantic Boulevard) 1035: Sergeant T.K. Waters #6866 called and advised me to go inside of Academy Sports and start witness interviews. 1042: I entered Academy Sports and was directed to the managers office at the rear of the business. Once I arrived I met with Officer R.R. Watson # 5772 who was reviewing surveillance video from the store. Officer Watson was sitting with the Store Director Daniel Casas (See Detective Chizik sup for his information) and was reviewing the store surveillance video. I noted the following while watching the surveillance video: 09:18 suspect and white female enter the store 09:19 suspect near the front entrance 09:20:34 suspect in field/stream camera 09:20:40 suspect at gun counter 9:22 suspect in field and stream camera 09:24:42 suspect at cash register eight (Writers note: Lestor Griffis provided me a copy of the store receipt for the suspects transaction; I then turned the copy over to Detective G.L. Warkentien #7461) 1050: Officer Watson told me that he was directed to the store to obtain witness information and work on securing the surveillance video. Officer Watson told me there were at least six employee witnesses (James Gergely, Chris LaBlanc, Daniel Casas, Bill Hampton, Lestor Griffis, Nathan Newton) and he provided me with their information. Officer Watson went on to say that the suspect had walked into the store carrying a shotgun. When a store employee asked to him to check his weapon in at the counter a confrontation ensued. The suspect refused to allow an employee to inspect the weapon to make sure it was safe and he refused to turn it over to staff. Officer Watson said the suspect then made his way to the gun counter where he was confronted by another employee. The suspect then picked up several boxes of ammunition and walked towards the front registers where he was checked out by a manager. The suspect exited the store with his shotgun and ammunition. He got into a white truck which was driven by the white female and left the parking lot headed towards Atlantic Boulevard. 1055: I contacted Sergeant T.K. Waters and briefed him on the above information. Sergeant Waters advised me that he was sending me several detectives (Detective Haines, Chizik, and Gupton) to assist with witness interviews. I then waited in the managers office checking the status of the surveillance video. 1120: I conducted an interview with Lester Griffis who told me that he received a phone call around 0920 from Chris LaBlanc telling him there was a man at the gun counter with a gun and that he was making threats. Mr. Griffis said he immediately dialed 911 and provided that information to the dispatcher. Mr. Griffis then ran towards the gun counter however there was nobody there. Mr. Griffis ran over to the optics isle and encountered a white male suspect holding a shotgun which he described as a .. short barreled pump action shotgun... Mr. Griffis told me the suspects back was towards him. He said the suspect was talking to Daniel. Mr. Griffis told me Daniel asked the suspect for his weapon and the suspect replied, .. l.m not giving you my weapon and if you try to take it 111 blow your fucking head off! .. Mr. Griffis said the suspect continued picking out ammunition and

eventually started walking towar , le front of the store. Daniel and Mr. Gr\ , followed the suspect and the white female he was with towards the front of the store. Once the suspect reached the front of the store, Mr. Griffis told the suspect that he would check him out at cash register eight. Mr. Griffis said he was trying to defuse the situation as much as possible and he thought cashing him out fast was the best way to get him out of the store. While Mr. Griffis rang up the ammunition he said the suspect said, "Don't worry I'm not here to hurt you." The female then paid cash for the ammunition and the pair began exiting the store. As they exited, Mr. Griffis said the suspect was saying something about the Federal Government; he said it sounded like he was upset about something but Mr. Griffis just couldn't make out what he was saying. Mr. Griffis said he and Daniel stood in the entrance of the store and watched as the suspect got into the passenger side of a white pickup truck. Mr. Griffis said the white male was wearing a red shirt, green shorts, tan boots, a straw hat and had gray hair. He couldn't describe the female he was with but he said she was driving the truck. He said the truck calmly pulled out of the parking space and headed out towards Atlantic Boulevard in the parking lot (west side of parking lot). He then saw a Jacksonville Sheriff's Office police vehicle near the parking lot entrance/exit (west side of parking lot near Atlantic Boulevard). Mr. Griffis told me when the truck left the front parking space the rear windows of the truck was closed. As it approached the area of the officer, he noticed that the rear window was open. He then saw the officer at his trunk and as the truck passed the police vehicle he heard a gunshot followed by five to six gunshot shots from a rifle. Mr. Griffis said he was sure the gunshots came from two different guns. Mr. Griffis told me he then watched as the white truck turned right onto to Atlantic Boulevard. 1156: I conducted an interview with James Gergely. Mr. Gergely told me he was working at the gun counter when the suspect approached with a shotgun. Mr. Gergely told me he approached the suspect and asked him to see his weapon so he could check it and make sure it was unloaded. He said the suspect was holding the shotgun with two hands and had the weapon positioned across his body towards his chest area. The suspect replied, "I'm not gonna give you my gun, I've been dealing with the Federal Government all day, I'm gonna shoot someone, where are the shotgun shells! " Mr. Gergely said the suspect lowered the shotgun but didn't point it at him. He said there was a white female with the suspect but she wasn't saying anything. Mr. Gergely told me he yelled for Chris and eventually Chris and Daniel arrived to help him. Mr. Gergely said he backed away when Chris and Daniel arrived but he did see the suspect walking into the ammunition isle. Mr. Gergely told me that he walked around towards the rear of the store to try and keep customers away. Mr. Gergely then watched as the suspect cashed out and exited the store. When asked about hearing gunshots, Mr. Gergely said he did hear multiple shots from at least two different weapons but he couldn't advise any further information. He did say he saw the suspect's white truck passing the officer's vehicle around the time of the gunshots. 1210: Detective C.T. LaValley #5275, Assistant State Attorney Mark Caliel and Assistant State Attorney Joe Sonson arrived on scene. While speaking with ASA Caliel, Mr. Griffis advised me he had a customer named, Kenneth Cheshire, who was at the gun counter when the suspect arrived. (See witness information for further details) Contact was not made with Kenneth as he was gone prior to the police arrival. 1238: I spoke to Chris LaBlanc who said he was working with James at the gun counter when the suspect came in. Mr. LaBlanc told me that he heard over the radio there was a male walking towards the back of the store with a gun. Mr. LaBlanc said James walked around to talk to the suspect who he heard say, "This gun is loaded I will kill you." Mr. LaBlanc said when he saw James put up his hands he fled out of the gun counter area and headed towards the rear of the business. Mr. LaBlanc described the suspect as a white male, 50 yrs old, short stocky, straw hat with a black band, red shirt, and green shorts. Mr. LaBlanc couldn't describe the white female the suspect was with. 1245: I exited the business; I did not have any further contact with any of the witnesses. This concludes my involvement in this case.

A DDITIONAL INFORMATION #1 ID# #7906 ReportinK Qfficers: D.E.ANDERSON On 12/11/12 at approximately 1730, I responded to the Crime Scene Warehouse and met with Detective W.A. Smith #5213. The listed vehicle and driver door evidence seal was photographed overall and in detail. A key ring containing multiple keys was removed from the ignition via the driver side door. The keys were photographed overall and in detail. The ignition key was returned to the ignition and the driver door was re-sealed with evidence tape, which was then photographed overall and in detail.
I then responded to Atlantic Self Storage Unit #14 (1089 Atlantic Blvd., Atlantic Beach) and met with Cold Case Sgt. R. Booker #6801 and Detectives Smith, D.E. Meacham #5654, G.M. Stucki #6796 and G.L. Warkentien #7461. Crime Scene Detective R.R. Scott #7887 also responded to the scene. The Storage Unit #14 was photographed overall and in detail. Three rifles and two revolvers were located in the unit along with multiple boxes of ammunition. A laptop computer and multiple thumb drivers were also located. These items were photographed overall and in detail. We then responded to Atlantic Self Storage Unit #330 located at 310 Mayport Road. The unit was photographed overall and in detail. No items of evidence were located or collected. The following items were collected from 1089 Atlantic Blvd (Atlantic Beach) Unit #14: 1 - Rohm .22 caliber revolver (Model 66 I SN IC252331) 1 - Camo Holster (from Rohm revolver) 6 - .22 Caliber live rounds (from Rohm revolver) 1 - I.J.A. & C. Wks. Revolver (UK caliber I UK model / SN M130963) 1 - UK 7.62mm Rifle w/ Bayonette (UK model / SN 3311525) 5 - UK caliber live rounds (from UK rifle I SN 311525) 1 - Hewlett-Packard Pavillion laptop computer (Model DV6000 I SN CNF7124QPY) w/ thumb drive 1 - JJ Higgins .22 caliber rifle (Model 36 I SN 2552429) 1 - UK 7.62mm Rifle (Model 1943 / SN 4A5063) 4 - UK caliber live rounds (from UK rife I SN 4A5063) 1 - Revolver cylinder 6 - UK caliber live rounds (from revolver cylinder) 2 - Thumb drives from upper level w/ lanyards 4 - Thumb drives on lanyards & key ring 1 - Laptop power supply and mouse 25 - Keys on key ring (removed from listed vehicle) The items were then submitted into the Property Room as evidence. Two bags containing items of evidence were collected from Det. Warkentien and were secured in the Crime Scene Blood Room for drying. On 12/12/12 at approximately 1350, the following items were removed from the Crime Scene Unit Blood Dryer and were placed in the Property Room as evidence. Officers were responding to an a h .d dispute inside the Academy Sports a ."" Outdoors store. (CCR# 894206) The suspect exited the store and entered a white Ford pickup truck. The suspect was the passenger. A traffic stop was conducted on the vehicle in the parking lot. A shot was fired at the officer from the rear sliding glass window of the truck. The officer returned fire with his SR-15 rifle. The truck's driver was not injured during the shooting and drove onto Atlantic Blvd. (westbound), stopping the truck approximately 946 feet west of the intersection (Atlantic Blvd. I Withrow Dr.). The suspect died at the scene. The weather conditions were; Temperature - 80 DEGREES Humidity 86 % Wind - 4 MPH SW Skies - Cloudy

Scene Location; The incident occurred in the Southwest parking lot of the Academy Sports and Outdoors located on Atlantic Boulevard in Jacksonville, FL. DETECTIVES AT SCENE; Homicide Detective Sgt. S. Scott #6386 Lead Crime Scene Detective H.R. Brooks #7536 Crime Scene Detective D.E. Anderson #7906 Crime Scene Detective J. Amponin #64623 Scene Description; The scene involved the parking lot near the intersection of Withrow Drive at Atlantic Blvd. More specifically, the incident occurred near the stop sign in the southwest corner of the parking lot. A raised landscaped median is located west of the stop sign that separates the incoming and outgoing traffic into the store parking lot. Investigation; A felony traffic stop was initiated on a white pick-up truck in the Academy Sports and Outdoors parking lot as the truck was traveling west through the parking lot. The truck appeared as if it was coming to a stop. Officer B. Hudson exited his marked patrol car with his rifle. The suspect (seated in the passenger seat) displayed and fired his weapon from the rear I back sliding glass window. Officer B. Hudson returned fire. The driver of the truck then proceeded to exit the parking lot and went West on Atlantic Blvd before stopping. Additional officers arrived at the scene of the final stopping point. The driver was removed from the vehicle and placed into a marked JSO patrol unit. The suspect was removed from the vehicle (passenger seat) by patrol officers and placed onto the sidewalk. He was pronounced deceased at the scene by Jacksonville Fire and Rescue personnel. The suspect was covered with a sheet by Rescue, and the Crime Scene Unit body screen was utilized to shield the suspect from the public's view. Atlantic Blvd. was shut down at the intersection of Withrow Dr. - westbound. The eastbound lanes remained open to traffic. C.S.U. Sgt. Scott was notified that I was responding to an officer involved shooting incident.

C.S.U. Detectives Anderson and Amponin were contacted and requested to respond to the scene to assist. Det. Anderson and Amponin took overall photographs of the scene as requested and collected evidence. Upon my arrival at the scene, I took photographs of the female subject prior to her being transported to the Police Memorial Building. I then went to the JSO Air Unit and took aerials of the scene. Detective Anderson met with Detective Smith and was briefed on the incident. Detective Amponin was requested to photograph the officer, his gun, collect the weapon and verify the rounds in the weapon. It was determined the officer had fired his assigned rifle seven times and there was one live round in the chamber of his rifle and 20 live rounds in the magazine. Detective Anderson and Detective Amponin collected the following evidence: (7) 5.56 mm casings from raised median in the parking lot SR-15 rifle w/ magazine, shoulder strap, and Aimpoint scope - Knights Manufacturing Co. - recovered from Officer B. Hudson .22 caliber revolver (RG) - from truck's driver seat .38 special revolver - from truck's passenger floorboard 1 2 gauge shotgun - from front bench seat inside truck (21 ) live rounds from Rifle - 1 in chamber, 20 in magazine (6) .22 cal live rounds from RG Revolver (1 ) .38 Special spent casing from chamber (4) .38 Special live rounds (6) 1 2 ga live rounds Control swab Touch DNA swab (RG Revolver) Touch DNA swab (RG .22 Cal live rounds) Touch DNA swab (.38 Special Revolver) Touch DNA swab (Rossi .38 cal casing / live rounds) Touch DNA swab ( 1 2 ga shotgun) Touch DNA swab ( 1 2 ga shotgun live rounds) Academy Sports bag (20) Buckshot Shells- Remington (live rounds) with boxes (40) Other live rounds (7.62 x 54R) in box Additional items were collected and documented in a Supplement Report by Det. Anderson. These items were placed into the Crime Scene Unit Dryer prior to being placed into the property room. The scene was searched and seven 5.56 casings were located in the raised landscaped median North of the intersection (Withrow and Atlantic Blvd.) The rounds ( EV#1 , EV#2, EV#3, EV#4, EV#5, EV#6, EV#7), were located in the mulch and on the concrete in this median. Additionally, it should be noted that after firing at Officer

Hudson, the truck's driver had to 1e around the median in order to exit t .. ,.;arking lot. As the vehicle was traveling south, Officer Hudson returned fire.

Upon searching the suspect's vehicle, three (3) weapons were located as described above in the property list section. Detective Amponin was assigned to photograph and document these weapons. A spent casing was found in the chamber of the .38 Special Revolver. Additionally, a .22 Revolver and a 12ga. shotgun were recovered from inside the truck. These weapons were loaded, but did not appear to have been fired. Two boxes of ammunition were located in an Academy Sports and Outdoors bag inside the truck. The suspect bought these items in the store during his dispute with management. The investigation revealed that the backstop for the Officer involved in the shooting was a dense wood line I trees. M.E. # 5 - Jeff Brokaw and M.E. # 14 - Betsy Moore responded to the scene. The Northeast body removal team responded and removed the suspect's body from the scene. This concludes my investigation on 12-11-12. Please view Detective Anderson's supplement report documenting her investigation with Homicide Det. W. Smith at the Atlantic Self Storage units on this date. Additionally, she documents the items she collected at the scene and placed into the JSO Crime Scene Unit Dryer. On 12-11-12, Detective Anderson sealed the truck at the scene prior to it being transported to the JSO Vehicle Warehouse at 1089 Haines St. The truck was followed by a Patrol officer to the warehouse. On 12-12-12, I was contacted by Homicide Detective W. Smith and Detective G. Warkentein. They requested that I respond to 315 Mayport Rd. (Atlantic Self Storage) in order to search Unit # 216. Upon my arrival, it was determined that a padlock was present on the Unit. JFRD was called to remove the lock. The Unit consisted of furniture and household items. Photographs were taken. I collected the broken lock and the key to the new lock placed on the outside. These items were placed into the property room. On 12-14-12, I responded to the Crime Scene Unit Vehicle Warehouse in reference to processing the listed White Ford Pickup truck. Upon my arrival, I met with Homicide Det. W. Smith. He stated that a consent to search was given from the truck's owner. I took overall photographs of the truck and the sealed Evidence tape. The interior of the truck was searched for projectiles I fragments. Two small fragments were located in the passenger floorboard and packaged. I then located the bullet holes in the exterior of the truck and attached string to each corresponding hole. Seven holes were located and notated as the following: BS #1 - IMPACT - rear bumper of the truck - no string - did not penetrate through bumper BS #2 - ENTRY - driver side - diamond plated side box - gray string in photographs The bullet's path is as follows : Entered through the rear of this tool box (near driver's side tailgate) approximately a 135 degree angle - grazed the lid of the bisected the tool box- exited the tool box at passenger's side back glass) - entered passenger side back glass and exited primary tool box (below through the passenger's door window (window was down). Two holes (through and through) were bullet went through the glass and struck the front located in the front windshield. It is unknown which bullet strike corresponds to this string I bullet hole. Additionally, it is possible that this bullet strike went out the passengers door window, as it was down during this incident. Statement of B. Hudson #5845
On Decem be r 11, 2012 I was travelling eastbound on Atlantic Blvd. in front of the Regency Mall. I was in d istu rba nce ca l l at the Academy Sports store involving a m a n with a shotgun . While en route I read in this info rmation had not yet been relayed by the dispatcher. Prior to a rriving a t the store, I observed two pol ice cars ente ring the pa rking lot approximately mile a head of me, so I knew that I had at least two officers for assistance if the situation escalated at the store. The d ispatcher then gave a clothing description of the suspect a long with information that the suspect was in a n older white p ick-up truck. It was at that time that I o bserved an older white truck approaching my location westbound across the pa rking lot. I then stop ped my veh icle as the truck stopped at a stop sign in the parking lot perpendicula r to my car i n front of me. I could observe a white female in the d river's seat, a nd a white male matching the description d ispatch had described in the passenger seat. I activated the trunk release button, and exited my veh icle q uickly. As I moved to the rea r of my vehicle my JSO patrol car and wearing my standard patrol uniform. I hea rd the d ispatcher say that there was a

for cover, I yel led loudly at the fema l e d river to "Stop I'' U pon reaching the rea r of my vehicle, the

female bega n d riving again m a king a southern turn from the stop sign onto the access road lead ing to at the truck, a n d began repeating orders for her to "Stop the truck I" The driver's window was down, so I knew that she cou ld hear my orders, but was refusing to comply. As I pointed my rifle at the veh icle my primary focus was on the male passenger based on the information provided by the d ispatcher as the person who had been a rmed inside the store. As the veh icle was d riving past me I observed the male passe nger i n the truck turn a ro u nd in his seat, a nd begin yel ling at the female to "stop the truck I" The male suspect a ppeared to be yel ling at me, but I cou l d not hear him. At that point the truck was travel ling southbound toward the traffic lig ht o n Atlantic Blvd ., a nd was pointing a ha ndgun at me thro ugh a n open rea r slid ing glass window. When I observed this I was still the Atlantic Blvd . I retrieved my rifle from my trunk, cham be red a ro und i n the ba rrel, pointed the rifle

approximately 30-40 feet away from me. The car had a l ready passed m e so the d river was no longer in my line of fire. I could a lso see my back d rop consisted of a wooded a re a of tall pine trees. It appeared to me at that time that his h andgun was moving in a simila r fashion of being fired and going through a recoil process, but I could n ot hea r h is gunshots. Fea ring for my life, the lives of the citizens in the a rea and my fellow officers I bega n to fire my rifle at the suspect. After a few shots, I coul d see the glass on the rea r window breaking, a nd I cou ld see the suspect lean forwa rd . I could not determine at that time if he was leaning forward as a result of being stuck by gunfire o r doing it to ta ke cover. I believed my shots had struck the suspect, b ut there was no evidence to suppo rt it at that time. My back d ro p had begun to cha nge d ue to the vehicle continuing towards

Atlantic Blvd . so I ceased fire, assessed where the veh icle was turning towards and ra n towa rds my patrol car . The veh icle t h e n co ntin ued t o t he traffic light o n Atl a ntic Blvd ., a nd turned westbou n d . Officers Sellers a nd Spence r fol l owed the suspect and cond ucted a traffic stop. I called on the rad io to the officers to be aware of the shooti ng, a nd that the suspect had shot at me as well. I don't remember what my exact words were at the time. I pa rked behind the truck and a pp roached on foot. I observed the female laying o n the street o n the d river's side of the truck with blood o n her clothing. I a sked her if she had been hurt, a n d she ca l m ly replied, "No" . I com m unicated with Sellers and Spencer concerning the suspect in o rd e r to ta ke him into custody a nd spoke briefly with respond ing s u pervisors a nd officers. The suspect was removed from the veh icle on the passenger side, but I did not see who removed him. I did not observe the i nterior of the vehicle a t a ny time. I i nformed Sgt. Ken ny that the scene of the shooting was at the parking lot of Academy Sports, a nd he instructed me to return there for the investigatio n . I then d rove back to the scene, a n d parked north of where it too k place and waiting for supervisors to a rrive. I remaine d at the scen e u ntil instructed to leave by Homicide.

It was reported a white/male had entered the store with a shotgun and was creating a disturbance. a white pick-up truck, being nd white/female were leaving the st1 were made aware of the white/1 rehicle continued to leave the drive,n by the white/female. U p1 mg ordered to stop by police officers scene, the white/male reportedly .,uinted the gun and fired at the officer. The officer fired h is weapon striking the suspect. The d river (white/female) drove a short distance before pulling over and being taking into custody. The white/male was pronounced dead at the scene by Fire/Rescue. The white/female (Tammy L. Gill) was then transported to the Police Memorial Building to be interviewed. Detective L.E. Kuczkowski met with Ms. Gill and advised her of her constitutional rights via the pre-printed Constitutional Rights form . Ms. Gill agreed to talk to Detective Kuczkowski in reference to the incident. D u ring the interview and investigation process it was found Ms. Gill was in possession of a pistol which was lying u nder her leg while she was fleeing from the scene after being ordered by police officers to stop. Ms. Gill was asked if she had a permit to carry a concealed firearm and she replied no. Investigation also revealed earlier in the day Ms. Gill had assisted in reading and sending an email to a former employer. The email contained a threat to kill the em ployer and family mem bers. Ms. Gill was shown the email and admitted to and sig ned a copy of the email stating, she read the email and sent it. M s . Gill was then transported to the Pre-Trial Detention Facility.
