Fees are not refunded. Falsification of information on any request for vehicle information will result in the loss of services with the Department's Motor Vehicle Division. When you make a request for information, you are solemnly swearing, affirming or promising under criminal penalty of a felony for fraudulent use of a false or fictitious name or address or for making a material false statement punishable by fine up to $5,000.00 or by imprisonment of up to 5 years, or both, that the representations you have made on this form and on any other required document or request are true and accurate. IMPORTANT NOTICE TO ALL PERSONS FILING ABANDONED MOTOR VEHICLE FORECLOSURE AFFIDA VITS As you should already be aware, new statutory procedures for the creation and foreclosure of abandoned motor vehicle liens took effect on January 1, 2003. New, statutorily mandated forms have been adopted by the State Department of Motor Vehicle Safety, including the affidavit to file with the court. Eventually, that form will be used in every case. However, there will be a transition period of about twelve months during which time the old statutes and the new statutes will be used, depending on the time oftowing or abandonment. WHICH LAW APPLIES TO MY CASE? For vehicles towed or abandoned on or after January 1, 2003, you must use the new DMVS affidavit form (MV-603a) with all required exhibits; any other forms will be rejected. For vehicles towed prior to January I, 2003, the old procedures still apply. Do not attempt to use the new forms for vehicles towed prior to January 1, 2003. Your affidavit must comply with the old statutes and must now provide a tow date so that the court can confirm that the old statutes mmlY. Failure to include the tow date will result in denial of your claim. WHAT ARE THE NEW FILING REQUIREMENTS UNDER THE NEW LAW?

The new law provides that the DMVS will be establishing uniform forms for use in lien foreclosure proceedings (0. C. G.A. 40-11-5). You must continue to provide a completed order for the court to sign. The DMVS has adopted a form order which you must use; a copy of the order form is attached to this notice. WHAT ABOUT THE EXHffiITS REQUIRED IN MV603a?

As mentioned above, the DMVS forms are now mandatory. Use of the exhibits required by that form is therefore obviously mandatory. Authorization to Tow: a. Law Enforcement Tow Ticket; b. Written authorization from the private property owner; or c. Plaintiff's business record that provides, the date of tow, the location the vehicle was towed from, the name (and badge no. if a law enforcement officer), title and employer of the person who authorized the tow. 4. NCIC Report. Obtain this document from Central Records. It provides each name and address of each owner and lienholder. 5. T22-B. Obtain this document from the MVD. Then have an officer come out to the location of the vehicle and complete the form.

If the vehicle is registered in another state provide a copy of the form used to request the names and addresses of owners and lienholders in that other state. 7. MVD Vehicle Title & Tag Information Report. (Or similar report from another state if the vehicle is registered out of state.) This report will provide you with the registered owner(s) & lien holder(s) mailing information. This report will probably say "no record.". 8. Newspaper Ad. 7 Day Letter. - A demand letter mailed to all owners and lienhold~rs within 7 days of tow informing them the vehicle will be deemed abandoned unless Iretrieved within 30 days of tow. Examples are available.

MV-603. Obtain from MVD, complete and file it at the MVD. If thJ vehicle is
registered in another state provide a copy of the form used to request the names and addresses of owners and lienholders in that other state.

8. MVDVehicle Title & Tag Information Report. (Or similar report from another state
if the vehicle is registered out of state.) This report will provide yo~ with the registered owner(s) & lien holder(s) mailing information.

9. MVDform letters. (Or identical letters produced by you if the vehicle is registered in
another state.) Fill out completely, including the list of fees and "DeKalb" as the Magistrate Court where the owner may request a hearing.

1O. Proof of Mailing and delivery of the MVD form letter. (A copy 0f the returned
envelope or green card is the most cornrnon.)
